Teachers, principals caught in fraud case

Fairfax educators sue over alleged land scam

Two Fairfax County public school principals and dozens of teachers they recruited into a North Carolina land deal have been caught up in what could be the largest mortgage fraud case in state history, according to court documents.

A federal grand jury in North Carolina has been probing the massive fraud case. Teachers were left with worthless land and gaping holes in their bank accounts, according to lawsuits growing out of the case.

Daniel Meier, principal at Fairfax's Robinson Secondary School, and his brother Thomas Meier, principal at McLean's Langley High School, worked with a former student, Mark Dain, to motivate investors to pay artificially inflated prices for land in coastal North Carolina at the height of the housing boom, according to a lawsuit brought by the investors. Dain was a co-founder of the now defunct Total Realty Management, based out of Woodbridge.

The company purchased subdivisions worth approximately $150,000 before turning around and selling them for double and sometimes triple that figure, according to the complaint. The Meier brothers allegedly offered "testimonials" on the scheme's success before crowds that often included teachers and colleagues. The sales were manipulated through "sham transactions" and multiple misrepresentations, according to the complaint filed in January in a Virginia federal court.

A lawyer for the plaintiffs in the lawsuit said the FBI had begun a criminal probe into the deals. FBI spokespersons in D.C. and North Carolina could not confirm whether the case has expanded to TRM.

Both Meiers are still administrators in Fairfax schools. Daniel Meier was named in the original lawsuit brought by the teachers. Thomas Meier was not named as a defendant in the lawsuit, but was depicted as involved in recruiting teachers.

"[Total Realty Management's] scheme was lent an air of legitimacy by the involvement of Daniel Meier and Tommy Meier," said the civil complaint on behalf of about 130 Virginia residents, including about 40 Fairfax teachers.

The company allegedly "paid Daniel Meier $25,000 for each lot purchased from TRM in the [s]ubdivisions by any individual referred by [him]," although "[t]eachers were not aware that [he] received commissions based on their purchases."

Daniel Meier denied all charges in a response to the complaint filed in March.

Both Meier brothers recently filed for bankruptcy in federal court. Daniel Meier listed more than $100 million in liabilities on account of the lawsuits pending against him.

Jill Pisner, a lawyer for the plaintiffs, said her clients have stopped pursuing claims against Daniel Meier.

"He is in bankruptcy and his debts exceed his assets," Pisner said. "What money he made, and he earned referral fees of $10,000 to $25,000 per lot on about 35 to 50 sales, plus speaker fees of $1,000 per seminar, is gone now."

Both Pisner and Daniel Meier's lawyer, Alan Shachter, said the FBI was likely not investigating Meier.

Calls and e-mails to the Meier brothers were not returned. Teachers referred questions to Pisner.

Dain could not be reached for comment. The teachers are still pursuing his company, TRM.

The case has garnered huge headlines in North Carolina as a federal grand jury investigated various allegations including whether former North Carolina Gov. Mike Easley got a sweetheart deal on waterfront property and helped green-light permits for the project.

When I first read this yesterday morning, I was shocked and saddened that someone I looked up so much could be responsible for “the largest mortgage fraud case in state history” but as I reflect on the situation, I realize that he is innocent until proven guilty. The media has a way of manipulating events in such a way to create a warped mindset in its audience so I say give him a change to explain himself or at least wait until he has had a fair trial by jury before you start judging him. Principal Meier has done a lot of great things for the robinson community I think we owe him a fair chance before judging him.

I live in the Robinson community and hate that this has happened yet, his word will mean very little without the strength of his character. Who can he lead one of the largest Secondary Schools in the state of Virginia with all of these legal challenges looming over his head?

I have known Coach M. since I was a student of his to a colleague. He has always been truthful and fought for what he has got in his life. Just b/c a person is a principal, vice president or president, doesn't mean they are perfect, it means they are another human being that make mistakes, gets ripped off and LEARNS from their wrong doings...IF there is any wrong doing on his part. Thank goodness we were broke at the time:)

Why hate? Why judge? When we ourselves are not any different in our social lives- deceiving, cheating, manipulating others. Instead of bashing on the Meier family, I think we should support them... especially during this time. It's so sad when someone high up in the community falls and we immediately respond by killing every last bit of pride and hope they have. What if you were in his shoes? Don't fall for the ignorant wall posts about mr. meier not being liked. Mr. Meier is a great man and an even better principal. I worked with Mr. Meier throughout my time at the school and was always impressed by his integrity and dedication to his students. It is unfortunate Mark Dain decided to take advantage of his reputation and trick him into be used for his Scam. Although Mr. Dan Meier was associated with the scam does not in any way make him guilty or make him a bad person. If Mr. Dain was able to scam the state of North Carolina he clearly had a well engineered plot and most likely tricked Mr. Meier just as he tricked many of the home buyers. Just because Mr. Meier was a victim of one man’s evil actions does not mean Mr. Meier supported or participated in the illegal actions.

For the past 6 years Mr. Meier has dedicated his life towards supporting the students and faculty of Robinson Secondary. This should be the time we all give back to the man who gave us so much. Mr. Meier I give you my full support as I know many other Robinson Alumni do. I think the true tragedy would be if you were to leave your job as Robinson Principal.

Mr. Meier at Langley is truly a nice man. This surprises me and sickens me to see a man of such dedication to his job get accused of such a crimial act. I am a junior at Langley high school. And not once have I heard of him overreacting or treating a student unjustly. May my prayers be with you tommy. Hopefully you will be able to overcome this massive mountain you have created.

I don't think Dan Meier should be held accountable in any way. 1. I went to the seminars and heard him speak and never once did he gurantee anything, he just shared his success and talked up his former player and CEO Mark Dain, I doubt he had any idea any of the illegal activity was going on. Mark knew that Dan was a high profile person in the Fairfax County community and he used that to his advantage. Mark didnt even have to sell anything at that point, Dan speaking about it was all he needed for him to make money. 2. I highly doubt that Dan would be that dumb to get people he works with involved in this mess knowing that he has a good repuation in the area. Its plain in simple, he was manipulated just as much as anyone else was and he put trust in one of his former players and it came back to haunt him. Both Marks and Brian Viola should be the ones on the spotlight, the ones that were running the illegal operation.

This is very close to a similar crime committed years ago involving WCOM. Although the fraud committed is slightly different, the end result for the investor is the same. The main principal, no pun intended, Mr.Dain may be looking at a similar sentence that Bernie Ebbers was given and believe me the judge was less than leanient in that case. 25 years with no parole.
Fraud cases are being treated as "example setters" and that doesn't bode well for the founder here.

Hi, I was a former student at Langley High School, and I am somewhat confused about one point in your article. In your article, you stated that, "Daniel Meier, principal at Fairfax's Robinson Secondary School, and his brother Thomas Meier, principal at McLean's Langley High School...".

So, are you saying that Thomas Meier is the principal of Langley High School, located in McLean, VA? Because I remember that our school had a different principal when I graduated. And to be sure, I checked the Langley High School website, at (http://www.fcps.edu/LangleyHS/index.html) and it says on the top of the page that our high school's principal IS Matthew Ragone.

So who is this Thomas Meier, that is supposed to the principal of Langley High School? Would you care to provide a website stating this?

Danny Meier was either full of it when speaking and full of it now or just plain stupid. I always thought he was a great guy....so I will go with just being stupid and trying to make money on real estate like the rest of the country. BUT...who would buy land without even looking at it first. Seems like a lot of good smart people were being stupid and should just get over it DUMMIES.

I have had a student at Robinson for the last four years. I believe Dan Meier to be a man of integrity and honesty. I believe his son's response on the Fairfax Underground Blog is an accurate portrayal of events, and I pray for this nice family. What a shame. Imagine how it would feel if the community were discussing YOUR private life. Remember this: the judge, who knows the law better than any of us do, threw out the case. I stand by our excellent principal. He is a man of integrity. Hang in there, Mr. Meier. You are loved by so many of us.

Jill Pisner was quoted in another publication, "Her clients paid between $249,000 and $440,000 per lot. "Some of them owned one, two or three lots." These lots, she said, may be worth as little as $16,000 now." Fairfax Times. It looks as if they wanted to do some flipping of their own. Many people made poor choices on inflated properties a few years ago. The choice was their responsibility. Property purchases/tax records are always available for reference. Seminars for property promos are always out there. I have always found Dan Meier to be an outstanding man, hard working, great leader and role model. No one made these people purchase...they wanted to get in on a good thing it sounds like. Like so many others....

If the Meier's didn't know that the real estate being sold was grossly overpriced, even in a hot market, then they didn't do their "homework". A simple Google search on NC real estate values should have made it clear to them that it was a scam. Either they were greedy or dumb. Perhaps both. And to prey on their own teachers; sure appears to be an abuse of power to me. Even if they thought it was legitimate, they abused their positions. If a student had done the same it would have resulted in an expulsion (read the Student Rights and Responsibility Handbook on the FCPS website) They should both be suspended without pay.

The choice was their responsibility" True, but when the one pitching the investment happens to be your boss, who can have a big impact on your career, decisions may be made for the wrong reasons. As for justice, The only justice Dan Meier will be getting is the stopping of this hernedous ridiculing that many of you seem to comment about.

Mr. Miers brightens up everyone everyday! stay strong people love to talk but anyone who has talked to this guy knows how much he loves helping out all the students in the school. take all the money out i dont know how many principals really try to get to know their students. i think your innocent but if youre not people do things in order to make lives happier for the people they love the only way i could see mr. mier being involved in anything like this would be to take care of his own kids

The Meirs boys are already guilty in the court of public opinion. They may not be guilty to the degree of Dain & Jalajel, but they certainly helped to perpetuate this massive fraud. Also, you teachers should have known what you were getting into. Did you ask the right questions? Remember the old adage if it sounds to good to be true....". I stayed away when presented this offer. It smelled fishy from the start. See you in court.
