Pitchfork rebellion against Judge Finch

A lot of Virginians are coming out of the woodwork and demanding that the General Assembly refuse to reappoint Fairfax Circuit Court Judge Gaylord Finch. The complaints are coming close to critical mass.

Virginia and South Carolina are the only two states in which legislators appoint judges. Partisan fighting between the Republican-controlled House and Democratic-controlled state Senate delayed many nominations last session. But Virginia lawmakers also have the power to deny a judge reappointment if he/she fails to live up to expectations.

A bill submitted by former delegate and current state attorney general Robert McDonnell created a panel to review judges’ performance of circuit, general district, and juvenile and domestic relations judges. It went into effect for the first time this year. Legislators are supposed to rate judges by their record on the bench instead of just rubber-stamping them for another term.

And they’re getting an earful from irate defendants who feel their rights were violated by Judge Finch. One man claims Judge Finch refused to enter a final order in his case – for four years !– leaving him in a legal no-man’s-land.  Another reportedly told the FBI that Finch routinely hears criminal cases in which the defense attorney is his golfing buddy and a frequent houseguest.

A former Fairfax County resident told members of the Courts of Justice Committee that Finch ridiculed and mocked her when she appeared pro se in his courtroom in an attempt to regain custody of her young daughter. Another man complained that in 2005, Judge Finch systematically denied him his constitutional rights when he was charged with trespassing for attending a school party for his Down’s syndrome son at this ex-wife’s invitation. He claims that Judge Finch refused to rule on his motions to dismiss, wouldn’t let the proceedings be recorded by the court reporter present, or even let the defendant present evidence or rebut witnesses.

Finch is also accused of holding ex parte hearings on a custody and child support case and ordering the wrongful imprisonment of a man on false child abuse charges that were later overturned. And the Fairfax County Coalition of Advocates for Public Schools blasted Judge Finch’s handling of the controversial western boundary redistricting case.

Any one of these complaints should give legislators pause as they reconsider reappointing Judge Finch. Taken together, however, they paint such a disturbing picture of judicial arrogance and disdain for the constitutional rights of citizens as to render him unfit for the bench.

A famous Virginian, Patrick Henry,said: "Power is the great evil with which we are contending. We have divided power between three branches of government and erected checks and balances to prevent abuse of power. However, where is the check on the power of the judiciary? If we fail to check the power of the judiciary, I predict that we will eventually live under judicial tyranny." Patrick Henry knew what he was talking about. He was a Virginia attorney and his father was a Virginia Judge. The behavior of Judge Finch just goes to show that Patrick Henry was right, that when there is no punishment for judges breaking the law and abusing their power that many of them will do so. Hopefully the legislature will finally take action to remove Judge Finch.

Thank you for bringing Judge Finch's wrongdoings to our attention. Unfortunately, there are a lot of bad actors like him on the bench in Virginia who let cronyism guide them in making their decisions. Other Judges who need to be removed from the bench are Esther Wiggins-Lyle and James F. Almand. My husband and I were falsely accused of neglecting our daughter, because she lost a few ounces after birth. The neglect charge was later overturned, and yet these judges allowed our daughter to be placed with her foster parents for adoption. The foster parents are a politically connected couple, the husband being a Federal prosecutor for the Justice Dept. Both of these Judges favored this couple over us, Sabrina's birth parents. In fact, Paul Ferguson, who helped the foster family remodel their home in Arlington, now serves as a clerk of the 4th Circuit Court where Judge Almand sits. Hopefully the legislature will investigate and remove these judges as well.

Clearly this article was written by someone who is totally ignorant of the law and only interested in getting his own way regardless of what the law states. Had you prevailed in your case, I'm sure your opinion of Judge Finch would be different. But this just sounds like sour grapes. Judge Finch is an honorable man and would never let his personal feelings dictate his rulings.

I have to strongly disagree with the posted comments about Gaylord Finch. I have been in court with him countless times over the years and arrogance is the last term I would use to describe him. I have always found him to be fair and without bias. Additionally he has always been polite and respectful to those who have appeared before him. This sounds like a case of sour grapes rather than a case of judicial misconduct.

I have known Judge Gaylord Finch personally and professionally over the past 21 years and the complaints filed by these individuals are completely out of charachter for him. He has always been most respectful and considerate in his deliberations as a judge and has adjudicated cases brought before him in the best interest of the child and family. Clearly not all parties are satisfied in these complex cases and, yes, people often leave court upset with some of the judicial decisions. The role of a judge is to listen to the facts of the cases brought before him/her andand render an unbiased, thoughtful and fair decision. This is what Judge Finch does.

i see my post from yesterday is not here. no suprise. it's beyond RARE for anyone to publish the active electorate's angry feelings when made public. the judiciary in virginia is corrupt. the JIRC, the Bar, the Supremeless Ct., the Ct.ofAppeals are all bought and paid for. If mr. finche's buddies who posted here in his defense had witness HALF of what I have across this state - they would not publically pronounce their adoration. read wes smith's account, his pleadings, and then -READ ALL THE OTHER STORIES on his site and exiledfathers - you apparently have not yet suffered the multi-billion $ divorce moneylaundering "business" the Commonwealth is running.

The comments about Judge Finch having been courteous etc to others is pretty much the same reaction as when friends and family say nice things about an accused murderer or rapist. Positive interactions with other people have no bearing on what he did to someone else. While there may be room to debate his rulings where he has to make a judgment call, when it comes to Constitutionally mandated procedural requirements, Judge Finch either followed them or he didn't. When he denied me my Constitutional Rights to call witnesses, present evidence, etc, that's not a judgment call, that is a illegal violation of the Supreme Law of the land. The legal term for such conduct by a judge as defined by the U.S. Supreme court is 'Act of Treason' and Judge Finch is a Traitor. He can be nice to all the people he wants but if he ever intentionally violates the Constitution he is a Traitor and unworthy of remaining a Judge.

I am not suggesting that he is a bad chairman and that he is a bad attorney. I am only insisting that the conflict of interest created when one person is in both roles is clear and should no longer be tolerated by the people of Virginia: A litigating legislator should not be in control of judicial hiring and firing. (Nor should lawyers make laws.) Virginia will see improved judging--and better laws on the books--when it finally prohibits litigating legislators from picking people to occupy the bench. To the ignorant defenders of Judge Finch, who think a sitting judge can do no wrong, there is more to come, Judge Finch was caught on tape during his 2nd judicial interview before the Courts of Justice Committee lying through his teeth... He is a disgrace and an embarassment to the entire judiciary. He must go.

I've practiced law for 30 years in Alexandria and Fairfax and appeared in Judge Finch's courtroom many times. On every occasion, he has been fair to all involved. No Judge can please all the people all the time.

Tom, there are two problems with your comment. First as an attorney you are a union buddy of Judge Finch and make money, big money, off his rulings. So you aren't exactly unbiased. And no attorney in Fairfax could publicly say Finch is corrupt without risking losing cases and career. Second unless you have been at every hearing Judge Finch had in those 30 years you don't know what he did during all of them any more then the neighbors of murderers who didn't see their neighbor murder anyone, and one single act is enough.

I agree with Liam's Dad, I don't think any attorney who has tried cases before any judge can really be unbiased. I've seen how all in the legal profession in Northern Virginia stick together. Rather, try to put yourself in the place of a parent who has been denied contact with your children by him.

Gaylord Finch is a disgrace to the bench. I had the unfortunate experience of appearing before him pro se in a child support matter. He refused to let me present evidence that proved the opposing party was lying to the court, and wrote a ruling that 2 lawyers were unable to interpret. Sorry, but this is not sour grapes. On that day, I witnessed a parade of frustrated lawyers return to his courtroom to have ambiguous orders clarified. He was smug, ignorant and arrogant, and in no way should be returned to the bench.

I was personally present at both of Judge Finch's judicial interviews. When Judge Finch was asked on 1/10/09 about (Liam's Dad) Wesley Smith's case, Judge Finch DID NOT DENY Mr. Smith's allegations that Judge Finch 1) denied him a court appointed attorney although he was indigent 2) refused to rule on his properly filed motion to dismiss the bogus "trespassing" case 3) refused to recuse himself in spite of an apparent conflict of interests 4)denied his fundamental right to present evidence and witnesses in his defense and 5) denied Mr. Smith the right to have a court reporter record the proceedings. Assuming, without deciding, that Mr. Smith's allegations are true, Mr. Smith is not "sour grapes" or some disgruntled litigant... nor is Judge Finch an "honorable" "fair" "unbiased" "thoughtful" "respectful" jurist as some claim.

Wesley Smith had a public defender provided for him for his trepassing trial. He asked them to withdraw and CHOSE to represent himself. Mr. Smith was convicted by a JURY of his peers not by Judge Finch, and he was given a fine of $100. Look at Mr. Smith's website liamsdad.org, and you can see all of the other judges that have "wronged" Mr. Smith. And then think if there are some sour grapes here. He has complained about every judge he's ever been in court with in multiple jurisdictions. If he doesn't get his way he will publicly terrorize the people who have "wronged" him. It's disgusting!

Dear rcamaur1@cs.com, You can't possibly offer an accurate opinion regarding how Finch handled my case on that day unless you were there. Far from being made of whole cloth, my story is true and accurate. My problem is not with the ruling he made that day, regardless of how unfair and uninformed it was. My problem is with the method in which he conducted himself and his court. He refused to let evidence be presented, apparently for no other reason than he didn't want to change his mind. He gave more weight to the verbal testimony of my ex - even though she contradicted herself - than he did to the written proof I had of which version of her story was true. He cleared the courtroom of every single person except me, my ex, the bailiff and his assistant so there would be no witnesses to his conduct. Judge Finch is dangerous.

rcamaur1@cs.com is not only a Finch buddy, he's a second rate attorney who apparently does not get enough repeat business, so he relies on referrals from the Fairfax Bar Association. He also apparently cannot afford a pet sitter because he brings his big nasty dog to work every day.

the web site pitchforkrebellion.org is displaying the "Go Daddy" ad site. This is a site I have seen used by the state when there is a criminal investigation of people connected to the site. Can anyone explain why this site is there and, if they are being investigated, why law abiding citizens would be investigated for an attempt to stop corruption?

Just thought of something. When Finch resigns, he qualifies to be a Judge pro Tempore, a temporary judge to continue to meet out his brand of law.
