Cheerleading gyms take fight to court

A cheerleader fight in Montgomery County is taking the call to "be aggressive" to a whole new level.

Competition in cheerleadingis normally limited to girls and some boys jumping, tumbling and flying for spots on private teams that can cost $3,500 a year to join.

Or it's those private teams, with names like "Rapture" and "Tiny Tantrums," competing for bragging rights in the multitudes of competitions held around the country each year.

But now three Montgomery County cheerleading gyms are locked in an ugly legal battle that involves accusations of poaching cheerleaders, stealing funds, setting up false Web sites and starting a whisper campaign that a rival coach is a pedophile.

The lawsuit, which involves a well-known international law firm that represents corporate giants such as Microsoft and Boeing, shines a light into how competitive the business side of cheerleading can be.

"Cheer ... is a wonderful sport for your child, but you know, it is a cutthroat industry," said Wendy Bender, a parent of a 9-year-old who has been a member at two gyms involved in the suit. "Everybody wants to win; it's just like the movie 'Bring it On.' "

The legal fight started whenXtreme Acro and Cheer sued one of its former coaches, Nicolas Sweeney, for breach of contract. Xtreme's owner, Judi Eicher, said Sweeney was the "face" of the gym who stole money and poached the gym's cheerleaders for a new facility he was starting on his own, called Fearless Allstars, while on the clock.

"He just ripped her off," said Sarah Hall, Eicher's attorney. "He tried to walk out the door with her business."

But Sweeney is pushing back with a counter-suit of his own. He sayshe left Eicher's Rockville gym because it was poorly run, and now his competitors, Xtreme and its new partner, Gaithersburg's Dream Allstars, are trying to shut down his new business.

Sweeney said he's been the victim of false rumors spread by a coach at Dream that he has inappropriately touched children.

"Any male coach in this type of industry, that can pretty much kill them," Sweeney said.

Bender said the staff at Dream told her about the rumors before she left that gym and enrolled her daughter at Fearless, which is in Gaithersburg. But she said the rumors have proved to be "totally unfounded."

"I totally trust this gym, I totally trust Nick," Bender said. "I would leave my child with him in a minute."

Sweeney's lawsuit also accuses Eicher's son of setting up sham Web sites that would direct people looking for Fearless' Web site to Xtreme's Web site.

Hall works for Winston & Strawn LLP, which has 12 worldwide offices and a client list that reads like a Who's Who of Fortune 500 companies. She called Sweeney's counter-suit "frivolous" and added that Eicher didn't know what her adult son, who lives in Florida, did.

Hall also pointed to Dream's efforts to have a cheer team made up of special-needs children, which has drawn national media attention, as proof of the good work the gym does.

Paula Kearney, whose daughter is on that team, said the owners of Dream have been "wonderful."

"It's the best thing we've been involved in," she said.

Cheer may be a wonderful sport for a child, but it's THE most dangerous college sport in terms of injuries. Nyeeshia: you can be fat & be a cheerleader. You can even be fat & be a gymnast.

Too Tall Gymnast, that isn't true. That report has been debunked over and over when you look at injuries per athlete. I think ice hockey and gymastics are actually higher. nyeeshia, you can become a cheerleader if your out of shape but its harder. you have to be athletic to be good at it but its good for becoming athletic!

This is really incredible! I am surprised that an attorney with such a high profile firm would even take a case like this. Athletes--including cheerleaders change teams/gyms all the time. No one organization "owns" a cheerleader! Cheerleaders who like their coach will follow that coach from gym to gym. I think these women at Xtreme and Dream really need to get over themselves and gear up for some real competition! They have really been the only game in town for a long time and now they will have tough competition! We should also not lose sight of what really matters in this issue: THE KIDS! When they see the adults acting immaturely they emulate that behavior. Quit being poor sports, Xtreme and Dream, and work hard to build your program!

Sure cheerleaders leave from gym to gym but it is completely unethical for a coach (in this case director) to recruit girls to come to his new gym WHILE HE IS WORKING FOR ANOTHER GYM. Every organization has bad apples so do not judge an entire group on what one or two people say. You must also remember that it is Mr Sweeney who upset the kids who decided to be true to their gym. Now that the shoe is on the other foot he plays the "how can they do this to the girls." Xtreme is, and always will be, the gym most concerned about the development of the athlete - not just winning. Remember everyone its just cheerleading.

From what I hear, they merged with the team that the owner along with a coach did the same thing to another local gym. I don't understand how they are willing to merge with them and be a part of that, when they feel the same thing happened to them. I guess it doesn't go both ways. It's a shame people can't just be adults and worry about themselves and not what everyone else is doing. There's enough cheerleaders in the area to field all teams. Just let it go and let the kids enjoy their sport. Concentrate on the kids, not your checkbook.

Talk about people being adults...part of the responsibility of being an adult is keeping your word..and more over, written contracts. If Mr. Sweeney had a contract with Xtreme that prevented him from opening or working at another facility within a certain radius (as most cheerleading coaches have to sign when they start with a gym), he broke his contract, and is now being held liable, as he should be.

I agree it is all about the kids...a concept that seems to be lost on Nick Sweeney since he had no problem walking out on the girls at Xtreme before the end of the season and encouraging others to follow. He left behind kids that were devastated by the loss of their freinds and heartbroken over the fact that they would not be able to finish the season by attending the National competition for which they worked so hard to earn their paid bid. You all need to remember, it is not "just cheerleading" it is a business that is governed by laws and ethical standards that should be upheld.

Judy Eicher should have sold the team to Nick Sweeney when he offered to purchase it – twice! We would have happily stayed with Xtreme because Nick and his coaches are excellent! Judy Eicher NEVER had a kind word, a smile, or just a simple ‘hello’ for me or my daughter until Nick decided to leave. Then, all of a sudden, I start receiving obvious hi’s, bye’s and smiles from Judy??? Talk about feeling like a dollar sign. But we stayed with Xtreme because I could see there was a high quality coaching staff who my daughter enjoyed working with. Where the coaches go, we shall follow. GO FEARLESS!!!

In the business world how Nick Sweeney went about opening his own gym was unethical, and wrong. He left before the season ended telling the athletes that he was leaving while they were at competition and gave them his new web site to his new gym. He was still employed by Xtreme.

All of the moms who have been lured to Fearless from either gym have taught their daughters that when you don't get your way you leave. I know because I watched them leave. The only gym my daughter has ever left, closed down. We have been with Dream ever since. I work VERY hard to teach my daughter that when you don't get your way, the important thing is that your doing the thing you love. If we changed gyms, schools, jobs, every time you felt slighted, where would that leave you? Cheer is just one example of how life sometimes gives you lemons, and you should ALWAYS make lemonade. Any moms who changed gyms out of some deep need to placate their daughters, should be ashamed. And I shudder to think of the adults these girls will be after having moms like these.

Mr. Sweeney's countersuit is a joke. He clearly was full of fear...that Ms. Eicher is finally holding him accountable for his actions...and was grasping at anything he could to come up with a countersuit. Bringing in all these other issues? Pathetic. I hope for his sake that Mr. Sweeney's lawyer is as good as Ms. Eicher's...but since he/she wasn't mentioned once in the article, it's not looking good for Nick.

Ironically, at that very UMBC competition, I witnessed an athlete that Sweeney placed on a tiny team (age 5 and under division) who I know for a fact was 7 because she was a student going into second grade at the school where I worked...so who is the cheater now? It is all about ethics.

Re: Cheating at UMBC. The team involved had athletes that were *way* too old for the division in which they were entered. This was confirmed when the same team entered their "proper" division at their next competition. It had absolutely nothing to do with the Dream parents whatsoever. Who would want to be involved with such a team that teaches your kids that it's okay to break the rules?

Except that the age of an athlete would have to be "officially" challenged by another team. The challenging team has to pay a large fee to even bring the challenge. Then, and only then, the competition will examine each one of the birth certificates. I'm sure the Dream management didn't feel embarrassing another team in front of everybody was the best course of action.

This is really shocking - Not the disagreement between the gyms, but the nasty comments and accusations being made here. All of these gyms have developed programs for athletes in the area, and it is up to the parents and athletes to choose where to join. If the gyms have a legal or business disagreement, that should be decided in court. Xtreme and Dream have grown their programs over the years and should be proud of their success. Mr. Sweeney is an excellent coach who worked not only at Xtreme but for many other programs in the area and had the right to open a gym of his own. My daughter absolutely loves him, and I trust him implicitly. I wish Mr. Sweeney and the other gyms the best of luck this season. Please stop this nonsense and let the courts figure out the legal and business issues.

Let's all please set a better example for our children by recognizing that there are at least two sides to every story. I have been to each of these gyms, and they all have great programs, coaches and athletes. We should be focusing on raising rational children who understand the value of sportsmanship, not hurling insults and terribly damaging personal attacks without truly knowing all of the facts.

Honestly its cheerleading. Bring it to the floor Dream or Xtreme or whatever you are now.. Dreams just mad because Fearless is a HUGE threat to their program. Dream will be shut down within a year because Fearless is nice and friendly to every athlete and very welcoming. I've never met a better coach then Nick Sweeny. He is obsessed with the sport and lives for cheerleading.

Does anybody understand Nick's contract was up??????? Done,finished,over. Nick approached Judi and her organization over and over to try to reach an agreement to a partnership or to buy the program. Nick was forced to leave as Judi was too greedy. I'm sure Judi wishes she could turn the clock back now! And one more thing, oh gee, if Nick were such a bad man and was inappropriate w children(totally false) why would Judi allow him to be part of her business? There really isn't anything more gross about the LIE they made up about Nick Sweeney. Shame on Dream amd Extreme!!!!!!!!!!!!!

"So unfair" is exactly right! But, it's even more absurd than that. Nick didn't even have a contract or non-compete with Xtreme at all! He was an independent contractor for Xtreme and many other programs in the area and never worked exclusively at Xtreme. If Xtreme was relying on him to support their entire program, that was their business error - they always knew about the other programs he was working with! He is committed to his sport and his gym and never would have filed a lawsuit against anyone. Sadly, he had no choice once Dream and Xtreme teamed up to put him (their only direct competition) out of business. And, by the way, has anyone figured out yet that the attorney for Xtreme is the husband of the owner of Dream?! How convenient.

It could be argued than anytime that Mr. Sweeney chose to leave was "unethical". But it was not illegal. The facts are that he had no contract and it was an open secret that he was trying to purchase the program from Ms. Eicher but the two couldn't come to an agreement. So he choose to leave. Leave it to an attorney to argue that he "stole" athletes when the athletes left on their own and have the right to cheer for anyone they want to. When do you start suing the children that left? This will go nowhere and only benefit the attorneys at the expense of the children.

Nick's contract wasn't up. He left on April 5th...almost a full month before the end of the season, and the last competition.

Also - do you have any idea what the terms were that Nick was proposing to buy the program and/or gym? He wanted to make monthly payments to Judi for a few years. Basically he wanted Judi to give her an interest free loan. And you call her being greedy for turning it down? Nick's an idiot, of course Judi didn't go for it - but that was all part of his plan. He's been planning to leave with her program all along. And YOU fell for it!

I'm so excited for this to go to court so that all the truth can come out, and shut everyone else up. The truth will always prevail.

And let's not even get into his talent as a coach. After watching girls struggle with backhandsprings for several years under his direction I have seen them move to roundoff backhandspring tucks, standing tucks, layouts and even some have gotten their fulls under the direction of the new coaches at Xtreme in 2 short months! This was something Nick coudn't accomplish in all the time he was at Xtreme. Also, don't forgot the many times our teams got penalized 25 points for the illegal stunts that Nick created. One has to wonder, was this a result of a lack of knowledge or another cheating tactic hoping the judges wouldn't notice. Either choice doesn't speak highly of his skills as a coach. Fortunately last year our teams were talented enough inspite, of his coaching they could still win with 25 point deductions.

Facts are facts whether you like them or not: no contract, no breach, coach left, some girls followed, some did not, purchase offer refused twice with terms, once cash up front also refused, everyone moving on- NOT because a suit brought by the Dream owner husbands firm representing Xtreme- which the article forgot to mention. Can't believe the owner of Xtreme who I thought I knew is allowing her good name to be used as a pawn for Dreams ugly games. Ironic and full of hypocrisy is that Dream who is behind the suit was OH BY THE WAY-etablished by the owner and a CONTRACTED coach "stealing" kids while on the clock at USA.

Make the choice that is best for your athlete and family- shut up and move on and stop dragging the kids through this mess. Let the courts settle this- Enough already!

Judi Eicher is one of the most compassionate and kindest persons I know. Her first priority has ALWAYS been the KIDS. She would never have done to the kids what Nick did. Many of the parents that went to Fearless were the ones that said Judi was too nice to be a business owner, it's shocking how opinions change when your backs are against the wall, right Fearless?

Reading this article and subsequent comments confirms why Montgomery County all star cheerleading gyms have been seeing a decrease in numbers.. so much blind hatred between gyms. I'm all for healthy competition, but this slander and mudslinging is ridiculous. As a former parent of several all star organizations within Montgomery County, I am truly disgusted and am ashamed to have ever given my money to those three gyms. I hope that once the competition season does start, these two organizations will not have a full out fist fight in the stands, because that's where it seems to be heading.

One has to wonder, where did this "front page" article come from. It is obviously not front page worthy in comparison to H1N1, Obama's health care plan, the economy. Was this engineered by Fearless because of their "fear" of what the courts will decide?

Of course a high profile law firm would take this, especially when one of the attorneys in the firm is married to an owner of Dream! Look at the publicity that's already been generated. Anybody can sue for anything - even for an alledged contract - just because they are unhappy that Mr. Sweeney started his own gym and were unhappy with Xtreme's operations.

I've been taking my child to Xtreme for 6 years...and I have nothing but wonderful things to say about that place. Judi Eicher is kind hearted, sweet, and honest - and wouldn't hurt a fly. Everything is so organized and together at Xtreme, and me and my family been so happy there.

From what I hear Nick Sweeney treats the cheerleaders very well. He doesn't scream and put them down, like the coaches at the other organization. These are just children and every child deserves to be treated with respect and dignity. Some of these coaches could learn a thing or two from Nick.

As a parent with a child on one of the "other" local teams, I think this is just what the doctor ordered! Parents and a short term coach cherrypicked and enticed several of our high level girls to quit and join them. I cant believe that this organization is having sour grapes because simalar activies have happend to them. I feel terible for the kids who have to work in the midst of this distraction, but the rest of you grownups get what you deserve. Whatever happened to developing your own students?
I applaud parents who stay with one team (no matter the organization), thats where your child gets to learn values like LOYALTY, RESPONSIBILTY and INTEGRITY! That is more valuable the the athletics.

From what I have heard Dream has done its share of cheating as well. You know who you are. I work at another gym and I heard that some coaches at Dream yell and scream at their atrhletes right before taking the floor. I have seen young girls start the competition in tears. How horrible and embarassing for an organization .

I agree with the SHAME comment. This is just a tiny fraction of what goes on in the allstar cheer arena. Anyone who doesn't know much about the sport, please do not read this and think this is what happens. It really is a great sport that teaches young children, dedication, teamwork, commradery, hardwork, and responsibility. It really has made my child to become such a well rounded person. Although, she is not affliliated with any of these gyms, it's just something else to try and bring down such a growing sport. I hope all of this settles down for the kids' sake because these young ones have to go to school and interact together and you (ADULTS) are putting them in a bad place. Please keep the kids in mind, FIRST- Do whats best for them!!

Hello moms and dads, there is a right that each one of us has - Freedom of CHOICE. Cheerleading is a sport of endurance and skill. The comments above are making a mockery of the sport. How can you expect your children to perform at their best when you instill such hatred and rivalry in them. We at FEARLESS refuse to participate in such childish behavior and will embrace and respect all organizations. Our girls work very hard to get to where they are and should not have to worry about being on the attack when competitions roll around. Let's all take a deep breathe and remember that we are role models for our children. Best wishes to all for a successful season.

There is no way Dream or Xtreme (DreamX) can be on that list, Dream wa a JOKE at Worlds - can't believe they even got a bid. Probably threatened to sue USASF if they didn't... for real! They need to change their reputation of favoritism and under the table stuff.

It was with sadness I realized that he had used his charm to infiltrate and establish false ownership to another cheer gym. To the owner of Xtreme you are one very smart lady, give thanks he is gone. So I say to you Parents Owners Staff of Xtreme, Dream, Fearless how well do you really know this man? It is now time to put away the mudslinging and seek TRUTH not about what his intent is but where did he come from, has he done this before and if so how many times. I would like to hear some of the examples of Mr. Sweeney's so-called "Cookie Trail"????
But just so everyone is aware, he was interested in Xtreme's program originally for their Acrobatic Gymnastic's program. Once he became involved in acro he was the cheer program and became interested. He did not have it as a "plan" from the beginning to take Judi's program out from under her.

Proof and Explanation .... the courts will prove Mr. Sweeney's intent/and possibly bring out the cookie trail... but your choice on what you believe is just that your choice... I guess asking Mr. Sweeney for an "entire list" of where he has worked and calling them would give you a better/clearer explanation. Good luck to all the teams....

Dave and Aston have no idea what they are talking about. I had my child tumbling with a 16 year old girl before I had them tumbling with them! They are all about basics and if they don't work with somebody that is pushing them they'll never get any better. I'd rather have my kids with a 16 year old before them because they have actually gotten more accomplished. Go Fearless!

Ask any of the girls at Xtreme or Fearless --
When Dave and Aston first came to Xtreme nobody would tumble with them. They were uncomfortable and said they spot me "weird." No matter the sexuality of the coach if the girls do not like how the coaches are spotting and teaching them they won't like the program. (And you wonder why all the girls went to Fearless)

Dave and Astin had to start with the basics...because it was something they never learned with Nick. Dave and Astin also teach TECHNIQUE...something Nick knows nothing about. If Dave and Astin don't know anything....how come kids who struggled with a backhandspring with Nick are now landing beautiful tucks and layouts after a few months with Dave and Astin? Riddle me that.

Wow. It looks like a great many psycho cheer moms, who've lost sight of what this sport is really all about (i.e, thier kids, not them...), have made this their personal fight. You ALL feel the need to put your 50 cents worth in??? Get a life. Let the actual owners figure things out. Mind your own business and keep your slanderous comments about all these poor coaches to yourselves! Everyone of these young men and women spend endless hours working with your kids for very little pay. The coaches from all three organizations are ALL good. They're all nice. I've met them all. All three owners, also...nice enough people. The question at hand is business, (Not yours by the way) and professional conduct regarding agreements between the actual people involved. Ah, which is about 3 people...none of which are you people. But out, and grow up. Just stop.

I am in total shock after reading this!!! I really wish that all legal battles stay in the courts. I would never show my daughter this madness. Every gym has there problems and you have to work through them you cant just change gyms when things dont go your way. What does that teach our children? What is this teaching our children? I am speechless by all this nonsense. To any of the athletes reading this: FOCUS ON YOUR SEASON, BE THE BEST YOU CAN BE AND ROOT FOR ALL TEAMS! Nobody wanted to tumble with Dave and Astin at first because they came from a real gym. The girls new that with Nick it was all play no structure and no progression. Once they did start tumbling with Dave and Astin they are now confidante, strong, and all have mastered more skills then they every thought was possible. Now we know that we are paying for our children to actually learn skills and progress.

 

So much for glass houses...

The reason the girls at Xtreme are now progressing in their tumbling is most likely becuase there's about half as many athletes now, so Dave and Astin can focus on the girls easier than Nick could, who had girls jumping all over him and talking to him during every tumbling practice. Take it from someone who had years of private lessons with him and always being interrupted by other athletes. So, Nick is not to blame for that "riddle". No one is.

As an athlete at Fearless this is disgusting to see everyone flaunting Nick's business around. I respect nick more than i respect any other adult just because he makes it enjoyable and still manages to teach us to the best of our ability. I will never in my life have my child cheer when I'm older because the cheer moms that I have seen.

I'm surprised the new/combined gym's name isn't BloomCheer! Since it is still all about the Blooms - how pathetic! How weird that the owner's kids are the "stars"? Get past that whole issue and maybe DreamX program can be more legitimate in the world of allstar cheer. Everyone talks about the nepotism in that gym! Very sad!

Leave it to Fearless to bring Dave and Astin into this when this is not even their battle. They only came in to save the program that Nick deserted. What's the matter, Nick's history too sordid you can't defend him any other way than to try to lash out at Dave and Astin. They are professional and talented. In 2 short months they have helped girls achieve skills that Nick couldn't in all the years he was at Xtreme. Nick allowing girls to "climb all over hime" and interrupt practice and privates and his constant use of the cell phone when he was supposed to be working is definitely something he could have corrected and if he were a professional coach he would have done that.

Are all of you people really too stupid to realize that it is everyone but the coaches/owners of these gyms who are posting insulting, untrue, unfounded and nasty comments here? Each of you is attacking whatever side you oppose and in so doing are running down your own organization and leaving them open for the next ridiculous counter-attack. The coaches/owners were smart enough to hire lawyers to fight their battles for them - you all have way too much time on your hands and hate in your hearts. Get a life of your own please!

These 3 gyms and all of these people throwing daggers at each other make me mortified to be a cheer mom and embarrassed to be affiliated with this sport at all! I feel very thankful that my child is not with any of these programs. Lawsuits? Unflattering magazine articles? Slanderous online comments about crosstown rivals? Taking public potshots at coaches AND children to boot!?!? All of this is absolutely disgusting and intolerable. I hope you all realize what you all have done and what all of this is teaching the kids. Thanks for sucking out all of the good that cheer offers our kids and contributing to the negative stereotype of cheerleading AND ESPECIALLY of CHEER PARENTS!

I am truly disgusted with all of the negative comments written on this thread. I am so glad that I am not associated with any of these gyms. I wanted to refer someone to one of the three but have since changed my mind. Why bring the kids into this. I am so shocked with all of the negative comments toward the coaches and staff. All gyms have their problems but it has never been this public. Let the lawyers handle the situation and the rest of you stay out of it. My gym would never condone this type of public behavior. I think that the owners of the gym need to send out an email to ALL parents of their gym to put a stop to this behavior because you all do not need this type of publicity.

Please stop it now.

Are any of these cheerleaders receiving a paycheck? We are not talking about professional athletes here. You either like the sport or you dont. You either like your coach or you dont. If you dont, you find or follow one you do. What I am reading here is jealousy towards fearless....and I have nothing to do with any of these gyms. Get a grip parents, you act like you lost out on something good...was it perhaps Coach Sweeney?!

WOW, what happened to the merger of the two gyms Dream X. I just heard that the merger will no longer go thru and each gym has changed their website back to the old version. No signs of mergers anymore.

i used to take tumbling at fearless so i could cheer there in the 2010 season, but i decided to switch to xtreme because i heard they had a better cheer program. their tumbling coaches are alot better & focus more on my back handspring (which i really need) instead of making me do cartwheel after cartwheel. i am alot closer to my BHS now!
