Glenn Harlan Reynolds: Nobody is applauding as Hollywood premieres Polanski defense

Roman Polanski anally raped a 13-year old girl. After plying her with Quaaludes and champagne wasn't enough to make her succumb to his charms, he ignored her protests and did what he wanted.

This was not a consensual affair, or a misunderstood romance. It was a wealthy, powerful man doing what he wanted to a powerless young girl.

Yet Polanski had -- and still has -- important defenders. Leading directors, including (amusingly enough) Woody Allen, but also such heavyweights as Martin Scorsese, David Lynch, Michael Mann, Mike Nichols and Neil Jordan, signed a petition in his defense.

Whoopi Goldberg, who has sometimes styled herself a "child advocate," opined that it may have been rape, but it wasn't rape-rape. Debra Winger commented that "the whole art world suffers" from prosecutions like Polanski's.

And film mogul Harvey Weinstein chimed in to argue that -- by going after a multidecade fugitive -- the government was the one "acting irresponsibly and criminally." Weinstein went on to opine that "Hollywood has the best moral compass, because it has compassion."

Compassion for rich and powerful auteurs, anyway. But it's easier to show compassion for them -- you might get something if you play your cards right.

Yet Hollywood's compassion is peculiarly narrow. They're still trying to decide whether to forgive Elia Kazan for naming communists in Hollywood more than a half-century ago. Anal rape of a 13-year-old girl merits compassion, but there are limits.

My daughter -- just past 13 herself -- comments that until pretty recently, actors and theater people were just a rung, or maybe a half-rung, above common criminals in the public estimation, and suggests that the Polanski scandal, and Hollywood's tone-deaf reaction to it, may go some distance toward returning things to the status quo ante. She may be right.

Though self-righteous moralism has been Hollywood bigwigs' stock-in-trade for decades, the evidence suggests that, overall, their moral position is nothing to brag about, and the Polanski affair may bring this home in a way that earlier scandals have not.

Indeed, the Hollywood response to the Polanski affair suggests that, in Hollywood's estimation, artists enjoy a sort of droit de seigneur by virtue of their talent, or at least their acclaim.

It's easy to see why an industry founded on the casting couch might feel that way, but it's surprising to see such alleged experts in communication state their position so bluntly. In the words of Humphrey Bogart in Casablanca, "It's poor salesmanship."

So will this blow over? Hollywood has faced scandals before, going all the way back to Fatty Arbuckle, and it has survived and even flourished. But those were the old days. Hollywood controlled the press's access to stars, and by doing so also controlled the press to a large degree.

And the press controlled people's means of communicating their views about Hollywood. That made it easy for them to float a story line -- like the "it was a long time ago, and besides, he's suffered enough" line being pitched for Polanski -- and have it control the public discussion.

Now, thanks to the alternative media, not so much.

The new Hollywood takes that love for granted, as narcissists generally do. Yet the audiences today have more alternatives than they had in Arbuckle's day, from video games (already outperforming motion pictures on a dollar basis) to the Internet, to movies they make themselves at home and post on YouTube.

Why hand your money to a bunch of obvious moral cretins, when there are so many better things to do with it? Technologically and market-wise, Hollywood is in the weakest position it's ever been, and yet it is also more arrogant than it was in its Golden Age.

Such circumstances seldom end well.

Some have seen the danger. Former screenwriter and director Roger Simon -- who worked with Woody Allen on "Scenes From A Mall" -- blogged:

"The mess is metastasizing and seems to be headed for something extremely dangerous for the entertainment industry [or part of it] -- the further alienation of the audience. These filmmakers are more than ever lost in their own narcissistic bubble, unaware that the public does not share their sympathy for Polanksi. (Even in France, according to a poll in Le Figaro, the public was 70 percent against him.)"

I think they're beginning to notice, but the damage is done. For decades, conservatives have been calling Hollywood soulless and amoral, but not one of those critics has done as much harm to Hollywood's image as Weinstein, et al., have done on their own. Congratulations, guys.

I think the only way to get the Hollywood crowd is through the pocketbook. I personally quit watching their trash years ago as it went futher and futher down hill as liberal's took over. An average person who places such phraise on Hollywood actors and do not know a thing about their beliefs or personal lives is just plain dumb.

The Polanski Defense is not a premier. It is merely a remake of The Clinton Defense starring basically the same cast of Clinton Defenders, Whoopi being most prominent. Those poor lambs on the Left that seem amazed that their mentors will excuse child rape missed the warm-up; the full spectrum excuse of more conventional rape or as the genius moralist Goldberb might call it, "rape-rape".

I don't think this is limited to Hollywood. The recent ACORN episode shows how much more prolific the problem is. And really, when you see the utter disregard by so many for the kids that will support the debt being piled on, you can see the evils of a common thread: sacrifice.

I am still in shock and disbelief over the excuses many in Hollywood are making for Polanski. It makes no sense whatsoever. However, it did dawn on me that some may be hoping to put this support of Polanski on their resume, in hopes he will employ them in his next film. This may be all they care about. Certainly not about a heinous crime perpetrated on a child.

It is undeniable that in any other town across America, save Hollywood, Polanski would have to register himself as a sex offender at the local police department. Glad I don't live there.

The Phryne defense only works if you really are that spectacular. Polanski has at best a one good movie i ten average. So, even by their own logic they fail.

Hollywood: its originality went the way of the dodo. How long has it been since Hollywood was able to produce an original screenplay that did not involve sex, murder or mayhem. They are so busy gazing at their own navels and congratulating themselves about how forward looking and progressive they are that they haven't noticed that their audiences are shrinking daily. Neither my wife nor I have found a decent movie to attend in the past four or five years. Yet we used to be attend weekly. Words, just words. I am sick and tired of hearing on the screen language worse than I used to hear on submarines and ships. I don't buy into the nervous twitters who try to shock laughter from the audience. Gone are the great comedians such as Red Skelton, who used humor not salaciousness to connect with his audience.

Great Article Glenn! How can anyone even try to rationalize RAPE of a 13 year old girl? This is not an 18 year old boyfriend caught with his 17 year year old girlfriend. It is not like he was hiding in a cave, he was in PARIS! Bring him back and Hang Him High. I am a pediatric RN, I have seen the results of other pedophiles. Possibly the creepiest thing I've noticed so far in this is seeing Natalie Portman's name on a Polanski support petition. It wasn't all that long ago that Natalie was a 13 yr old starting out in the movie industry--one hopes that if young Natalie had been brutalized by some despicable Polanski wannabe during that time, the response from the "beautiful people" would have been less loathsome than she and her associates have produced in this case.

I heard this "But Polanski is a genius artist!" defense before from a young athlete who defended OJ Simpson with "Give him a break: he's a Hall-of-Famer!" as if touchdowns allow for murder.

But Polanski's defense is even weaker: his movies are mediocre and quite forgettable. Time will erase his memory.

I just want the right to forget him by way of him being in prison.

There are bad people on both sides of the aisle. People that defend pedophiles should be called out loudly by everyone, and for the most part they have been. There are always the loons that will defend anyone but they don't represent the entire Republican or Democratic parties.

So what if Polanski returns and answers to the Law? It got me thinking... Does he admit to the sex with a minor, but deny everything else? Would it go to court, and what would his defense be? Is there physical evidence? Is the statement from the victim enough? Do the Duke & Hofstra cases impact judgment? Would he claim additional misconduct ala the repressed memory syndrome that was once all the rage? He's no doubt guilty as hell, just as the opening sentence declares. Is that because it fits the narrative? How do you think this case will unfold?

OK, I went out and did my own research. Arbuckle was an extremely bad example for Reynolds to use in this article. That he's throwing Roscoe Arbuckle's name into this scandal with Polanski is, from what I have found, wrong and smears him, once again, without cause. His career was destroyed in just this way. He was cleared by a jury with an unprecedented apology, and died before he could recover at 46. It's not right and Glenn should apologize for the reference. Or retract his statement... Somebody here must know the proper thing to do in such cases... Glenn?

Arbuckle fans: My point was that Hollywood, at the peak of its power, threw Arbuckle under the bus, while now, when it's much weaker, it's rallying around Polanski. I've heard the arguments for Arbuckle's innocence before, but while they may be true the point is that Hollywood didn't even try to buck the scandal.

I'm not an Arbuckle fan, I have never even seen any of his movies. However, I do know from reading about the scandal that he was railroaded. The judge, when he was found innocent, made a speech in court about how Arbuckle was owed an apology for a sad miscarriage of justice. He was kept out of the movie business by William Hayes, a precursor of Jack Valenti, yet another stupid toady doing Hollywood's dirty work. There are not arguments for Arbuckle's innocence there are facts. I would think that a lawyer/law professor like Reynolds would look for facts instead of arguments.

This will get some "anti-semite" maniacs' knickers in a knot, but Hollywood and AIPAC have had a longstanding relationship with Simon Wiesenthal, the guy that's been chasing old German men and bank accounts around the world for DECADES. Is the HEINOUS crime of violating a 13 year old child in America in 1977 as hideous as the violation of a young Jewish girl in 1943? Is the American child not as important? That's all I'll say, but you get the point, right? Make the rest of the connection for yourself. Judicial and procecutorial misconduct = judge allows rapist to travel overseas, then goes back on plea deal after meeting with prosecutor without notifying defense counsel. Proscutor
brags about it on camera.
Double jeopordy = wanting to put away criminal for same crime twice.

Victim doesn't want prosecution and wants to move on with her own life.

Anyone who defends Polanski's statutory rape of a 13 year old girl is a stupid dirt-bag. Let's be clear about this. It is a defining issue that tells you everything you want to know about that person. Mr. Polanski is a pervert that makes no justification possible. The Hollywood elite feel he is one of them and should get the standard "Hollywood punishment" of community service, ussually forgotten as soon as the possible. I think we should get the list of "child rape supporters" and do them like country music did to the "Dixie Chicks" they get nothing from us, do not attend any of there movies (as if they were worth viewing), attend none of their event or speeches. Let them rot with Mr. Polanski.
