CRS Report: Honduran 'coup' appears legit

In response to the ouster of Honduran President Manuel Zelaya, the U.S. State Department cut off foreign aid to Honduras and stopped approving visas for government officials. The U.S. is even threatening now to de-legitimize that nation's upcoming November elections, and has been treating the interim government of Roberto Micheletti as a rogue regime.

But State's is not the only opinion. By way of contrast, a new report (click here for the pdf) from the Congressional Research Service bears out what our editorial board has been pointing out for months now: The situation in Honduras should not be a cause for concern in Washington. It should a relief.

President Zelaya, who was attempting to subvert the constitutional order of Honduras by seeking re-election (considered a crime there) was removed from office by the order of civilian authorities, and the constitutional order of succession was honored afterward.

The legal arguments made in the report, which was prepared by Senior Foreign Law Specialist Norma Gutierrez, are quite intricate and based in Honduran law. But the bottom line is this:

  • The Honduran Congress appears to have acted properly in deposing President Manuel Zelaya. Unlike in the United States, the Honduran Congress has the last word when it comes to interpreting the Constitution. Although there is no provision in Honduras's Constitution for impeachment as such, the body does have powers to disapprove of the president's official acts, and to replace him in the event that he is incapable of performing his duties. Most importantly, the Congress also has the authority to interpret exactly what that means.
  • The Supreme Court was legally entitled to ask the military to arrest Zelaya. The high court, which is the constitutional venue for trials of the president and other high-ranking officials, also recognized the Congress's ouster of Zelaya when it referred his case back down to a lower court afterward, on the grounds that he was "no longer a high-ranking government official."
  • The military did not act properly in forcibly expatriating Zelaya. According to the CRS report and other news stories, Honduran authorities are investigating their decision, which the military justified at the time as a means of preventing bloodshed. In fact, Zelaya should have been given a trial, and if convicted of seeking reelection, he would have lost his citizenship. But he is still a citizen now, and the Constitution forbids the expatriation of Honduran citizens by their government.
  • The proper line of succession was followed after Zelaya's ouster. Because there was no Vice President in office when Zelaya was removed (he had resigned to run for president), Micheletti was the proper successor, as he had been president of the Congress.

“The nonpartisan Congressional Research Service concluded the removal of former President Zelaya was Constitutional, and we must respect that," Rep. Aaron Schock said today. "It's unconscionable the administration would attempt to force Honduras to violate its own Constitution by cutting of foreign aid.”

I am Honduran and most of us support what was done in our country. We had peace until our ex president came back but we do not want or need a New Constitution as he and his followers state. they do not want elections so what type of democracy is that. WE WANT ELECTIONS AND TO BE A FREE COUNTRY.. neither tue US, Venezuela or other nation can tell us how to live.. we want as Americans say..LIBERTAD, EQUALITY AND FRATERNITY!!HONDURAS!!

We had peace after Zelaya left since he openly disobeyed all orders and disrespected all authorities. We are happy to have elections on November so we expect all the nation´s respect for our democracy and independence. We do not want Zelaya, Chavez and all the new social communists in our country. The Honduran congress acted properly by preventing a president from violating the constitution as has been done repeteadly in Venezuela by dictator Hugo Chavez. The people of Honduras should be proud o their democratic institutions. Those countries that are backing Zelaya should see what Chavez has done in Venezuela. Chavez is continuosly interfering in other countries internal affairs.

It just seems strange that State and the Administration never seemed to actually investigate the whole thing. the conclusion Honduras was acting properly seems undeniable. So, why did the administration deny it?

Any rational person, when finding himself on the same side as Chavez would at least attempt to reevauate his position.

Thanks for reporting on this situation. Unfortunately, Zelaya is using the poor as a cover for his quest for oil money and unlimited power. Zelaya needs to get out of Honduras and let the elections proceed. Hopefully, the new leader will have the eyes of the world on him and do a good job.

What the CRS has revealed is clear. I have written two article (www.resdal.org.ar) explaining with constitutional basis what happened in Honduras was not even a "coup", but a "Constitutional succesion". Rhy the State Departmente has not recognized that? That is the bic cuestion with a small ansswer: they fear international presure and wanted to get rido off of it, specially that coming from the ALBA countries headed by president Hugo Chávez. They did not dare to say it was a a "military coup", but concluded it was a "Coup dé E´tat" havingno no single constitutional nor legal suport.
All that mess was created by José Miguel Insulza, secretary general of the OAS. That is way president Cház was right when he declared that president Obama in in "terrible labyrinth", much more with the help secretary has giving to him. Could they get out of this labyrinth?

I am very bitter, I'm an american born in Honduras, every year my family (4kids my wife and I) go to Honduras on vacation. This summer we went and I was impressed with the level of support that people have for the decision made to remove Zelaya from power. It is very hard to read, to get informed, to talk to people in the streets and every where and still understand how can our american government still insist for a criminal to be place back in power.

I thinks that any intelligent president just the fact of having enemies of democracy such as Hugo Chavez and his gang supporting someone should be enough to start paying attention but not to our presiden and a Clinton.

I don't get it why, why, why would they abandon a country that for so long has struggle to keep itself in peace and a friend of the US?

PLEASE, PLEASE, US Congress, don't let this information die out. Let the whole world know that this was a constitutional succession.

A big problem is that the US is too worried about healthcare to care about a little third world country that has nothing they are interested in, like oil.

Well, what the do have is BALLS to stand up to the whole world and defend their constitution.
We should all learn a civics lesson from this "Little Country that Could" and DID!

Dear fellow commentators, I share with you the frustration of this bizarre period in international politics. It seems we are in Alice Wonderland with everything backwards.

Now ... let's be clear. There is no reason, or laws behind the presidents's
actions against Honduras. They have formed an international Elite Club of people in fear they all might share same fate as Zelaya's. It is this very understandable fear what's driving them crazy...

Their fierce fight to return Zelaya to power is really for them a safeguard, in case their citizens decide to question their actions in their respective countries.

History will be the best judge here.

I LIVE in HONDURAS there is no such thing...one radio station and one tv channel are off air..though it was a bit extreme..right now they Congress is debating to veto that law..so it will probably be taken out soon...you are concern about the shutting down of radio stations I would like you to make a voice of protest over the HUNDREDS of free media that CHAVEZ has taken out...
