Obama should give Geithner the hook

Timothy Geithner, President-elect Barack Obama’s nominee for Secretary of the U.S. Treasury, didn’t pay his federal self-employment taxes for four years because he “forgot.” That is no longer a credible explanation in view of yesterday’s reporting by National Review’s Byron York. The claim that he forgot simply doesn’t square with the fact that for four years Geithner accepted reimbursement from the International Monetary Fund (IMF) to cover federal taxes he had not paid, according to Senate confirmation documents examined by York. The IMF is an international agency and as such does not pay federal or state taxes owed by employees who are U.S. citizens.

More specifically, he failed to pay self-employment taxes - Social Security or Medicare - while employed at the IMF until he was audited by the IRS in 2006. At that point, Geithner made good on his 2003 and 2004 obligations, but still failed to pay the amounts due for 2002 and 2001. It was only after he was named by Obama to succeed Henry Paulson at Treasury that Geithner took care of the obligations for 2001 and 2002.

This is especially damning because on the IMF’s Annual Tax Allowance Request, Geithner promised to “pay the taxes for which I have received tax allowance payments...” If, as The Wall Street Journal reported, Geithner was told by one of his accountants that he wasn’t obligated to pay the taxes, he shouldn’t have signed the IMF document promising to make the payments. Clearly, he should not have accepted the reimbursements.

Geithner also received an annual reminder from the IMF that he was responsible for paying his taxes. He applied for a reimbursement each year from 2001 through 2004, but then pocketed the cash instead of forwarding it to the IRS. Doing so four years in a row is not merely an “honest mistake,” as the Obama transition team maintains.

As a general principle, The Examiner believes presidents ought to be allowed to pick their cabinet officials and have them confirmed, except in cases in which there are clear and unquestionable ethical problems. Considering the dire state of the economy and the continuing possibility of scandal emerging from the opaque administration of the Toxic Asset Recovery Program, of which Geithner was an architect from his current position at the New York Federal Reserve, this is no time to complicate the economic crisis with an additional ethical complication. So unless he’s comfortable with appointing a tax scofflaw to oversee the IRS and the entire U.S. financial system, the prudent course is for Obama to withdraw Geithner’s nomination.

NOW is it okay to question a nominee's patriotism? According to or VP-elect, paying taxes is patriotic. Cheating on your taxes is surely the oipposite.

I agree fully. The media ran hog wild over Joe Wurzelbacher's back taxes and now they cannot do enough to dismiss this. Geithner's mistake is called "common" but a common man is not desirable for this position. The guy accepted the money to pay those taxes and apparently had no interest in handing it over until his nomination. Inexcusable.

If one can plead the "Fifth" in a civil case, one can now plead the "Geithner' in an IRS case. He will destroy all IRS compliance capability. He would not even qualify for a Treasury clearance as he shows intent over a long period of time to evade taxes.

Yes, the hook should be applied. If the nomination goes through, then it is another example, in a long list, of our political elites/Wall street/ K Street types being out of touch and accorded a different standard then "Main Street."

One of the items the tax audit found wrong on Geithner's tax return was failure to pay the penalty for a 401K withdrawl. Financial types categorize early 401K withdrawl as poor financial management except as a last resort to avert a catastrophe. Geithner's supposed to be the genius to save the entire financial system. His 401K withdrawl in combination with obvious tax cheating is significant. And surely Geithner knew he had to pay the penalty.

As a tax cpa, I can tell you this guy is a tax cheat PERIOD. IMF told him what to do, gross-up his pay for the tax effect of the extra cost of giving him the social security payment and he signed off that he understood. I can't wait to go to the IRS for my clients. Oh, Mr. IRS, "innocent mistake", no penalties...right? It is ok for your boss!

I agree. The "my scratch your back and you'll scratch mine" is in power now. This will be the most crooked power/money hungry presidency ever to be in power. Hopefully, I'll be wrong. Why don't we ALL cheat or not pay on our taxes and UNITE. Let's see if they say it was a hic-cup of a mistake and let it go. I would join in the fight if we could get thousands of people to ignore their taxes to make a point.

It is outragious Timothy Geithner is still even being considered. After all that we have been through and all the support that we have given him, we now find that he and his cronies are just another bunch of crooks. This makes me sick.

Ignore Obama's words. His actions tell us that cheating and lying are the way to get ahead. Geithner's appointment is so cynical. The guy just plain cheated big time on his taxes.
