Fenty interfered in standoff with gunman, records show

An investigation of the District’s top police union official grew out of a dispute in which police officers who coaxed a gunman out of a barricaded home accused Mayor Adrian Fenty and Police Chief Cathy Lanier of improperly meddling in the negotiations, according to police records.

Union Chairman Kris Baumann filed a federal lawsuit this week, accusing Lanier of illegally targeting him in an investigation of rank-and-file complaints stemming from a May 30 standoff with Terrence Moore. The internal investigation commenced after The Examiner made inquiries into whether members of the Metropolitan Police Department’s Emergency Response Team were ordered to lob tear gas into the home where Moore had holed up, sources said.

Moore fled narcotics officers, and allegedly kicked in the door of a nearby home and opened fire on the police. He was shot four times in the initial gun battle and barricaded himself in the home. According to internal police reports, officers refused to lob tear gas because they were afraid of panicking Moore and provoking another round of gunfire. They were told that the mayor — through Lanier — had “pressured” them to do so, records show. 

According to one police memo, the front-line officers were told that “the mayor called the chief and told her to end this situation asap.”

Fenty’s attorney general, Peter Nickles, did not respond to requests for comment.

Lanier dismissed charges that Fenty played a role in the negotiations. “It is utterly ridiculous to suggest that the Mayor would interfere in a law enforcement operation. I do not know who would make such an absurd accusation,” she said.

D.C. police regulations discourage even the chief from interfering with police standoffs.

“ERT personnel are specifically trained to handle these types of situations and interference by anyone other than an ERT official should always be avoided,” general order 309.1 states.

Internal police records show front-line officers desperately working against their commanders to resolve the standoff peacefully.

Officers were worried that tear gas would panic Moore, forcing him to come out, guns blazing. According to police records, the following exchange took place between Lt. Scott Dignan and a rank-and-file officer on the scene:

Dignan: “Be advised, I’m being ordered to give you the go to deploy gas.”

Officer: “...please stand by for just five more minutes...”

Dignan: “...I’m getting issues down here ...I’m getting pressured.”

Dignan would later tell his officers that the order originated from Fenty, according to three separate internal police records.

Records also show that Lanier stepped into Moore’s firing range during the standoff.

“Also, can you advise ERT 1 and 2 — the commander and the chief — they’re in a bad situation,” an officer told Dignan. “So if anything happens, they’re in the line of fire.”

Moore eventually surrendered without further incident.

A judge has temporarily ordered the police department to halt its investigation of Baumann while the case is pending.

So all the police on the scene are saying the order came from Fenty, but Lanier denies it. Not too hard to figure out who's telling the truth. Fenty meddled and Lanier is covering for her boss.

I thought Lanier was going to be a good Chief, I am sorry to say that I along with others have lost all faith in her. She will be gone along with Fenty in 2 years. Wow bring back Mayor Barry and Chief Turner.

Yes, I agree. I too had high hopes for Lanier. I do not say to bring back any of the former mayors or chiefs, but I agree and I bet she knows this too - she will be gone when he goes.

One who knows; you are on of those cowards who sit by and watch while the rights of your brothers and sisters in blue are being violated. As long as you are taken care of by this unethical lying scum thats now running the MPD. Since you have no interest in helping the FOP and wish to protect the chief; just resign your FOP membership and see how chief and the Department treats you after they figur out you are on your own.

I guess Fenty and Cathy Lanier think they are above the law. How soon do they forget Kwame Kilpatrick and Chief Ella Bull Cummings of Detroit? By the way, while the authoritites are probing this matter, dig a little further and investigate the old rumors of Lanier covering up Fenty's domestic violence issues involving his wife while Lanier was commander of his district in Ward 4. Trust me, the residents will be ever so grateful and it will help no doubt to kill two cukoo birds with one stone. Someone needs to pull Fenty's coat that White men can't jump and White women don't take the fall for Black men. The revolution will not be televised but Lord knows, I pray their descent into some jail's cellar is syndicated.

I don't think that the FOP would take on such a serious matter unless they have the facts, based on what I have heard the FOP has the FACTS. I just hope that the matter goes before the courts where, the behind kissers, and all those involved have to testify under OATH. Remember what happened to Mayor Kilpratrick in Michigan, lying will get people in trouble, even if is in DC. The ERT members who want to kiss the behind of the chief and the mayor, I just hope that no one get seriously hurt or killed because of Mayor Fenty's urge of POWER and his dictatorship. Police Officers are supossed to be family it should be all blue. I thank GOD that we have a Union (FOP) to protect us. ERT is a very respectible unit, but if it continues to take hits from the chief and the mayor it will be destroyed little by little...Good luck and protect the rank and file. Remember chiefs and mayors come and go...

Why is anyone suprised by this. They lie about crime stats, they lie when they violate labor laws, they lie when they tell you how great things are, and when you catch them in a lie, they just lie about lying in the first place Lets start looking at the conviction rate on the record homicide closers. This is Rasey 101, put people inplace who have to go with the flow because they don't have the ability to retire. I guess they all missed the ethics part of the promtional process

This really happen I was on the scene and heard it my self.They could say what they want,but the bottom line is that "it happen". Now they are using the Lt. Dignan as the fall guy for their wrong doing. They are going to get a citizen or a officer kill if they continue to put their hands where it does not belong. Thank you FOP for looking out for the officers safety! Keep up the good work.

WOW - politics at its finest - the only reason to bring back mayors like Berry is at least you would know up front you have idiots and fools running DC!

We have an idiot mayor pressuring a police SWAT operation and the chief folding like a cheap suit! What a shame - and a good man - Lt. Dignan requesting reassignment? Needless to say he was pressured into "requesting reassignment" or risk demotion or worse.

The mayor and the chief should have both been arrested for interfering with a police investigation.

Mayor - Chief: let the true professionals do their job and please stay in your office for the safety of everyone!!

Seems yet once again Chief Fenty is at it again, Lanier has to do what Fenty says after all she covered up his domestic violence and now is owned by him. Lanier is a HORRIBLE chief. And Fenty is an even worse mayor! Does anyone know if the rumors about him being caught in the act at a same sex gathering is true?

I can believe Fenty attending same sex gatherings!! He certainly hates women and loves the ground Catania walks on. I feel sorry for his wife, the domestic violence between him and his wife is real.. I think its awful that neighbors, EMT and Lanier are keeping quiet about Fenty beating his wife.

It makes me sick to think that Fenty is going to run for another term. We truly need to beg Chairman Vincent Gray to run for Mayor....
