Dems push expanded Community Reinvestment Act; deny Act's role in mortgage meltdown; GOP cites ACORN connection

A number of experts believe that aggressive enforcement of the 1970s-era Community Reinvestment Act contributed to the mortgage meltdown, and thus to the greater financial crisis, by requiring financial institutions to lend to unqualified borrowers. Now, the Democratic majority in the House of Representatives is responding to that situation by proposing to expand the scope and power of the Community Reinvestment Act.

This morning House Financial Services Committee chairman Rep. Barney Frank held a hearing on H.R. 1479, the "Community Reinvestment Modernization Act of 2009." The bill's purpose is "to close the wealth gap in the United States" by increasing "home ownership and small business ownership for low- and moderate-income borrowers and persons of color." It would extend CRA's strict lending requirements to non-bank institutions like credit unions, insurance companies, and mortgage lenders. It would also make CRA more explicitly race-based by requiring CRA standards to be applied to minorities, regardless of income, going beyond earlier requirements that applied solely to low- and moderate-income areas.

Republicans on the committee strongly oppose the plan. "Instead of looking to expand the number of institutions that must abide by Community Investment Act regulations," California Rep. Ed Royce said in prepared opening remarks at today's hearing, "I think we should reassess the role this and other government mandates played in the financial collapse and consider scaling it back."

In private conversation, other Republicans were more emphatic. "There is clearly arguable evidence that the CRA is at the root of this financial meltdown," says one GOP committee member. "So what do they do? They try to expand CRA."

But Democrats, led by H.R. 1479 sponsor Rep. Eddie Bernice Johnson, claimed that expansion of CRA is much-needed. "Congress has passed a number of laws designed to combat redlining and eliminate housing discrimination," Johnson said at the hearing. "Unfortunately, we all know that redlining still occurs."

Then there is the ACORN angle. Republican critics point out that the Association of Community Organizations for Reform Now has used the CRA to pressure banks to pour money into ACORN and its affiliates, allowing ACORN to facilitate loans to clearly unqualified borrowers. Now, with ACORN under fire after a series of undercover videos showing ACORN workers in Baltimore, Washington DC, New York, and California openly encouraging prostitution, tax evasion, and other crimes, Republicans on the committee are citing the CRA-ACORN connection as yet another reason the Act should not be expanded.

Johnson's bill has 51 co-sponsors, including some of the most liberal members of the House, like Reps. Dennis Kucinich, John Conyers, Bobby Rush, Steve Cohen, and Barbara Lee. Given the Democrats' tremendous numerical superiority in the House, if the majority wants to expand CRA, Republicans will be unable to stop it.

Guess it wasn't enough that Barney Frank's nonsense just caused the value of my home to drop like an anchor. Now he wants the American public to allow him to repeat his crap? Is Maxine Waters backing him on this the way she backed him when they both told the Republicans in 2006 that there was no need to regulate Fannie Mae and Freddie Mac because they were doing just fine? Sleeping Beasts where ever there are definately need to wake up and put the screws to this one. Only people that can afford to pay loans and the going rate should get loans, otherwise there are a lot more rental properties now than there were curtesy of Franks. Oh and before anyone says it, It isn't because I'm a racist, it is because I want my house to go back to being worth as much as I paid for it.

I noticed this bill is called the "Community Reinvestment Modernization Act of 2009." Just the title of the bill should send shivers down the backs of all Americans. Here is the title of the stimulus bill: the American Recovery & Reinvestment Act of 2009. Clue: Whenever you hear the word, reinvestment, a red flag should fly up.

Brought in my Carter, enforced by Clinton, warned by Republicans as Wall Street watches loans default on their first payment to these free loaders in the 90’s and now as we sit in 2009; my new home is negative, I can’t get help because I make too much to mod my loan, WTF. Frank and Waters are criminally negligent in promoting a bad bill that will result in further bank failures and collateral damage to the economy. Waters at least has a pattern of attributing every problem to racism so she is just stupid. Frank ducked responsibility for his role before, obviously thinks he can again, but may not. FHA is ready to go bankrupt as Freddie and Fannie did.

Look for further nationalization of the banking system, as recommended by Marx, and big unemployment numbers for a long, long time. Someone in DC has to know this, and is comfortable with it. We are being fragged.

To bad Congress never investigates itself. If they did, Barney Frank, I think, would be front and center as far as blame goes. But, of course, Congress does NOT investigate its own blame, so Barney can keep blaming others for the housing meltdown.

By the way, it is not discriminatory to refuse to loan money to a person who can't afford to pay it back. The community re-investment act was passed in 1977 for crying out loud I wonder how many mortgages went full term & were paid off in the last 30 years. The facts are Fannie & Freddy were only 12-13% of the sub prime mess. Let focus on the Wall St. villians who really sold us down the river.

Yes. And it was widened by Clinton, and restrictions loosened over the next decade by both parties in Congress.

The CRA _was_ the major factor for the financial crisis. Profiteering was also a factor, but it was only made possible by the CRA and the protectionism surrounding it.

But more importantly, where did government get the idea that it has the right to 'close the wealth gap'?

And why can nobody see that every action they take to 'close the wealth gap' actually WIDENS it? The housing bubble caused the price of homes to DOUBLE in the early 2000's. How many low-income families can afford a house now, thanks to all these programs to 'help' them?

It's insanity. But liberalism is a mental disorder.

OMG...I just read this...are the Dem's out of their minds? We have to get this to the public's attention....Hannity...Beck...Hey guys...O'Reilley...we need you! This is what started the foreclosures. I am a Broker and I saw it happen right before my eyes and there was nothing we could do. The Dems blocked the Repubs in 2004 when they tried to change the legislation. I believed the Repubs tried twice. This is horrible...everybody write to Sean, Bill, Rush and Glenn and let them know what the Dems are up to. Good God...not again!

I can't believe we're in for another round of this crap. Three houses on my street (my block actually) were purchased through the Reinvestment Act about 6 years ago. The owners had to them them go into foreclosure when the ARM adjusted. Young, smart investors bought them, fixed them up and we began to see houses being sold for what they're worth again. Now we have to see it all happen again ? Why are we being forced to give our tax money to programs that are bound to fail AGAIN?

The liberals who support this are not held accountable by their constituents. If Maxine Waters and Barney Frank and Chris Todd were wrong about the finacial status of Fannie/Freddie in 2004, and these loan guarantees contributed to the collapse of MBS(which is a fact), then the folks who continue to support/vote for them DO NOT CARE if they were wrong, only that they provide benefits to their own communities, at the expense of US taxpayers.

Barney Frank is one of the most dangerous men in Washington. Failure to recognize indications the GSE's were failing and needed more oversight was his committee's failure; sleeping with the Fannie assistant director I'm sure did not "color" his thinking at all.

I spent 35 years in banking and 20 of those in compliance, and I KNOW the CRA is tantamount to government "red lining" forced upon banks. It did indeed lead to the lending issues that got us here and the number of foreclosures we're experiencing.

It's time Barney and Friends get their blinders taken off and get forced to understand the economics of the marketplace. Congress isn't where you learn business and economics; it's where you learn to ignore them.

The fair lending laws inacted by Congress, played a major role in the mortgage crisis, but the Fair Housing Act, used federal minority discrimination laws, to encourage lending institutions to write sub-prime mortgage loans.
HUD in turn, encouraged minorities to file lawsuits against lending institutions, if they failed to comply.
