Obama's dissident database could be secret -- and permanent

The White House request that members of the public report anyone who is spreading "disinformation" about the proposed national health care makeover could lead to a White House database of political opponents that will be both secret and permanent, according to Republican lawyers on the Senate Judiciary Committee who are examining the plan's possible implementation.

On Monday, White House director of new media Macon Phillips posted a note on the White House web site complaining of "disinformation about health insurance reform."  "These rumors often travel just below the surface via chain emails or through casual conversation," Phillips wrote.  "Since we can't keep track of all of them here at the White House, we're asking for your help.  If you get an email or see something on the web about health insurance reform that seems fishy, send it to flag@whitehouse.gov."

In a letter to Obama Tuesday, Republican Sen. John Cornyn wrote that, given Phillips' request, "it is inevitable that the names, email address, IP addresses, and private speech of U.S. citizens will be reported to the White House."  Cornyn warned the president that "these actions taken by your White House staff raise the specter of a data collection program."

"I can only imagine the level of justifiable outrage had your predecessor asked Americans to forward emails critical of his policies to the White House," Cornyn continued.  "I urge you to cease this program immediately."

Senate Judiciary Committee lawyers studying the proposal say that although there is no absolutely settled law on the matter, the White House plan is likely not covered by the Privacy Act, which prohibits government agencies from keeping any records "describing how any individual exercises rights guaranteed by the First Amendment unless expressly authorized by statute or by the individual about whom the record is maintained."  Therefore, it appears the White House can legally keep records of the emails and other communications it receives in response to Phillips' request.

Those lawyers also point out that the White House is not covered by the Freedom of Information Act, which means it would not have to release any information on the plan to members of the public who make a request.

In addition, the lawyers say the collected emails likely will be covered by the Presidential Records Act, which requires the White House to preserve and maintain its records for permanent storage in a government database.  Phillips' request suggests that whatever information the White House receives on health-care reform "disinformation" will be used to further the goal of passing a national health-care makeover, which is, of course, one of the president's main policy initiatives.  Such material, and whatever the White House does with it, would qualify as presidential records. Only after more than a decade would such records be publicly available.

"So the White House, whether by design or accident, has requested information from the public that will become 'records' under the Presidential Records Act, yet would be impermissible for any government to otherwise collect under the Privacy Act," writes one Judiciary Committee source.  "Where were the lawyers in all of this?  What is their legal basis for authorizing the collection of these records?"

Linda Douglass, head of communications for the White House Office of Health Reform, says the White House is "not compiling lists or sources of information" on opponents of health care reform.  But if "fishy" information is indeed collected, as Phillips' request suggested, the laws involved mean that the information obtained by the White House could not only be secret but permanent. A dissident database, in whatever precise form it ultimately takes, could be around for a long time to come.

Aside from the privacy act, does the determination that the program is "probably legal" address the EO 12333 problems with collecting on US persons? Is all of the information they are requesting considered "publically available" or obtained by "consent of the person concerned"? It doesn't seem like it. Therefore, this would seem to be a clear problem if done by the IC. If it is done by any other agency, does it have statutory authority to collect on US persons?

I will be forwarding dissenting e-mails and originating some of my own in the days ahead, assuming that my internet access isn't somehow mysteriously broken off. I will also be attending as many townhall meetings as I can, and I will carry an American flag (you know, what Speaker Pelosi calls a "swastika"). Anyway, put my name on the list, please. Thank you for the opportunity to perform my civic duty."

Those lawyers who supposedly looked at this for legality of the program were probably in too much of a hurry (or are too partisan) to pay much attention to existing federal law 5 USC 552a, which PROHIBITS any agency, including the President, from keeping a database of information on persons exercising their Constitutional rights except for legitimate law enforcement purposes. It's time to push back against these blatant illegalities!

Keep in mind that the government has the ability to trace your email and IP address to your computer, look-up your social security profile, and do some pretty damaging things. Whatever they claim they're doing about "fishy misinformation" is a belligerent violation of free speech. If the republicans take the house and senate again and they find that there has been any retaliatory action against American citizens, Obama could be impeached.

Yes, I am also guilty of reporting myself. It happened so quickly that I could not stop myself from doing so. I hope I was the first one. If not, that's ok. I have actually recieved several hundred gigs of fishy information today. I am so glad that I upgraded to Verizon FIOS. At 25MB/sec it will only take a couple of hours to transmit the loot I have. I'll watch reruns of Red Dawn while I wait for the transmission to complete.

Most Posters seem to feel that Obama and company compiling a list of people who oppose an all powerful state is bad but not serious. Stalin killed between 20 and 50 MILLION people out of a population of 164 Million.

Historians cannot agree on how many were killed, because people just disappeared.

They people compiling this list are the same people who want total control over your health care. If you use mail order meds. How do you verify that the right stuff is in the bottle.

Big Brother controls the drug company and you are on his list. The computer fills the bottle, prints the label, you pass away. No police in the middle of the night, no protests, etc. Stalin would be jealous.

Regarding the NSA comment, there is a big difference in my opinion. In this particular case you have our current administration, our government, asking fellow citizens to rat out each other. Did the NSA ask that of us? This kind of behavior is dividing this country. Obama is making healthcare a "fight"...us vw. them....what kind of leader is that?

I also want to point out that everyday I believe our privacy is invaded. For example, when I go to the Jewel and use my Jewel card, that information goes into a computer and creates a profile on me. There is some website on the internet I came across the other day that had a whole bunch of information about me that I have no idea where they got it from. I don't like it but my point is that if people want info on you they can get it. However, having your government asking people to send in dissenting emails is way, way offensive.

The saddest part about this article and the trail of outraged comments that follow it is that it's a complete manipulation of the facts. The White House did not ask for a list of dissidents; they asked for the what, not the who: they want to know the counter-arguments to the president's policy.

Nobody (not even the author) read the note from the White House which is linked in the article. I love paranoia. Even if the Obama administration wanted to collect information on opponents, this would be most one of the most inefficient and useless ways to do so. Has the author never heard of the FBI, internet data-mining, etc., etc.

Well what did you expect.I for one am not supprised.I was not taken in by Obama's silver tongue,his good looks ,his nice family or his smart dress.NO I did not vote him in,but now we have him.This man could not arrange a two car funeral nor could he mananage a hot dog stand .Befor trying to establish a new healthcare system he should have looked at the present system and try to define the faults (like cheating by patients and medical personal. In the case of the budget he should look at the wellfare ( aid to single mothers ,disability food stamps) I would suggest that he is not interested in uncovering problems in that area.He has divided the country like no other man in our history. If you send an email out through the WWW then its a given its going to end up on a list somewhere...If Obama wants to see what the American ppl think so he can address those issues, and the American ppl are sending it through emails..then what is the big deal? There is no privacy on the WWW and if an email is being forwarded around the world then who cares if it ends up at the White House as well-in fact thats the first place ppl should send their opinion. As a "socialized" medical care covered American and as an individual who believes 50 million uninsured, and about 250 under insured Americans deserve more from their government then the same "old thing", for profit health insurance coverage,let me suggest that banning together to support the wellness of all Americns (socialisim) is not the same as saying that all the land you own and all the wealth you have belongs to all of us. It mearly says that "we the people" by being an American citizen have the right to be free of illness and disease as a birth right ... just as we have a right to vote: "life, liberty, and the pursuit of happiness" actually says the best health care the nation can provide. If the administration wants a data base of those who speak against helath care reform I say bravo! How else is the administration going to be able to help the uninformed understand the need of nearly 300 million Americans.

Why don't people wake up and smell the stink. If anything seems fishy to me is the direction our country is being led. I'm sure most people don't sign their name to a legal contract without reading it first. Are we suppose to just believe everything Obama says about the healthcare? How are we to pay for this plan without going bankrupt or having to pay more taxes? I don't agree with the plan nor do I care to pay for it. There are better solutions to the problem. Also I want to add that something drastically wrong is happening when our government is abusing our 1st amendment by wanting to censor our freedom of speech whether it be true or false. We have that right...do not let them take it away from us. Which amendment will be the next to go if we let them have their way.

Don't the senators know that with this many folks against the health care plan, if they vote yes on it it will be their last term in office. I'm catholic, pro life, believe in the second amendment,STRONGLY believe in the constitution and think Obama is trying to get rid of it. I guess that makes me a terrorist???

I am truly astounded by the paranoia. They're not collecting information on people. They're just finding out what some of the rumors are so they can respond to them. Ben, I can see that Obama has gotten the wool pulled over your eyes. He hasn't proven himself trustworthy enough to believe anything that comes out of his mouth. If it's paranoia, we certainly have good reason to be. As for myself, I call it great insight. It's so obvious I don't know why the whole country hasn't caught on to it yet. It feels to me as if he isn't working for the people of this country, but on his own agenda. Who knows what that may be...but it's certainly enough to scare me.

He lied. He has taken over Automobiles, Banks and soon, Health Care in an effort to bring this country to its knees. If we continue to allow our senators, our congressmen and our president to remain on this path, they will destroy our freedoms and tranquility. I can just imagine that millions of Americans will want to report this guy for spreading misinformation. I heard him myself.

Here is a guy that has close ties to Communists, Domestic Terrorists, Convicted felons. He has been involved in a payoff scheme to his wifes employer. Caused severe hard to the US economy by suing Citi Bank and forced every bank to make ARM lons to millions of dollars. Lived in a million dollar mansion in Chicago under questionable financing and was deeded property well under its true value. Hired ACORN to help stuff the ballot boxes with votes of people that don't exist. I'vre heard him myself speading lies and untruths about the socialist Healthcare Bill and he does not even have a birth certificte and may be an illegal alien.

Where in Macon Phillips blog did he request to "report anyone"? It said nothing about reporting people but did say the following and I quote:

"If you get an email or see something on the web about health insurance reform that seems fishy, send it to flag@whitehouse.gov."

Whose distorting the facts now?
