Scrappleface: Sotomayor may sue SCOTUS for overturning New Haven ruling

President Obama's Supreme Court nominee, Judge Sonia Sotomayor, announced today she may sue her potential future colleagues for racial bias over yesterday's 5-4 ruling that overturned her own decision in the New Haven fire fighters discrimination lawsuit.

The Supreme Court ruled in Ricci v. DeStefano Monday that an employer could not throw out the results of a promotion exam simply for fear of a lawsuit from racial minorities who fared poorly on the test.

Sotomayor accused the high court's "Constitutional literalists" of bias and an "abject lack of wisdom" in tossing out the 2nd U.S. Circuit Court of Appeals' prior ruling in the case which she joined.

"In their majority ruling in Ricci, Justices Roberts, Alito, Kennedy, Scalia and Thomas failed to take into account the cultural forces exerted on a Latina appeals court judge," said Sotomayor. "Historical, entrenched institutional prejudice can cause a person, even a wise Latina, to make emotional decisions which, while consistent with the cultural norms of the aggrieved ethnic group, might not comport entirely with the specific language of the Constitution -- a document of questionable practical value due to the Anglo-Saxon cultural bias of its authors."

Sotomayor said she hopes the threat of a lawsuit will be enough to persuade the Supreme Court to reverse its ruling.

"The court's rejection of my opinion proves, ipso facto, the kind of bias that President Obama will eliminate by placing me on the court," she said. "The all-male, non-Latino court majority lacks the sympathy to set aside the cold rationality of the Constitution for the good of the people."

As happy as the decsion makes me; as pointedly humorous as this revealing satire is, I still feel dread because four justices could not see the truth. Are white people inevitably going to be pusished for being white? Are hard workers going to be denied so their efforts are either fruitless or "redistributed" to the shiftless, lazy and ignorant? I don't think we will see outrage until a few thousand white people at the major MSM institutions begin losing lawsuits (and their jobs) to the stupidity of Sotomayor's way of thinking.

Soto's application of 'Deeper Knowing' is clearly on display--which is racist code for 'I don't reach my thoughts through rational discussion and the application of logic but through emotions and the racial rubric of perceived inequality of outcome.' A Republican would not have survived this far into the process. A clear political barometer of the state of the nation. A storm is coming.

Discrimination is really a a two way street and its is time to put it behind us not use discrimination as a weapon for gaining an position that is not earned. When is "affirmative action" going to finally be a historical issue. I was one of a handful of conservative Federal employees at a northeast regional office. It had gotten to the point that promotion announcements had to include two positions. One was for the most qualified and then one other. The other was solely for the Director of the office to stave off another OEO complaint.

I didn't want to believe it, but now I have no choice. Sotomayor is racist and has a chip on her shoulder that can't be ignored. Just because I'm a feminist doesn't mean a man can't be more qualified than I am. Just because some whites studied hard DOESN'T mean that it's a biased test. Maybe it was a biased test, but the racial makeup of those who MERIT promotions isn't part of it. What happened to post-racial-ness?

Judge Sotomayor's statements lashing out at the Supreme Court should be cause for grave concern about her judicial approach to interpreting the Law, and also sheds a bright light into what her demeanor vis a vis her colleagues on the bench will be should she be confirmed. Is this the kind of tantrum we can expect of Justice Sotomayor every time she finds herself in the minority? Is this the kind of Justice we want on the Supreme Court with a lifelong tenure? Someone prone to make emotional decisions and who considers the Constitution "a document of questionable practical value?" Do the American people want a Justice that would "set aside(cold) rationality of the Constitution for the good of the people," as defined, of course, by herself?

Justice is to be blind, remember the blindfold? She has obviously given up the blindfold to don a miners light to focus directly on a specific group of people.. very sad, another bad day for the United States. Because thre was one other worker who had been with the company longer, the union required that he be promoted along with me. Great post. The fact that some apparently cannot see the parody proves just how close we've come to lunacy with Obama. The most absurd, ridiculous events are not beyond possibility. Prima facie and ipso facto ludicrous. I hope this will be the rope with which she finally hangs herself. Back in my highschool days our Latin teacher had a very simple rule regarding the frequently attempted "corner-cutting" on homework translations of such ancient authors as Caesar, Cicero, Virgil, Lucrete, etc.: As literal as possible (to preserve precise meaning), and as free as needed (to translate subtleties of tone and voice). Our two hundred and twenty year old Constitution is of exactly this nature. The SC majority are "literalists"? Well, yes, of course. That's their primary duty. A Constitution so malleable as to bend to the "cultural forces exerted on a Latina [lower court] judge" would not be worth the paper and ink to print it. This "wise and sensitive Latina", in my view, has no business sitting on any bench higher than small-claims court! She should be demoted, forthwith !

Does Soto want some Cheese with her Whine? How disgraceful is it that a justice of a state Supreme Court can not see the wisdom of the US Supreme Court and their interpretation of the Constitution. Her wanting to sue the Supremes is proof that she is truly a leftist and that she the BIG "O" share a desire to let the courts make policy and just not ensure that the law is good for all...not just those that are considered minorities.
