Illegal immigrant charged with child rape had been released a year earlier after assault arrest

A year before Prince William County police say he raped an 8-year-old girl, court documents show an illegal immigrant from Honduras was released by Montgomery County police after being arrested for second-degree assault.

Marcos Banegas has been on the run since Feb. 16 when Prince William County police charged him with forcible sodomy and aggravated sexual battery of a Woodbridge girl.

But before moving to Prince William where police say he cut hair at a local salon, the 26-year-old was arrested by Montgomery County police. Banegas was accused of “violently” grabbing a stroller, causing the child inside to be shaken, police said in court documents. The incident allegedly occurred while Banegas was arguing with the child’s mother near the intersection of Muddy Branch Road and West Diamond Avenue in Gaithersburg.

The charges were later dropped, and Banegas was released. Had his name been sent to federal immigration authorities, as it was in Prince William County, Banegas would have been detained for deportation hearings.

Earlier this year, Montgomery County Executive Ike Leggett altered the county’s long-standing policy of not sending the names of those arrested to Immigration and Customs Enforcement. Pushed by a series of high-profile killings allegedly committed by illegal immigrants, Leggett said in February the county would now send to ICE the names of people accused of violent offenses.

Leggett said the county would rely on the state’s legal list of violent offenses. But second-degree assault is not included on that list, and Banegas’ name would not have been turned over to ICE under the new policy, Leggett’s spokesman Patrick Lacefield said.

“People need to be held responsible for the crimes they commit,” Lacefield said. “Reporting every single crime would be putting county police in the position of enforcing federal immigration policy,” he added, calling on the federal government to reform immigration laws.

Jon Feere, a policy analyst at the Center for Immigration Studies, said Banegas’ release “is a perfect example” of local governments failing to enforce immigration law.

“Legal residents are going to have their lives threatened by people who are in the country illegally if those people aren’t deported after having committed even the most minor of offenses,” Feere said. “Montgomery County and Maryland as a whole are slowly realizing sanctuary policies are bad policies.”

Montgomery is not the only county who is failing to protect all residents from these types of criminals.

How many victims of criminal illegal aliens is it going to take for other jurisdictions take action?

Arlington County will never protect their citizens from these criminals because it would go against their elected officials public statements opening the doors to these illegal immigrants.

Criminal charges should be brought against the people who support "illegals" in this country.. they should all be held accountable for their actions.. this makes me sick.. i surely bet he moved from one county to the other using phony i'ds that they make, like the ones they use to get their md. drivers license. Like the illegal that crushed my legs in a car accident had.. and bet he's out driving again using another phony id.. The politicians that support illegals should be criminally charged with aiding and abetting these criminals.. these aren't ordinary immigrants.. These people purposely would love to remain illegals and work for cash so they can have the best of both worlds. Phony id's to get welfare/food stamps/emergency checks/etc and drivers license.. If they were legal citizens they wouldn't be able to get all this..

burn him, fry him, then castrate him, then deport him to the jungles of Venezuela. Illegal supporters such as Casa De Maryland and Ivey, Hixson, Niemann, Vallario, Gustavo Torres, Ramirez, Madaleno, Harrington. Because of legislators such as these, and Ike Leggett, this is what happens. All of them should denounce their citizenship and leave the country. Someone get this to National Press.

Undocumented immigrants don't commit crimes because they're undocumented or illegal...what a terribly distorted, non-contextualized take on our immigration problems in this country. This piece was clearly written with the intention to steer people towards harsher and more violent reactions to undocumented immigrants and to avoid the need to adjust the immigration program so we quit making "illegals" out of normal people. Just look at the rash, base comments posted here...

There is no legal standing "undocumented immigrant" - that would be
ILLEGAL ALIEN, Patrick.
That is no rash statement-it is a fact.
When someone crosses our borders illegally or overstays a visa , that is a crime and necessarily-everything they do after that is a crime.
Laws do not come from games and they are not up to us to choose which ones to obey OR ENFORCE!
You are attempting to distort our Laws, Constitution, and modus operandi of Law enforcement,

You cannot be Politically Correct and be truly correct-or didn't you learn that in middle school

Here is yet another example of the harm that comes from not enforcing our immigration laws. If this guy, just like the one arrested in the Chandra Ley case, had been processed and deported this would have been avoided.

It's time that the AMNESTY CONSPIRATORS in Washington are held PERSONALLY RESPONSIBLE for the crimes committed by illegals because they not only refuse to do their job, but in that refusal are inviting more to come here!

When will this insanity stop? American citizens are being terrorized everyday by illegals and the government turns a blind eye. The border must be secured and ALL invaders must be made to leave the country. Its time for Mexico to take responsibility for its citizens!
