Maryland may charge ACORN video-makers, State's Prosecutor heads anti-child abuse group UPDATED!

James O'Keefe, the intrepid filmmaker who teamed with National Journalism Center intern Hannah Giles in the ACORN video sting, now faces the prospect of being prosecuted by the Baltimore City State's Attorney for violating a Maryland that makes it illegal to tape an individual without their prior permission.

If he is convicted, O'Keefe could spend five years in the Maryland State Prison. Yes, you read that right. Here's the complete statement issued late yesterday by the prosecutor, Patricia Jessamy:

"Baltimore, MD – September 11, 2009 – We have received inquiries from citizens and the media asking whether the Baltimore City State’s Attorneys Office would initiate a criminal investigation for acts allegedly committed at ACORN offices located in Baltimore. The only information received in reference to this alleged criminal behavior was a YouTube video. Upon review by this office, the video appears to be incomplete. In addition, the audio portion could possibly have been obtained in violation of Maryland Law, Annotated Code of Maryland Courts and Judicial Proceedings Article §10-402, which requires two party consent.

"If it is determined that the audio portion now being heard on YouTube was illegally obtained, it is also illegal under Maryland Law to willfully use or willfully disclose the content of said audio. The penalty for the unlawful interception, disclosure or use of it is a felony punishable up to five years.”
 
Jessamy, a Democrat, was appointed to the State's Prosecutor position in 1995 and has since been re-elected to the job three times. Among the items listed on Jessamy's extensive resume of accomplishments is that she is president of the Baltimore Child Abuse Center. She also lists her prior membership on the Governor's Council on Child Abuse and Neglect from 1995 to 1998!
 
Let's be clear about what is happening here: O'Keefe and Giles dressed up as a pimp and prostitute and walked into the Baltimore ACORN office seeking "tax advice" for a brothel that would include the use of 13-year-old sex slaves from San Salvador. Two ACORN advisers happily provided all kinds of advice about how to deceive federal and state tax authorities about the true nature of the "business," and how to insure that the prostitutes "keep their mouths shut."
 
In other words, two ACORN employees appear to have voluntarily become accessories to multiple federal, state and local crimes, including child abuse, interstate transportation for purposes of prostitution, tax evasion, and immigration law violations. The two ACORN employees may also have thus provided hard evidence that their employer should be prosecuted as a criminal enterprise under the RICO statutes.
 
And the Baltimore City State's Attorney may prosecute the two people responsible for exposing this heinous operation!
 
If any of this sounds vaguely familiar, it should because back in the Clinton days, the Maryland State's Prosecutor prosecuted Linda Tripp for recording Monica Lewinsky's description of her sexual encounter with President Bill Clinton. And, as the Baltimore blog Inside Charm City noted, this particular ACORN office has previously been in hot water for apparent illegal activities.
 
Reasonable people can disagree about the importance of the Lewinsky matter, but nobody can deny that O'Keefe and Giles have exposed multiple serious felonies involving sex slavery, child abuse, and federal tax evasion.
 
And by the way, O'Keefe and Giles did the same sting on the Washington, D.C. ACORN office. You can watch the videos of both sting operations here on the BigGovernment.com web site. BigGovernment.com is the product of the fertile mind of Andrew Breitbart.

An eagle-eyed Hot Air reader notes that Jessamy did nothing in recent years when two Baltimore media outlets used the same hidden camera technique to after stories that ultimately won professional plaudits from journalism colleagues. And in the same post, Hot Air's Ed Morrissey points to the substantial evidence of Jessamy's intensely partisan approach to the duties of her office.
 
Having lived in Maryland for more than a decade and covered politics at the local and state levels here, nothing about this story surprises me. Maryland is a one-party state that is effectively controlled by the Democrats, and nowhere more so than in Baltimore City. As with any monopoly, the result is always abuse of office, corruption and hypocrisy.

Well, the DA didn't jump out and declare he was filing charges against them. He got asked by "concerned citizens" - aka ACORN shills - if this was a crime and made a pretty non-committal statement saying it could be.

Trouble is, if it goes to court then ACORN has to admit all the statements on the tape are true and it wasn't staged. That nails them for multiple felonies so they're not going to testify against themselves. That's how most journalistic stings like this slide by the law: The perp caught committing a crime on tape won't testify against himself so there's no case.

I can't even begin to imagine anyone prosecuting the people trying to EXPOSE a child prostitution ring, instead of the people shown on tape trying to help set one up. Not to mention the tax evasion tutorial they provided. It must mean that Jessamy is corrupt as well.

This is not going to play well in the news for her. Her picture and name will become synonymous with ACORN corruption.

That dog won't hunt anyway. Look at the precedent set by the Food Lion case and the extensive use of hidden camera sting operations by media outlets like 60 Minutes. It would be fun to watch the prosecutor trying to argue that the same thing would have been OK if 60 Minutes did it, but not OK if done by a smaller media outlet. Bottom line: The folks involved will claim freedom of the press and they will have case law behind them.

well first off, after watching hannah on glenn Beck, she clearly said that she didn't like ACORN and she was going to devise an undercover plan to nail them.

SO right there, she is already stepping way past the boundaries of basic journalism ethics.

If you want to do an undercover investigation of soemthing, then you do it impartially, accepting the results of it whether or not the result backs up your own theory or disprooves it.

Second, it's curious she chose prostitution and brothels as her bit. If she went after ... Oh, I don't know, one of the million corrupt credit card companies out there, I doubt she would try and nail them with the prostitution and brother angle.

But, I guess since she was going after black people, that must be her perception of what blacks are all about.

Keep playing the race card Jim. It's working soo well! I hope that the Maryland State's Attorney brings charges against James O'Keefe and Hannah Giles. These two courageous twenty-somethings are the 21st Century equivalent of John Peter Zenger. If charges are filed against them, I guarantee you that within a few short weeks, they will be blessed with a huge war chest to fight the charges. They will have the resources to match the state’s case dollar for dollar. This pool of resources will be made up of hundreds of thousands of modest contributions from ordinary people. No competent, responsible attorney will waste scarce funds prosecuting a case they can not possibly win and that would be sustained on appeal. Why don't you answer the question about basic media ethics. I have been a professional reporter for 13 years and I have never once did a story where I was out to "Nail" a person or a group.

That form of reporting is not called news its called made up news. All the racist "supposed Crimes" in this case were introduced by hannah montana and her dorky investigator friend who probably rushed to the hospital after the incident because that was the first time he had ever been in that close of quarters with a black person.

I say that Jim is naive. The human brain is fed by millions of neuroreceptors that perceive the environment. An individual processes these bits of data to come up with a perception of what a group of people does -- much like how a human perceives different species of dogs. Labrador retrievers are calm and non-violent. Yorkies are noisy but cute. Pit bulls are violent and avoided. If it is okay for humans can categorize dog species behavior, then why is it not okay to categorize different races as to their behavior? If my experiences tell me to beware of a race of people because myself or others that I know have been burned by that group of people, then why should I expose myself to that group. Racial profiling may not be that good, but it is part of the survival mechanism in human nature. Call me a racist. I do not care.

Lets see the ACORN idiots allegedly broke Federal law hence Federal Charges (we still have to have verification that the tapes weren't "edited", A valid issue since Glenn Beck is involved.) So if the "evidence" is good then these ACORN idiots face the Feds. The idiot "journalists" neglected to follow state law and as such face State Charges. Just because they are going after a group you don't like does not give them a free pass to break state laws! At least ACORN fired those on the tape instead of making excuses for them!

I don't remember Mike Wallace, Diane Sawyer, or others in the 60 Minutes group being asked if they liked the people they were investigating. And they went after their targets with the resources and reputation of a major network behind them, doggedly pursuing the object of their investigations.

I suspect that most stings are done after there has been actions that made a journalistic team want to document their wrongs. I doubt they just go out on fishing expeditions to see what will come out of the sting.

She should be prosecuting ACORN, an anti-American, radical progressive organization, permeated by subversives who have no regard for our laws. She is as absurd as they come and proves to sane individuals how far the left will go to achieve total control over the people.

A woman in Florida was charged with the same charge, 3 felonies, facing 15 years, for taking a video of her ex-boyfriend, a criminal judge, while he was on a public beach talking about women's breasts and posting it on YouTube. She was denied bond, spent 83 days in jail before pleading to a misdemeanor just to get out of jail. Her public defender neglected to tell her the whole time she was the judge's once divorce attorney.

The two ACORN workers can't be charged with a crime, because one didn't take place. If a crime did take place, the two reporters would be complicit and would have to be charged also. That's what happens when you "play" a criminal rather than being undercover.

One more thing to keep in mind about crime reporting is that often, the local or national news reporters don't do this kind of sting on their own, but instead are working with police or FBI for the story. If you've seen some of the reports of stings on pedophiles, the reporter is just following the investigators and documenting the process, not playing the part of a child and recording the criminal on their own.

Brings to mind the use of videotape by the FBI to bring down former DC Mayor, Marion Barry. Should the FBI have been expected to inform Mr. Barry that he was being tape recorded. If law enforcement does it, it's just fine, but if two journalists (even journalists with an obvious agenda) do it, it's considered to be criminal.

We have not seen the entire videos. Additionally, we know O'Keefe is a proven LIAR. Who knows what is accurate.

Additionally, even if the videos are partially accurate, we are talking about 3 employees out of 400,000 across the country.

The thought boggles the mind.

Have you seen O'keefe's other videos? He frequently likes to make fun of minority employees. It is obvious O'Keefe is a LIAR, an Elitist and a Racist!

He, however, not only illegaly taped, but also altered that tape--both video and audio--and then illegally and slanderously released it.

He's got multiple court dates coming: for his crimes in New Orleans, and for his slander and wiretapping against ACORN.

Of course, all the wingnuts here will have moved on to believing new lies by then.
