White House moves to restrict criticism of stimulus projects

 A new White House policy on permissible lobbying on economic recovery and stimulus projects has taken a decidedly anti-First Amendment turn. It's a classic illustration of Big Government trying to control every aspect of a particular activity and in the process running up against civil liberty.

Check out this passage from a post on the White House blog by Norm Eisen, Special Counsel to the President on Ethics and Government Reform (emphasis added): 

 "First, we will expand the restriction on oral communications to cover all persons, not just federally registered lobbyists. For the first time, we will reach contacts not only by registered lobbyists but also by unregistered ones, as well as anyone else exerting influence on the process. We concluded this was necessary under the unique circumstances of the stimulus program.

"Second, we will focus the restriction on oral communications to target the scenario where concerns about merit-based decision-making are greatest –after competitive grant applications are submitted and before awards are made. Once such applications are on file, the competition should be strictly on the merits. To that end, comments (unless initiated by an agency official) must be in writing and will be posted on the Internet for every American to see.

"Third, we will continue to require immediate internet disclosure of all other communications with registered lobbyists. If registered lobbyists have conversations or meetings before an application is filed, a form must be completed and posted to each agency’s website documenting the contact."

The key passage is the reference to expanding regulation from registered lobbyists to "anyone else exerting influence on the process. We concluded this was necessary under the unique circumstances of the stimulus program."

This is the Camel's nose under the tent, being poked because of special circumstances. Let government restrict political expression - i.e. lobbying of government officials regarding policy - in one small, supposedly specialized area and not long after the specialized area starts expanding. Eventually, all political expression regarding all policy will become subject to government regulation.

More on this as it develops. And trust me, it will develop.

Carter Wood at Shopfloor sees the same threat to the First Amendment:

 

"Lobbyists and organizations that lobby complained that the White House’s restrictions on lobbying on stimulus fund projects were discriminatory and unfair because the same restrictions didn’t apply to people like corporate executives or officials. So these memorandumly noted changes address that fairness issue by expanding the ban on orally petitioning the government or expressing one’s views through speech. In the interests of transparency the First Amendment must be sacrificed.

 

"The restrictions are also ambiguous enough that a lobbyist or other petitioner won’t be sure how to fully comply. So if someone runs afoul of White House officials, a phone call to a news outlet or a friendly prosecutor can punish the offender. Ambiguous rules plus capricious application equals negative rule of law."

I'm no fan of this administration, but from what I can see this is a change for the good. Essentialy all communications with the gov't over the awarding of a stimulus grant have to be made public. It says nothing against 1st amendment rights; it does not stop private parties from communicating among themselves confidentially. It just opens the doors to understanding what sort of information guides bureaucrats on their decisions. The weak spot is that it still allows communications initiated by the government to be kept away from public scrutiny. (Think of it like Backtrack's decision on Gitmo - maybe not the best, but certainly better than what he was promising and what the Left was hoping for...)

I don't understand why having an open, competitive bidding process on government contracts, as opposed to back room deal making and Bush-style no bid contracts, violates the 1st amendment. Was there an argument for that claim in this post? The 1st amendment guarantees a right to petition the government. That right is clearly preserved in the bidding process. It also guarantees the right to free speech, and anyone who doesn't like the process can go to the press. I don't see any argument to the contrary in this post. Where's the argument?

The WH policy does not violate the First Amendment, which places a restriction upon Congress. I know the Obama WH has been acting like Congress but that still doesn't make it Congress. The policy does violate Article II, Section 2, in that there is no grant of power to the president to restrict anyone's speech. It also violates the Ninth and Tenth Amendments which protect all the people's rights, whether specifically mentioned in the Constitution or not.

How many of you actually bothered to read halifaxcb comments or even the actual update from the WH. If you bothered to read halifaxcb comments or the update from the white house there is no "restriction" of speech but rather the policy of how to lobby for stimulus funds. The administration is trying to adopt a "sunshine" policy to have greater transparency. At least do yourself a favor as well as others as being informed before you post silly and ignorant comments.

I think we conservatives are sensitized to over-reaction now that we have a leftist in the WH. I read the Eisen blog post as an exclusion of lobbyists from exerting undue "hidden" oral influence on decision-making. I think commenter halifaxCB had the interpretation correct. I also respect the comment from Tapscott about the potential for this oral comment restriction to "creep" into other policy areas if it proves to be successful in this area. Honestly, we are being conditioned to react negatively to any WH announcements over the weekend as stealth tactics designed to hide controversial measures.

NO BODY IS EVER REFUSED CARE! Stop! that should be the only measure of comparison, There are flaws that need to be worked out. Of those, ways to EXCLUDE Unions is paramount. Hospital Janitors should not be paid more than Minimum wage. A trained seal could push a broom. A trained seal would do it for a LOT less than $25/hr. Likewise as to Laundry, food service, etc, etc , etc! Private providers will be more efficient in the long run.....

USMC: See, that's not the first sentence. Did you read the actual blog entry? It "require[s] all oral communications between federally registered lobbyists and government officials concerning Recovery Act policy to be disclosed on the Internet." It's just a sunshine provision for people who are competing for recovery money, so that we, the public, can see what's going on. There's not a word in there that puts any restriction on what they can say, not is there anything that tries to keep it private. In fact, it's just the opposite--it ensures that everything is public. There's nothing bad going on here.

This really seems like the start of some serious George Orwell type of stuff. But if this regulation is carried out it will be grounds for impeachment. Since violation of an American citizns civil rights is a felony, and commiting a felony is grounds for impeachment. But don't see that happening. This really begs the question, "what do we do"?

I'm confused. The way I read this is that they're not saying you can't have oral communication, just that if you do, you have to summarize it and post it on the appropriate website. Surprisingly, not a bad idea from Obama administration which doesn't have many good ideas.

I am STUPIFIED. Protecting the public from the backroom dealings of both parties (oh yeah both dems and reps love a sweet deal rather than helping the country) is infringing on the constitution? GET OVER IT- Bush wasn NO Republican (hello Lincoln, Teddy Rooselvelt, Eisenhower) he was a constitutional betrayer. Don't believe me? Stop listening to the people like Rush Limbaugh (conservatives)and Al Franken (Liberals)who you are making rich by listening to their crap and actual get the facts.

This piece is pitiful. Under W. Bush, criticism was crushed, not restricted. Perhaps Shakespere said it best when he suggested, "First we kill all the lawyers" - of course, that was when England was a real monarchy, and lawyers did not have the power they have now. IMO, lobbist/lawyers have corrupted the electoral and legislative process in a horrible and destructive way, making America a 2nd rate country. Anything we can do to stop them is good IMO.
