Top D.C. cop alleges officer overtime fraud

D.C. police officers ripped off taxpayers by claiming phony overtime while assisting in a pair of federal prosecutions, a top department inspector charged in documents obtained by The Examiner.

Inspector Hilton Burton, director of the police department’s Court Liaison Division, claimed in a letter to the D.C. inspector general that 17 officers, detectives or sergeants “have defrauded the District Government out of tens of thousands of dollars.”

He said that “upper levels of the executive command staff … have chosen to ignore and disregard this blatant conduct.”

 Burton charged in an April 17 letter that the officers checked in for court on days when their cases weren’t being heard, or were dismissed from court hours earlier than they signed out.

Flags were first raised in February, Burton told the IG, when the 7th District commander reported one of his officers was claiming time for court cases in which he had no involvement.

Burton began a preliminary investigation, he wrote, and found 57 occasions between Jan. 1, 2008, and Feb. 13, 2009, in which the 7th District officer either checked in for a case — an eight-count indictment against an alleged member of the violent 22nd Street

Crew — which wasn’t on the court calendar that day, or checked out hours after the case had adjourned.

The Examiner has elected not to name any individuals Burton accused of fraud, as they have not been charged.

The officer earned more than $15,000 in overtime over a four-month period on one trial, more than double his salary for the same time period, Bur


ton charged.

Burton noted similar “irregularities” from two detectives in a recently concluded 2003 murder case. On Jan. 30, according to Burton, a detective checked out at 2 p.m. even though the matter had ended for the day at 12:53 p.m. He received four hours of overtime, totaling $278.76.

Burton shared his findings with the U.S. attorney’s office in Washington, but prosecutors there defended the officers.

Assistant U.S. Attorney Glenn Kirschner told Burton that the 7th District officer “has been a consistent presence throughout” the massive ongoing conspiracy case against the crew.

The police department’s Internal Affairs Bureau rebuffed Burton’s calls for an investigation — Director Jacob Kishter wrote in an April 1 e-mail he didn’t “see the need.”

Burton declined comment on Friday, except to confirm that he had sent the memo.

“I put my signature on it,” he said. “I don’t have anything else to say about it.”

A spokesman for the IG also declined comment. Police Chief Cathy Lanier did not respond to multiple calls for comment.

Inspector Burton is a brave man to come forward and report corruption. Let's just hope because of his protected disclosure that he will be protected by DC Whistleblower Laws. I guarantee that upper management of MPD will retaliate swiftly against him. I hope that he is aware that he has fallen out of favor with them. Inspector Burton please dot your I's and cross your T's. The MPD Grim Reaper is rapidly approaching to attack you. Did you not see what happened to Jordan?

Burton has alot of nerve since when he was the commander at 4th district he spent his time sleeping with woman in his office, sending out sexual emails to woman etc instead of protecting the citizens of ward 4. Which is why he hisself was demoted!

Whether people have made mistakes or not in their pasts, it is appropriate to come forward about things people are doing when you know they're wrong. Instead of judging the man, look at the fact that he might have learned from his experiences and become a better person as a result. Everyone changes for the better and "It's an ill wind that never changes."

As an Official he must report or investigate corruption or bad conduct of an Officer. Why did he blow the whiste? The Chief and Internal Affairs refused to back him. WOW. I believe he is doing his job, but for the wrong reasons. This will bite him in the rear because many people as well as Officers can see these allegations were not in the best intrest of the tax payers or the DC Finest. He has exposed the Commander at Seventh District, and he has alerted the Officers with no indictment or probability of termination. This is not an investigation this is Someone who's looking out for their self, and now he has the Examiner to thank for it. LMAO

Excuse me, but what does sexual emails have to do with stopping corruption that can be proven. You sound like a bitter woman that is just trying to hurt someone that is trying to save tax payers money.

It sounds like his attempts to warn everyone were ignored. He was responding in his official capacity to a commander who reported these actions back in February. Then on April 1 the person in Internal Affairs said in that e-mail he didn't see 'a need' for investigating. I would have reported it also because if he hadn't, he could have been blamed for not carrying out his duties. DC is just that dirty. The Chief is always around at every crime scene but not for comment on this? From what I've been told, the IG is the next step. This should be interesting to say the least. Why is it that people who come forward about wrong doing are always themselves smeared?

The DC Police Department has gone to the dogs. Again as stated earlier what does sexual emails have to do with corruption. If that's the case maybe someone should go back and looked at the email exchanges that have taken place between the Chief and her boyfriend who happens to be an officer. This has got to be the worst administration since Sonya T. Proctor. In the last two years this Chief has spent more time taking her personal feelings out on people that she either dislikes or feels that they done her wrong. Her latest victim is Brian Jordan. Not only has he been demoted twice now they are trying to send him to the trial board. Maybe the Examiner should start investigating that whole situation.

How come no one is reading what the United States Attorney's Office is saying. They said the officer was needed. The AUSA should have just submitted a CANS for every appearance even though if you case is continued to the next day you dont need to. Also since when dose the 7D Commander determine who's needed to prosecute a case? There all waiting for Lanier to trip so the can move up. In the current climate Burton had to go to the IG, if he did not, they would screw him for over spending his budget... End of story. And for the Brian Jordan fans he did not get what he deserved. He fired people for alot less

I retired several years ago from a federal law enforcement agency. Ironically, I was a manager who started an investigation in much the same way after someone tipped me off. I found out that about 80 managers and supervisors were fabricating their time and attendance records cheating the taxpayers out of a million dollars. When I went to the head of the agency he shut me down. I then went to members of Congress. The two who were interested were shut down by the leadership. I was then forced into retirement after the agency tried to flip the investigation around on me. I had over 30 years on and could retire immediately and I did. Three days after I retired there was an article in the Washington Post that the Director and Assistant Director had to turn in over 1,500 hours of comp time earned illegally. They both resigned shortly thereafter but one of them received an even higher political appointment. It's hopeless.

Everyone will have an opinion about Mr. Burton, because of his past, however if the chief really want to be honest, she can admit, before the allegations from the two scorned women, Mr. Burton was a excellent commander. The truth is the truth, we all know police officers think just like a criminal on the streets, most officers will lie and try to cheat the system because they think they are above the law and could get away with it.
