Republicans don't believe Sotomayor's stories

Republicans on the Senate Judiciary Committee are convinced that Supreme Court nominee Sonia Sotomayor has not been candid with them in under-oath testimony about her speeches and legal activism.  But given the assurance that majority Democrats will vote to confirm Sotomayor no matter what, the GOP effort against her is largely an attempt to convince other Republicans that Sotomayor has not earned a vote for confirmation. 

Republican aides worked through the night, Tuesday into Wednesday, studying the 108-page transcript from Tuesday's hearing.  They believe Sotomayor told a variety of stories, none of them entirely truthful, to explain her series of infamous "wise Latina" speeches.  And they question her efforts to distance herself from the work of the Puerto Rican Legal Defense and Education Fund, on whose board she served for twelve years in the 1980s and early 1990s.

For example, in response to questioning from Republican Sen. Lindsey Graham, Sotomayor denied involvement in PRLDEF litigation which argued that the denial of taxpayer-funded abortions amounted to a form of slavery.  One brief, in 1980, compared the withholding of taxpayer abortion funding to the Dred Scott decision, and another, in 1992, argued that for poor women, especially blacks, denying taxpayer-funded abortion violated "the right to privacy in matters of body and reproduction -- a right that was trammeled with state sanction during centuries of slavery."

Sotomayor testified that she "never reviewed" and "wasn't aware of what was said" in the abortion briefs.  Yet Sotomayor served on PRLDEF's litigation committee at the time, and a report last May in the New York Times, citing several former board members, said that, among the PRLDEF board, Sotomayor "stood out, frequently meeting with the legal staff to review the status of cases."  The paper reported that for Sotomayor's entire 12 years on the board, "she played an active role as the defense fund staked out aggressive stances on issues like police brutality, the death penalty and voting rights."

On capital punishment, in 1981 Sotomayor signed a PRLDEF memo opposing the reinstatement of the death penalty in New York State, arguing that "capital punishment is associated with evident racism in our society."  On Tuesday, when Graham asked whether she had "challenge[d] the death penalty as being inappropriate punishment, because of the effect it has on race," Sotomayor answered that she had "never litigated a death penalty case personally."

"Did you ever sign a memorandum saying that?" Graham asked.

"I signed the memorandum for the board to take under consideration, what position on behalf of the Latino community the fund should take on New York State reinstating the death penalty in the state," Sotomayor answered.  "It's hard to remember, because so much time has passed."

On the issue of Sotomayor's infamous 2001 "wise Latina" speech, Republicans are more skeptical now than before Sotomayor began her attempts to explain the remarks. In response to questions from Sen. Jeff Sessions, the ranking Republican on the committee, Sotomayor said that the "wise Latina" remark was "a rhetorical flourish that fell flat...It was bad, because it left the impression that I believed that life experiences commanded a result in a case, but that's clearly not what I do as a judge."

Republicans pointed out that Sotomayor gave versions of the "wise Latina" speech at least six times over the years.  "Fell flat?" asked one senior GOP aide.  "Well, it fell flat six times.  If you said this one time, and it fell flat and you stopped using it, that would be one thing, but when you've said it repeatedly over a ten-year stretch, it's very hard to believe that it is anything other than what it appears to be.  It's only fallen flat now that she's been called on it."

Democrats on the committee have not offered an extensive defense of the "wise Latina" remark, in part because they appear reluctant to acknowledge that Sotomayor actually said it.  Early in Tuesday's session, committee chairman Sen. Patrick Leahy substantially misquoted Sotomayor's speech when he said to her, "You said that, quote, you 'would hope that a wise Latina woman with the richness of her experiences would reach wise decisions…'"  In fact, Sotomayor said that, "I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life." [Emphasis added.]  If Sotomayor had said only what Leahy attributed to her, it is doubtful there would ever have been any controversy.

After the hearings adjourned for the day, Leahy was asked about the cleaned-up quote.  "I was doing it from memory," he explained.  "But I knew that she would -- she stated exactly what she said, and the statement is in the record."  Leahy added that he did not consider Sotomayor's precise words very important; her response, he said, was much more critical.

After a night of studying Sotomayor's testimony, Republicans will have more questions about what they view as her misrepresentation of her record. GOP senators know that Democrats are committed to confirming Sotomayor, and, with a 12-to-7 advantage in the committee and 60 votes in the full Senate, they don't need any Republican support to get it done.  But they are troubled by her answers, by her attempts to deny the clear meaning of her words from the past.  And that could result in growing, rather than diminishing, Republican opposition.  "We heard a lot of things that were not factually buttoned down," the senior GOP aide said.  "If that's because she and the White House think she has the votes and doesn't have to answer, then some Republicans are going to be troubled by that."

Well, truth is she will get the "nod" no matter what happens and no matter what she says or does not say.

Once on the bench, she will begin her left wing, liberal judicial activism in full force. You can take that to the bank.

I think this comes under the catagory of "Elections having Consequences", along with Cap & Tax and Obama-Care, destruction of the Nation as we know it, etc. Just the usual Democratic agenda.

I heard an interesting comment on Jay Severen's radio show yesterday. The list of supposedly conservative SCOTUS justices who turned out to be liberal on the bench is substantial. The list of supposedly liberal justices proclaiming moderateness and ruling conservatively on the bench is non-existent. So whatever you think of Sotomayor, move left two notches and you have a good guesstimate of her philosophy, IMHO.

Well, why should they? Obama hasn't been candid either. Oh, he sounded candid on the campaign trail, but I think it's quickly become apparent to everyone that he said what it took to get elected and never had any intention of following through on his more moderate rhetoric. The only place he's been moderate is in the war arena, but I believe that's because he has no choice.

The Alinsyites have bubbled to the top of the system. "by whatever means necessary." This is the beginning of the end if we don't wake up.

You don't use a "rhetorical flourish" "gone awry" five times in prepared speeches over the years.

She meant what she said. Now she's lying to cover it. And she's getting plenty of help.

Sotomayor is racist, much like the man who nominated her, President Obama. It is pretty clear to anyone who hears that speech that she has racial bias and prejudice which has clouded her judicial responsibilities.

I agree with critics who state if there was a white man who made similar comments (Don Imus comes to mind) would be shown the door immediately. This double-standard shows the hypocrisy inherent in this Administration.

If this committee had any decency left, they would not confirm her and would condemn her statements as racist and against the grain of American society.

Sotomayor just doesn't get the whole idea of becoming an American. She is still a "Latino" woman who is in the U.S. and got where she is by affirmative action. (Pushing a dumb minority to the head of the class because of race - not merit). She doubletalks her Latino BS as truth and justice. Go home and read Nancy Drew books. They are less fiction than your excuses for Latina racism against the typical white male.

The fact that this isn't going to stop her nomination doesn't mean the process doesn't have value. There's plenty of moderate democrats and independents who voted for Obama who won't be comfortable with some things about her either. A vote for Obama was not a vote for every position he takes or represents. It's important to take note of what he's doing and not just assume he's doing what we voted for.

Judge Sotomayor's case law decisions, as well as her public speeches indicate that she is an "activist" judge who considers the U.S.Constitution, Bill of Rights and Rule of Law as living, conditional documents subject to her own personal "ethnic" interpetation and jurisprudence.

If a moderate or conservative Supreme Court nominee would have espoused such rhetoric or comments, they would have been skewered by the Left and liberal MSM before ever reaching the senate comfirmation hearings.

I agree that people like Democrats define lies differently - probably someone lies in the case if it hurts your ambitions or cause...Another thing is that I have personally experienced people in an American University teaching that "mainstream" America is in fact oppressive, consequently for the radical leftists to lie to the mainstream people would probably mean to lie to the oppressors...they themselves, of course, are the oppressed...it is unbelievable, but it is true...this kind of thinking is almost religious for many people like Sonia (in fact I don't blame her for that)...Anglos don't always behave nice, too, but that's another matter.

Sotomayor is bad, no question about it. But it could be worse. She's an intellectual lightweight, unlikely to convince other justices to sign onto her opinions. She's in poor health: overweight, diabetic, with a drinking problem. It would have been much worse if Obama had nominated someone that was smart and in good health.

Sotomayor is more qualified to be a Supreme Court justice than most of those already on the Supreme Court. So what if she has an agenda and her own ideology - everybody does. Are you wingnuts telling me that the republicans don't have right-wing supreme court justices that are NOT biased? (See Alito & Roberts) Of course they do! We all know that republicans NEVER lie and they would NEVER abuse power... (see Bush & Cheney among MANY others) Give me a break! I can't wait for Sotomayor to be confirmed (and she will be).

Obama was born in Kenya. He's an illegitimate president. You libs know in your hearts this is why he hasn't released his real birth certificate. What other possible reason could there be? It will come out, though, and SCOTUS (which thought they successfully punted) will then have to deal with whether Sotomayor is a legitimate justice and whether any laws signed by "president" Obama are legit. We'll see if Sotomayor recuses herself when that day comes. I'm all for having a black president. He/she needs to meet the constitutional standards, though.

Leftist always say Roberts and Alito have "right-wing" agendas etc, but they NEVER provide an example of them actually failing to follow the written law in an actual ruling!!! They never have. ALL of their rulings have been well within the definitions of the written law. The libs always say things without backing them up. Meanwhile, we have a clearly racist/subversive judge that was blatantly biased in the Ricci firefighter case, and that is OK with them!!! The libs create things like abortion, sodomy, const rights for foreign terrorists, discrim against white males etc etc out of thin air, by contrast. Really, does the const really matter anymore after the liberals have trashed it so badly?!!

If ever there was an elegant scale model of what passes for intellectual rigor and honesty among folks like Sen Leahy, it is the sanitized misquotation he uttered and his tut-tut deflection of any criticism of this kind of dissembling. It takes me back to the level of "it depends on what the meaning of is is...." Both worthy of Foghorn Leghorn.

What should not be lost is that the act of sanitizing it is a very powerful admission that he knew it to be wrong, and not just wrong, indefensbile.

1st of all - rise above the name-calling. It is immature, and soils this discourse.
2nd of all - bias FOR our national principles is the mark of an individual who has respect for our national institutions, not a bias for their own personal positions regarding such principles.

This candidate stands for separating the national principles of law (upon which the Supreme Court is firmly founded) from her responsibility to uphold them. This position is NOT respectful to the letter of law, it is respectful to the letter of personal interpretation. She does not appply principles to legal proceedings with bias TOWARD the principles of law; rather she applies principles of law with bias TOWARD personal conviction and personal interpretation.

It's ABOUT TIME to distinguish the legal lamb in the skirt from the civil rights-peddling wolf she truly is.

Sotomayer sounds stupid when she talks. She is slow when she speaks and does not answer the question. She has trouble answering questions on her opinion. Who does not have an opinion and know what it is especially those in the field of law? Does anyone else see her as stupid? She also has an awful personality. How did she get this far. I guess that is where affirmative action works well for dumb and not so well adjusted people.

These hearings only prove that Obama is replacing one liberal without the intellectual firepower to make Justice Kennedy's lefty streak flare up with another unpersuasively reflexive Ivy League liberal. This is the best Republicans can ask for, considering how badly they handled the last two elections. She's just another number 4 in a bunch of upcoming 5-4 decisions. Bottom line: no impact whatsoever. The five Republican-appointed justices are the youngest and healthiest ones, so just grit your teeth and bear it for another 3 1/2 years.

If she claims to have this so called latin womans experiance..what is that. Because in the Latin the comminity the Mother is the most reverand person in that culture. She has no children. So what is that experiance she is refering to? I would like to know what her sexual preference is. I wonder if she is a lesbian. Or who is her boyfriend? We know everyhthing there is to know about Sarah Palin personal life, how come we know nothing about Sotomayer personal life?

I am disgusted by the double standard that the Dems and the press hand out. When the Dems blocked Alberto Gonzalez who was qualified, they where not accused of being racist. Yet they say that of any repub who questions her qualifications or her statements. She made these statements many times, even joked at the Duke speech something to the effect that I know this is being taped and should not be saying this. Why did the press dive into every little detail of Sarah Palins life and even report untruths taken off blogs as fact and yet not even scrutinize this woman at all. Of course the same could be said of their lack of objective reporting on Obama. Could you imagine the press coverage that Bush or Cheney would have got for some of the gaffes that Biden or Obama have spoken if spoken by them??? Puzzles me and yet worries me about the direction of the country. Do we really want a bigger government?

Back in 2000,when asked if he cared whether or not his candidacy might split the Dems. vote vs. GWB,Nadar replied that if the result brought country to ruin so much the better because then people would be willing to accept his proposed changes i.e. to be rebuilt in his image.Astonishing candor,but that kind of elitist mindset exemplifies the liberal view on the role of goverment in our lives.Nadar's Green Party being the "Prince Rupert" of the Democratic Party that they hide in the basement when company visits.Obama's team of Nerds on steroids seek to retool every branch ,including the Judiciary, as evident by Sotomayor's appointment .Kagan would have been worth a look ,but Obama was playing the ethnic card .
