AmeriCorps stonewalls questions of White House involvement in IG firing

A top official of the Corporation for National and Community Service, the government agency that oversees AmeriCorps, has refused to answer questions from congressional investigators about the White House's role in events surrounding the abrupt firing of inspector general Gerald Walpin.

Frank Trinity, general counsel for the Corporation, met with a bipartisan group of congressional investigators on Monday.  When the investigators asked Trinity for details of the role the White House played in the firing, Trinity refused to answer, according to two aides with knowledge of the situation.

"He said that's a prerogative of the White House, so he didn't feel at liberty to disclose anything regarding White House communications," says one aide.

Investigators asked Trinity whether he was claiming executive privilege, something that could only be authorized by the president.  Trinity answered again that it was a White House "prerogative."  When the investigators pointed out that, in the words of one aide, "there is no legal basis whatsoever" for such a claim, Trinity still declined to answer.

According to the knowledgeable sources, Trinity refused to say what contacts the Corporation had with the White House prior to the firing, or after the firing.  He refused to say who at the Corporation had spoken to whom at the White House.  He refused to say whether Corporation officials had discussed the specific reasons for the firing with the White House.

The last topic is particularly important to investigators, who believe the Obama administration may be constructing an after-the-fact rationale for canning Walpin.

When Walpin was fired on June 10, a White House lawyer told him that the president no longer had confidence in him.  When congressional Democrats asked for a more detailed reason, the White House said Walpin had become "confused" and "disoriented" at a May 20 meeting with the board of the Corporation.  Now, the story has shifted again, to emphasize allegations of racial and gender insensitivity in a parody newsletter produced to mark the retirement of a worker in Walpin's office in May 2008. 

The newsletter, which was not written by Walpin, said that the departing worker, who handled procurement for the office, had "finally procured her federal retirement" from a "retirement vendor" who was a "qualified minority-female-veteran-disabled person."  The newsletter also joked that the procurement official would be replaced by disgraced former New York governor Eliot Spitzer, who specialized in "the procurement of blondes, brunettes, and redheads."

The newsletter was written more than a year before Walpin was fired.  The board of the Corporation did not cite it as a reason for its unhappiness with Walpin.  The White House did not mention the newsletter in earlier versions of its reasons for firing Walpin.  Yet at the meeting with congressional investigators on Monday, Trinity pointed to the newsletter as one of the main reasons for Walpin's dismissal.  When asked whether anyone at the Corporation had discussed the newsletter with anyone at the White House, Trinity refused to answer.

Prior to being fired, Walpin had been investigating misuse of AmeriCorps money by Sacramento, California mayor -- and prominent Obama supporter -- Kevin Johnson.  Walpin's investigation led to conflicts with members of the Board, who supported a decision by Trinity and other top Corporation managers to reduce Johnson's punishment.  Walpin strongly opposed that decision.  After board chairman Alan Solomont, a top Democratic fundraiser, complained to the White House, the White House counsel's office claimed it conducted an "extensive review" of the matter before the president's decision to fire Walpin.  But three board members have told congressional investigators that the White House did not contact them during the review.  (One was told about Walpin's firing at about the time it happened, and the other two were contacted days later.)  In addition, the White House never contacted Walpin himself, nor did it contact his top assistant, leading congressional investigators to question whether the "extensive review" was really just a cover for a decision that had already been made.

I read the parody newsletter, and thought it was hilarious. Anyone, and I mean ANYONE, who reads that and gets in a twist has absolutely no sense of humor, and is looking for a reason to be "offended." Where's the special prosecutor? We sure didn't hesitate to demand one in the Valerie Plame bull, and this one is on a scale so far above that nonsense as to be mind boggling. How's that Hope and Change working out for you? Looks like Capone wasn't the only evil criminal in Chicago's history.

What's the big deal? Everyone serves at the pleasure of the President. Just look at the former CEO of General Motors. Obama's going to change this nation, kicking and screaming, and he has to have the latitude to get rid of people that don't roll his style. How do you think he's going to seize the property of the upper 50% if he doesn't have the unfettered power to arrest, fire, or take at will?

I'm hoping that HatlessHessian is being sarcastic, because the reason this is such a big deal is because of a bill he helped passed in the Senate. Unlike other positions, IG's, due to the bill he helped pass, cannot not just be summarily dismissed. They are no longer "at-will" employees. In order to remain "apolitical" a President MUST give Congress 30 days notice and a VALID reason why he is dismissing an IG. As far as Bush firing 8 federal prosecutors? That was just priceless since Clinton fired and replaced ALL of them.

My question is, why is this Trinity guy still in HIS position? If I, as a citizen refused to answer questions in an investigation, I'd be fired and most likely, in jail. I don't know about you, but I, for one have had a belly full of the whole "Government overlord" thing. To be employed by the government (i.e. the people) does not make you immune to the law, or superior to your employers (us!) They need to get a grip on that.

Kathy, The reason is that this isn't an investigation. Congress is not a court, they are the legislature. They could issue subpoenas and if they refused to answer refer them to a criminal court for prosecution. That being said, the Dems are more than likely try to avoid that as anything that reflects poorly on the President will also hurt them.

Don't let the Walpin firing investigation and reporting drop. We must expose the Obama's role in this. They are going to stonewall this forever. The White House has violated the law on IG terminations that Obama was a co-sponsored. Obama must explain himself.

Well, more facts will come out soon. We'll discover Mr. Walpin ALSO had a library book that was returned three days overdue in 2005. As a citizen I feel privileged to have had Mr. Walpin on duty providing oversight.

Good for you, Bryon York! Keep up the investigative reporting. Just think how long it took for the Watergate investigation to put forth enough facts for people to finally respond to it. Who knows? Maybe some of the lame White House Correspondents will get tired of being manipulated and their profession disgraced by their dishonest reporting, and follow York's example of seeking the truth.

Walpin deserved to be fired. Not for the parody newsletter, not for being disoriented, but because he had a flagrant disregard for federal rules and regulations. He felt was so much smarter than everyone he encountered and he let them know that. And get off the old saw that this is being done by the Democrats. The Republicans fired Luise Jordan, the first PAS IG at AmeriCorps. It is all politics as usual in Washington. This time the guy had it coming.

An Blatant Cover-up by Obama Cronies to stop the inquiry into the ILLEGAL Actions of the White House Staff ( undoubtedly with full Knowledge & approval of the CIC) to protect a Long-term Obama fundraiser & Pal at the Expense of the American Taxpayer & an IG that was actually doing his Job and trying to Protect the Taxpaying Public from Corruption & Political Influence in the ranks of the Public service Domain. Trinity was & continues to be a Prime Mover in this Illegal Dismissal of Mr Walpin, Hence his reluctance to talk about it. The onlt real Question is "Why didn't these Congresspersons find this little Obama Toady in Contempt of Congress & have him Incarcerated"? oops! that is really rhetorical isn't it. We all Know the the Democrats would Never allow one of their own to suffer such an Ignamonious affront to occur to one of their own. It seems our 'so called' legislature has forgotten who put them in office. It is a time for replacement, Folks. If Bush could fire 8 men and Clinton could fire them all, we only need to take 3 out for each of us. Two senator and 1 (non)representative. Lamar Alexander and Bart Gordon of Tennessee emailed me Oba ma had been investigated and found eligible. but they couldn't tell me where they got that information or why they wouldn't give it to 'we the people'. It boils down to: how can a man with a Kenyan father be eligible for the Oval office? Folks, our 'so called' legislature allowed it to happen. Have any of you old folks ever heard of a supreme court holding a private meeting with a presidential candidate? I haven't. The goal now it to get our nation in debt where he can declare a "state of emergency" and take over as dictator. We are in the socialist middle regime now. Dictatorship is next. And I hope I'm wrong.

Americorps must be commanded by congress to reveal the details of this illegal firing. Let the President then be forced to either come clean about Walpin's firing, and the corruption by Kevin Johnson that Walpin uncovered... or, declare "executive privilege," thus proving his complicity in the cover-up.

Is there an address or telephone number where "we the people" can call on behalf of Walpin? The company that he was investigating, the company that appeared before Congress? Do whatever it takes, peacefully, and we can have results. Keep up the great work and please don't let this one die...Mr. Walpin did the right thing and they punished him for it!
