AmeriCorps feared bad press if IG investigation continued

One of the mysteries surrounding President Obama's firing of AmeriCorps inspector general Gerald Walpin is what prompted the White House, supported by the board of directors of the Corporation for National and Community Service, which oversees AmeriCorps, to try to get rid of Walpin so quickly and quietly?

On the evening of Wednesday, June 10, an official of the White House counsel's office called Walpin to tell him he had one hour to resign or be fired.  The action flew in the face of a law (sponsored by Barack Obama when he was a senator) that requires the president to give Congress 30 days' notice, plus cause, when he intends to fire an IG.  In this case, the White House apparently wanted to dispatch Walpin quickly by pushing him to resign, which would not have required the president to go through the congressional notification process.  Instead, Walpin refused to quit, and only then did the White House tell Congress.

Why the rush?  Walpin had certainly displeased the board by his aggressive investigation into the misuse of AmeriCorps funds by Kevin Johnson, the former NBA star who is now mayor of Sacramento, California and a prominent supporter of President Obama.  Prior to his election as mayor, Johnson ran an educational organization called St. HOPE, which received $850,000 in AmeriCorps money.  Walpin discovered that Johnson and St. HOPE had failed to use the federal money for the purposes specified in the grant and had also used federally-funded AmeriCorps staff for, among other things, "driving [Johnson] to personal appointments, washing his car, and running personal errands."

Walpin recommended that Johnson be banned from ever receiving any more federal funds.  But after the passage of the $787 billion stimulus bill, amid worries that such a ban on the mayor would keep Sacramento from receiving its share of the stimulus cash, the board of the Corporation for National and Community Service reached an agreement with the acting U.S. attorney in Sacramento under which Johnson would repay some of the mis-spent money and also be eligible to receive new federal grants in the future.  Walpin strongly objected to the agreement.  (Knowing his opposition, the board excluded him from the negotiations.) 

Walpin's objections were the subject of a now-controversial May 20 meeting in which Walpin, to use his term, "lectured" the board on what he believed was its mistake in approving the Johnson settlement.  On the morning of the meeting, the Sacramento Bee reported that a man named Rick Maya, who worked with Kevin Johnson in the St. HOPE project, claimed that Johnson's emails had been deleted during the time of Walpin's investigation.  The Maya news suggested that there might have been obstruction of justice in the St. HOPE affair, and Walpin used it to drive home his point that the board should have let his investigation stand.

It appears the discussion of the St. HOPE matter was a turning point not only in the May 20 meeting but in Walpin's tenure at the Corporation.  In a recent interview, a Republican member of the Corporation board told me that Walpin told board members at the meeting that he wanted to issue some sort of public statement to the effect that there should be more investigation of the St. HOPE matter.  "He said, 'I feel so strongly about this that today I am going to issue a statement to the press calling for further investigation,'" the member said, recalling Walpin's words.  "The board members all caught that.  Several of us wrote down that he was going to be issuing a statement to the press that afternoon."

It was a distressing scenario for the board.  As a favorite program of Barack and Michelle Obama, AmeriCorps was enjoying a higher profile than ever before.  The Corporation also stood to receive vast amounts of new funding from the $5.7 billion Edward M. Kennedy Serve America Act, which would triple the size of AmeriCorps. And in the midst of that, here was the agency's inspector general saying he might re-open an investigation into an embarrassing episode involving hundreds of thousands of mis-spent dollars and a politically prominent supporter of the president.

"Right now, when there is such a great emphasis on service, we did not need any press out there on this St. HOPE matter, which was already settled," the board member told me.  "We thought he was going to use the press…He had an issue with the fact that a settlement was reached…and he was doing everything he could to continue to keep the issue at the forefront."

As it turned out, Walpin did not issue any statement, to the press or anyone else.  (He doesn't recall whether he said precisely what the board member recalls, although, he told me, "There wouldn't have been anything wrong if I had.")  Instead, Walpin contacted the FBI in Sacramento with word of the Maya allegations, and agents there are now investigating the matter.

Later in the meeting, members questioned Walpin about his intentions.  It was at that point that they say Walpin became confused and disoriented.  But whatever Walpin's demeanor, it appears that board members, of both parties, were worried about the possibility of embarrassing new revelations involving a sensational case they thought had been closed.  After the meeting, the board began an accelerated effort to remove Walpin, compiling an informal list of grievances against him -- he could be difficult, he telecommuted, he was somehow disabled -- that the White House would ultimately cite as cause for his firing.  But there is no doubt that, whatever the other reasons, the board feared that a revival of a scandal they thought was in the past would be embarrassing to the newly-prominent AmeriCorps.

Ahhh, the poor lil board member, he should be the one going out the door. Also remember michelle heavy involvement in americorn, they called jerry on eve June 10 to fire him and michelle was arriving back in D.C.on afternoon june 11 from london [no fingerprints!].

Johnson had a duty to resign the Mayorship. That he would assume the position of Mayor while being debarred from federal business is unconscionable. Lifting the debarment for criminal acts not the solution here. Perhaps you can also tell us more about the Americore debacle at CUNY in the 80 million range that Walpin was simultaneously investigating.

I was surprised your article didn't see fit to mention Republican Lawrence Brown, the acting US Attorney who settled with Johnson/ St. Hope and criticized the actions of Walpin. Without the whole story, one might think you had an agenda. But it's the MSM who got it wrong, I'm sure.

Uh, Sean, the story is the firing of an IG by the President in violation of a law he co-sponcered in the Senate. One would think the MSM just might be interested in why the President would violate his own law. The story is not whether a Rep. US Attorney settled with St. Hope. That might be a story depending on how an investigation of the Johnson/St. Hope affair turns out.

Well clearly the President HAD to break the law, violating a law he co-sponsored; and remove Walpin immediately without the requisite information to Congress 30 days before firing. Why? One of his employees might have been confused. Fire him immediately without notice or cause. Joe Biden is said to be a bit nervous about the whole thing... not sure why.

So much of what is being trown at Walpin is ludicrous. The relationship between an Agency and its IG is supposed to be adversarial when non-compliance and amlfeasance is found out - like the relationship betweenme and an IRS auditor. If I can't timely produce the required comtemporaneous documents, I'm hosed, and the only way to change the findings of the audit is to come up with the documents that prove my deductions, or in the St.Hope case, the Invoices for services rendered per the conditions of the grant. What's interesting is that Walpin was willing to have the City have someone other than Johnson be assigned to care for Federal funds, so that the City wouldn't suffer. I would have gone for the throat. Even though it was still a civil matter, I would have used the treble damages threat, and also demanded disgorgement of his ill-gotten gains - specifically the mayoralty - after all, St. Hope moneys were used for political purposes, among others.

This whole thing infuriates me. Walpin's job was to prevent misuse of taxpayer money, that's OUR money, and he did his job too well, so they got rid of him. Leaving the field clear for the continued misuse of millions of dollars of OUR money! This is just wrong! I don't care if the people involved are Democrats or Republicans, they all need to answer for this misuse of power! Why are people just ignoring this?

Great story - I hope your able to continue moving forward on this. The Bush administration may have made mistakes in being too aggresive in protection the USA, but here we have an administration aggressive in self interests no matter the costs.

This entire story is bizarre. Inspectors General were created--by law--to police activities of a designated agency, but were never to be answerable to that agency. The president appoints all IGs and the term is 10-years--so no president such as Obama can dismiss an IG without serious cause. I can recall, not a single IG who has been fired--since Jimmy Carter created the program in 1979--30 years ago. Will Obama get away with such flagrant political corruption? If so, the USA is no better than the likes of Castro and Cuba.

The St. HOPE deal was a sweetheart deal for sure. If you look at other agencies who have been caught misusing funds, they usually pay 2x the amount misused plus a fine. Some people even go to jail. The fact the Kevin Johnson got off so lightly is an outrage and I certainly don't blame Mr. Walpin one bit for wanting to go to the press. The ACTING US attorney, Mr. Brown, was NOT a Bush appointee- his predecessor wasand stepped down last fall. Mr. Brown is a government employee who stepped in to fill the post until Obama appoints someone. Perhaps he may get his appointment now that he settled this case so favorably for Obama. Someone should look into that.

This is typical of our liberal establishment: when out of power, do a lot of posturing and posing about integrity and support of oversight, then, once securely in power and having stuck enough of the people's noses in the public trough, completely abandon any such pretenses of public integrity or responsible handling of the taxpayers' dollars. Why should there even be an Americorps at all? What function has it served other than to be a public sector version of ACORN paid for by the American people whether they want this group or not? It can be reasonably inferred from the known facts that this started as a rather ordinary fraud and theft of tax funds by Obamas' friend and heavy money supporter, Kevin Johnson, that the Ameri-Corps board wanted swept under the rug. It got out of hand as a White House fraud by the President when he used his well known "Chicago community organizer" skills at underhanded firing of an honest IG, who was doing his job, of protecting our hard working tax paying citizens and the country. The President apparently figured he could quietly ease this annoying honest public servant out of the way and go on plundering the public purse with his dishonest friends but got caught with his hands in the cookie jar and it is about time we see him as he is and not as he wants all to believe him to be, a nice high minded black fellow from that sweetheart city Chicago. Where is the MSM? Will they ever again do their job?

Perfectly understandable reaction to a line of questioning that implicitly suggests that Walpin stop doing his job and play ball. If this was merely the problem of one event at one meeting, the power of the president would not have been used. It's time to start putting the heat on individual board members. Are they united in support of Obama on this? If so, they'd better be prepared to share the shame. In particular, are Republicans Jim Palmer, Steven Goldsmith, and Eric Tanenblatt willing to bet their reputations on this? (Steven Goldsmith apparently is, from his public statement of support for the firing.) I work in the Fed and what I hear is that Walpin is reportedly a mental case and a troublemaker. Isn't that interesting? "They" are trying to destroy this guy from within. Check out Norman Eisen, Obama's chief of ethics, a friend from Havard Law, and also a community organizer, and his role in firing Walpin. Gee, where else has this sort of thing happened to citizens? Only in totalitarian states like Russia, but then his Obamaness, et al., has America in his socialist sights.

Walpin should not have been fired in this manner. But don't think for one minute that he is as squeaky clean as the conservatives are trying to portray. He does not like democrats and he does not like other segments of society. He investigates those he does not like. He is above the law, feeling that he does not have to comply with federal law when it's inconvenient.

U S Attorney Brown in Sacramento entered into a sham so called settlement agreement, to sweep things under the rug. When Walpin criticised that "farce" agreement, Brown wrote to FBI Kaiser in D C, with copies to the Board that oversaw AmeriCorps, which led to Walpin being fired. This was a raw act of intimidation to coverup up much more. Why aren't any looking into more on Board ties, and so in Sacramento. I don't feel this story has been fully reported on, yet. Will major events on matters be just ignored in a few days, as we drift on to some other fluffy frill in D C.
