Ken Klukowski: Foreign law shouldn't impact American gun-owners

Gun owners are increasingly concerned with the White House's citing of foreign law when it comes to gun rights. Look no further than the recent Senate confirmation of Professor Harold Koh to be State Department legal advisor in June. Koh, a committed transnationalist, is a passionate opponent of gun ownership.

Koh, recently the dean of Yale Law School, was confirmed as State Department Legal Advisor with 35 votes against him. He now becomes the top U.S. authority on international law, and the top advisor to the president and secretary of state about America's obligations and treaty commitments with the United Nations and other countries.

Harold Koh is also one of the most far-left legal advocates anywhere in this country, on issues ranging from affirmative action to same-sex marriage to the reach of the federal government into people's lives. While many on the Left believe that foreign law should be considered by American courts in interpreting the Constitution, as a true transnationalist, Koh believes that U.S. courts should directly cite foreign law to decide cases, and that foreign policy actions such as war-making are illegal without express U.N. approval.

There is no issue on which Koh is further from the mainstream, however, than the right to keep and bear arms. He openly advocates a global gun-control regime, run by the international community and based on foreign law, that would ban all handguns and subject all other firearms to draconian restrictions.

The Koh nomination is only one of three nominations thus far to push an extreme anti-gun agenda using foreign law.

Here's a little history: Senate Democrats' sustained opposition to John Bolton's nomination as U.S. ambassador to the U.N. originated from his service as the undersecretary of state for arms control early in the Bush administration. Some aggressively pushed at the time for an international treaty banning handguns and severely restricting all private firearm ownership worldwide.

Bolton spoke at the U.N., declaring that the United States would never join a treaty that violated the Second Amendment rights of American citizens. That treaty never died, however. Anti-gun forces at the U.N. continue to push for adoption of this global gun ban treaty and for the U.S. to join it.

That's why it's important that Obama's nominee as undersecretary of state for arms control is Rep. Ellen Tauscher (D-Calif.), who was also confirmed on June 25. Tauscher is a fierce opponent of gun rights who holds an "F" rating by the National Rifle Association. Tauscher is the Obama administration's point person on these pending gun ban treaties, advised by Koh.

The third nominee is Judge Sonia Sotomayor for the Supreme Court. In addition to Judge Sotomayor's support of using international law in U.S. courts, her longtime opposition to gun rights became a central issue in her confirmation battle.

Legal experts are all aware that Harold Koh is himself on the short list for the Supreme Court. Now that he holds this prestigious position, he could next be nominated for the D.C. Circuit federal appeals court.

After a year of service on the bench, then-Judge Koh, with his scholarly credentials, would be an ideal pick for President Obama to make the first Asian-American nominated to the High Court, where he would then be the most liberal justice in U.S. history.

Thus Harold Koh's nomination becomes part of a broader pattern, where adherents of foreign law and extreme gun control intersect both at the U.N. and the Supreme Court. Supporters of American sovereignty and the Second Amendment had better join forces quickly, because this part of President Obama's agenda is moving faster than many believed possible.

No surprise that the enemies of freedom go for the guns. Once they have them, we are all slaves to a corrupt tyranny.
I once read an article by a liberal lady writer whose name escapes me, but she hit the nail on the head when she said: "I find it strangely comforting, that on the opening day of deer season in Pennsylvania, there are more hunters with rifles in the woods than there are soldiers in the US army".

None of this is suprizing at all!
I know of no one in this country that does not know that the democrats are the party of treason...The constitution is clear..it is the supreme law of the land..and any politician who votes for this treaty is in violation of the constitution...How long will people let these bums in Washington continue to take away our rights?..They are out of control!...And in Michigan there are over 700,000 deer hunting licenses sold every year..and with the other states armed as well..let the government try to enforce the law and see what they get!

The simple fact is that a commited Marxist ("I think redistribution of wealth is a good thing." -- BHO to Joe the Plumber) has been elected President of the United States by an electorate largely consumed by Bush Derangement Syndrome. To the victor go the spoils. What remains to be seen is how much of the republic given to us by the founders remains at the end of Obama's first term, and how much of the American electorate realizes what they have done to us all.

Had the 'Little People' that still think they have protected rights in that 'Bill of Rights' not "acted stupidly" by opposing Sonia Sotomayor for Supreme Court Justice, and not been concerned when Michelle Obama said, "For the first time in my adult life I am proud of being an American" then maybe ... possibly ... Pres. Obama would have given us some 'Kool-Aid' for our guns.

If you have a democratic Senator or Representative you better start calling and expressing your opposition to all this progressive crap that's being shoved down our throats. The only thing they fear after being elected is not being re-elected and taken off the elite status they have given themselves at the taxpayers expense. I really believe that if they can be held at bay for 3 1/2 more years our traditional values will remain intact. A lot of the fools that put this traitor in our highest office are already waking up.

Foreign Law WILL Impact American Gun Owners,if Obama,who supports the UN gun ban treaty,and his liberal anti-gun cronies like Koh,Tauscher,Sotomayor,to name a few,get their way. The UN has been after our guns for years. I'm sure the NRA,and other pro-gun organizations,will talk about this again. Soon,and very aggressively i hope. Obama is assembling his anti-gun work force here. You don't have to be a rocket scientist to figure out what their up to. We,and our politicians in office who are against this,have to make their voices heard.

As I have posted on numerous other sites about this PLAGUE we call our elected officials. I will not surrender my arms. Ever. The only way they will be taken is by prying my cluthed fists apart. But not without leaving some with the same fate as I have suffered. For any that do not wish to have an all out Battle Royale, I strongly urge you contact your Congressmen/women and let it be known their career is over if they do not abide by the Constitution of this Country that they SWORE AN OATH TO UPHOLD AND PROTECT. Let it be known to them that We The People are sick and tired of the nonsensicle games that are being played with our Liberty, Freedom and Prosperity. This has got to stop. ANYONE, I repeat, ANYONE that has a problem with what is inherently granted to us AND is protected BY the Constitution of this United States need to look no further for an enemy.

The first step is registration. Resist this.
Canadians were assured that registration would stop gun crime and would never be used to seize firearms. Hundreds of thousands of firearms have been seized over the years. Just last week, someone at the RCMP decided that 870s with stock barrels under 18 inches were suddenly prohibited. Gun owners received letters to turn them in.
Do not fall for the registration trick.
The problem is that when gun stores close, the sales records revert to the BATFE.

Our Constitution CAN be changed, if the people want to, it has been before. Rather than go through the proper process of changing the Second amendment, which most likely would not pass, they resort to any tactic at hand in getting their way. It will backfire when we no longer have guns and the international society outlaws something of value to the anti-gunners.

I live in Seattle, Washington. Considering all this I asked people in government, State Rep., US Rep., and some in the National Guard but have not received an answer. It is this lack of an answer that really concerns me because the right answer would be OK. I regard a no answer as a wrong answer.

The question is: Where is the line separating when you would fight for the Constitution against an insurrection on one side, and on the other side when you would fight for the people against tyranny acting under color of law?

Remember the 2nd Amendment wasn't to protect us from bears, criminals, or get venison. Unfortunately, at some future time it may be that, just as happened in 1860 when people decided to go north or south, the people and the military will have to decide and protect us, and our Constitution. I dread that thought.

Futhermore, if we start shooting back, there would be a revolution in this country. Take our guns and we'll use pitchforks. Resist registration of firearms? We have it already. When I bought a rifle, there was a form I had to fill out, complete with name, address, and SS number, among other things. With this paper in hand, the clerk called some federal office for permission (!). Since I had resisted giving my SS #, the clerk turned to me and said, if you don't give them the number we can't sell you the rifle... Does anyone think when they want to confiscate that rifle they won't know just where to find it?

What people must remember is that the power does not lie with the Federal Government, not the president, congress or the Supreme Court. It lies with the People and the jurisdiction to enforce the Will of the People lies with the States. This is made very clear in the Constitution. Anything passed by the Federal Government the people can empower the States to strike down. Maybe it’s time We the People reminded the feds of this Constitutional fact.

To those who voted for Obama-His roots are truly African, If you wanted his kind of change you could move to Africa!! You could live under the religion of his ancestors!! Obama has said he is a GLOBAL citizen!! Is this the change he offers??
As for me I want to live in the America the WW1 and WW2 folks died for. Please notice their generation dying off has allowed the welfare crowd's votes to get Obama elected. America still can recover from the Obama atrocities but it will take, GOD (The God of America's Bible) Guts ( folks like the WW1 & WW2 vets) and Guns (guns like the law abiding citizens of our America have).
Freedom is not free neither will saving our America be free. It is our country, not Africas, not Mexicos, not Irans etc etc.
Our laws and legal system govern our America. These laws come from God and that is what makes America GREAT!!

I'm retired and work for a major sports emporium where I turned a hobby into a job. I have fun selling knives but have a hard time with people over the ammunition shortages that have prevailed since Obama was elected. You can buy all the guns you want but try getting what you need to shoot in them.
I have yet to see enough public squawk
about no ammunition. There's too much apathy and resignation. C'mon people!
This is your 2nd Amendment freedom at stake. The fact that the 2nd Amendment says nothing about ammunition is nonsense. The removal of the same from store shelves is infringement,period!
Everybody wonders where all the TARP money went. It would not be surprising that Eric Holder's using enough of it to with Obama,the U.N.,and George Soros' blessing,buy up all the ammo,primers,powder,etc. and warehouse it keeping the same out of public hands to accomplish Sneaky Pete disarmament of the American People. What do you say??

As a retired U.S. Army Military Policeman, and a former Deputy Sheriff in two NC counties, I took an oath of allegiance to defend the Constitution of the United States, against all enemies, foreign and domestic. I did not take an oath to follow temporary employees.. and that includes all of you yellow belly politicians!!! especially THE UN. When I joined the Army I took an oath to defend the Constitution of the United States, against all enemies, foreign and domestic.

Had I known what "The Chosen One" and his cohorts were going to try and do to our country I would of I would of spoken out much more vehemently against this guy and his worthless "New World Order" CRAPOLA.

This guy and all his Brown Shirts need to disappear from American and reappear in some Hugo Chavez run country.

Nothing to fear because a proper understanding of the Constitution is that the United States has no power to bind it's States in any way that would conflict with a State's powers that were NOT delegated to the United States!

One other thing. The right to bear arms was never restricted to the militia. Its intent was to permit citizens at that time to protect themselves, their families and homes against assailants, including a government that might turn on them.... where are we headed?
