James Jay Carafano: Immigration reform kept behind closed doors, under wraps

Call it an after-action review. The Bush administration’s attempt to craft a “comprehensive” immigration reform bill had crashed and burned. As the legislative rubble still smoked, a high government official met with conservative groups that had balked at the White House proposal to grant amnesty to illegals.

He began his remarks with one word. “Ouch.” He went on to concede that the administration had made several mistakes fatal to the bill:
» They had tried to ram it through without open debate.

» They had ignored or pooh-poohed legitimate concerns over how the proposal might affect other policy goals, from sovereignty to security.

» Their approach was flat wrong.

The good news? They had learned a lesson. Excluding all sides in making public policy didn’t make for good policies.
Now, as the Obama administration readies its own amnesty efforts, it appears that this White House has been learning lessons too. Unfortunately, they are all the wrong ones.

As a result, Obama’s immigration agenda is bound to lead to bitter partisan squabbling and, ultimately, failure. It will further poison serious, honest reforms that could reduce the unlawful population (and, hence, uphold the rule of law), get employers the workers they need to help grow the economy and make our borders secure. All because of the secret plan.

In deciding how to approach immigration, Obama’s White House has ignored the Bush debacle of 2007. In fact, it is writing a bill that is even worse.

The Obama bill will grant blanket amnesty to millions and do little to address fraud and abuse in qualifying for U.S. citizenship. Moreover, it won’t include the kind of meaningful temporary worker programs that would provide a real alternative to an illegal work force.

A bill like that is a tough sell. But rather than draw marketing lessons from the experience of his predecessor, Obama is basing his sales plan on the blowback his administration got when it let Congress try to write health reform legislation this spring.

Lawmakers backing the “more government” approach to reform were rocked by withering criticism from their constituents. In town hall meetings from one end of the country to the other, angry citizens pressed their representatives to explain why they would support tremendously expensive reforms that would prompt employers to drop existing coverage for millions, leaving them with no option but enrollment in a one-size-fits-all government-run plan.

After witnessing the firestorm over health reform, Obama apparently has decided never to go down that “let Congress lead” route again.
Enter the new road map for immigration reform. Rather than have congressional committees hold hearings and draft legislation, the administration is drafting the proposal itself. In secret. One key author, a former Ted Kennedy staffer who helped draft the failed ’07 bill, is now a policymaker at the Department of Homeland Security.

The draft is sequestered in an undisclosed location that happens to be the office of Sen. Chuck Schumer, D-N.Y.

Its hundreds of pages of complicated legislative language completely rewrite our immigration law. Yet most members of Congress won’t get a peek at the mammoth bill until Schumer dumps it, en masse, on the floor.

The second part of the secret plan is to hold off introducing the bill until next year. If Schumer were to bring out his bill this fall, members would have to talk about it when they went back to their districts during the winter recess. That would not be fun. Odds are they’d be pilloried by constituents unhappy with plans to gut immigration enforcement and hand out citizenship like candy.

And if “Obamacare” becomes law, then voters would also have something to say about the president’s pledge not give to health care benefits to those in the country illegally. Amnesty will make all the illegals legal. The president won’t have violated his pledge, but he will sock taxpayers with billions in new bills to pay for the health care of an additional 12 million or so.

But if Schumer keeps the bill up his sleeve, then there’s no outrage, no problem. Lawmakers won’t have their holidays ruined by citizens asking uncomfortable questions.

So the plan is simply to keep the bill secret till Congress comes back in January.

It’s a bad plan, Mr. President. Americans deserve better. Publish now or let the bill perish.

I absolutely agree with Carlos. "let the bill perish." The only thing that need to perish is the current immigration legislature, that allows for hard working people to endure abuse and injustice. For far too long the immigrant populace has stayed in the shadows. I say no more, the time for immigration reform is now. One more failure; and i would not like to see what 12 million angry people would look like. We are not the minority.

No matter what, the right wing extremist will never accept a real immigration reform legislation. They prefer the status quo, which is a blank amnesty. In their ideal world Joe Arpaio would be the President,Rush Limbaugh would be the Secretary of Defense, and Lou Dobbs Secretary of Homeland Security. What a wonderful world !!!

Whatever happened to equality? When the government refuses to equally enforce the law it establishes Un-Equality as the rule of law. Making some people subject to the law and others not subject to the law sets those protected from prosecution ABOVE the law! In this case non-citizens are set ABOVE the law that Citizens must obey, remember we are now prosecuting businesses that hire illegal aliens, not the illegal aliens thereby establishing the loss of EQUALITY for Citizens. EQUAL PROTECTION OF THE LAW REQUIRES EQUAL PROSECUTION OF THE LAW God created people EQUAL, only man makes some pigs more equal than others!
We have been a nation dependent on the equal enforcement of our laws, why make non-citizens above the law and destroy Equal Rights?

I cant believe the comments here,the utter disregard for millions of Americans unemployed and under employed there is six people looking for every one job.As we know due to the millions of illegals there is no way to check them in background checks,The toll on the communitys to provide cheap labor is devastating from coast to coast.

Why should rewarding foreign lawbreakers be the way to go? So, should we also reward American lawbreakers? If we let in more LEGAL immigrants to replace all of the illegal aliens in our workforce, then these LEGAL immigrants would be paying taxes and their fair share of health care costs.

Why would a President or a member of Congress who supposedly loves this country, want to give amnesty to those who've disregarded its laws? No illegal now in this country deserves amnesty. They need to go home. We have 13 programs for "guest" workers (meaning they go home eventually), we have well over a million LEGAL aliens coming in each year as well as a myriad of other workers that can come in on the many alphabet programs. We don't need illegal aliens. Send they home. Eisenhower had the courage in the early 50s to do it then. Guess no President since had the courage or the will to stop the invasion or send lawbreakers home. Our government is filled with traitors who want to turn this once-proud nation into a third world country.

The rationale among free traders in favor of unlimited immigration is that these desperate people work for less and don't require benefits.

Once they are given citizenship or its equivalent, and once the courts have ruled that they are entitled to benefits in any event, that ratiionale disappears.

I read the constitution and citizenship is only to be granted to Law-abiding residents' children. Enforce our own laws and make the illegals go back. I am excited about the precedent that legalizing millions of people will set for people like me. If the law is circumvented for those who just want or "need" something for a better life, I will be able to take anything I want from you stupid liberals. As I live in Arizona, I see the results of illegal immigration on a daily basis and unfortunately pay for it with my ever rising taxes.

If they once again try to cram this so called immigration reform down our throats again .... this time it will be a disaster for them. Many of us are ready to take to the streets and protest in a manner that will make the tea parties look like a boy scout parade. In addition, we will donate to who ever has the "stones" to fight with us against this amnesty.

These illegals need to be rounded up and immediately deported back to their country of origin, no questions asked.

It's about time the politicians we send to washington start to listen to the people who sent them there, they can be "fired" just as quickly as they were "hired" or elected.

Divisive issue to say the least. Our law may say one thing, but our action says something different. If here illegally then there should be no benefits of any kind. No jobs, no school, no healthcare, no anything. Some people believe illegals are treated better than citizens. Thus the great divide. Takes real commitment and dedication to solve. Seriously, the illegals in this country will never be turned away from hospitals. Our moral standards, even in this day and time, won't allow us to do this. What needs to be decided is whether they should stay permanently, temporarily or be exported. For me, I'd like to see a program, like the old Bracero program where people can register to work here, pay taxes, cross the border freely, and received whatever medical treatment needed. That way we control temporary workers and kick out illegals with heavy fines to those employing them.

Like the latino gangs, composed of an undisclosed number of illegals, I'm not intimidated by threats of those ex-acornites responding to this article, either. Bring it on.

We are told "This is a nation of laws." so we must again look at our interrogators - digging for some reason to charge someone with some crime. However, when it comes to people committing multiple crimes to enter and remain in our country, we must take care of them, make them legal, provide them with health care, etc. No jail time, don't send them home, etc. How about keeping those jobs for citizens and legal visitors. Fix our immigration eligibility and numbers, don't give special status to people who pick and choose which laws, if any, they want to obey.

Didn't the president promise openness and transparency when he campaigned? We Chicagoans recognize the machine-management that's been transplanted to Washington. My way or the highway.

Someone wrote to a congressman in Iowa requesting their citizenship be revoked - so they could become eligible for all the benefits illegal immigrants receive without being required to pay taxes.

How about immigration reform that rewards those willing to obey the law (i.e. people waiting in lines) and punishes lawbreakers? If we don't have rule of law, and equal treatment (meaning no race is exempt from our laws) we might as well go straight to Soviet Russia's oligarchy. Or are we already there (since our politicians exempt themselves from most of what they pass, including the socialized healthcare bill currently underway)?

It is about time we return the illegals to their country of origin. My parents came here through the legal mechanism of immigration. Why do we not demand the same from the illegals? Although we respect there desire for a better life there are many others who wait their turn. Now that the unemployment rates are at the highest, especially in California, all immigration should be stopped until we again have resonible unemployment rates. We cannot afford to keep providing services at taxpayers expense to people who have broken the law. California has a large portion it's land turned to a dust bowl to protect the delta smelt. Farm workers are not needed there since the farms are all going bankrupt. All the illegals should be shipped home. A labor loan program could be set up to provide workers during harvest if needed.

If one is not willing to become a citizen and CHOOSE to obey its laws, that person is welcome to "go home." There, you can abide by the laws of your homeland. No problem; just abide by by the law. We should let Congressmen know that this is meant to be an open government. This means no secret meeting, especially on matters of national and critical interest. This problem has been brewing for years and never gets fully resolved. I don't care who or what you are, democrat, republican, or libertarian; you can stick amnesty where the sun don't shine if its for criminals who committed a criminal act to get here, and continue criminal behavior staying here.

Fix the dang system so those who wait in line and fill out the forms; and then agree to follow laws, like federal with holding, social security, unemployment compensation, state disability, vehicle registration, insurance, smog, and safety etc. can get in and integrate into our country and system, learn to use our language, and become real Americans, not hyphenated Americans.

This is for kjohnson. It is pretty obvious that English must be your second language so I will keep my comment simple. First of all, it's the NRA, not N.R.A. Second point, there are probably a lot more than 40,000 NRA members that would be more than willing to defend this country against terrorism. Would you? My guess is probably not. I fought for my country once, and I would be glad to do so again.
And for sd619 I have this to say. 12 million people, angry or otherwise, is still a very, very small minority. Do you have your green card?
My first ancestors would be deemed "illegal" by today's standards seeing as how they came to this great country aboard the Mayflower! But the ones that came later, all went through Ellis Island and did it legally. So, I have no tolerance, none what-so-ever, for any kind of amnesty for illegals. Or for that matter, anyone who supports ANY kind of amnesty program...period!

Amnesty without tough conditions is not an option. Realizing the complications of returning 10 to 12 million illegals is a huge task, so a workable, realistic amnesty program seems to be the best solution with the return of those that do not qualify. But all of this will be a waste of time if the government continues to ignore the laws that are already on the books regarding the illegals.

A a candidate for the House of Representatives, I believe most of our problems can be traced to a failure on the part of representatives to honor their oath to follow the Constitution. There have beed several past presidents, including both Truman and Eisenhower who followed the law and deported illegals during their terms in office. What is the law if it is not enforced. We are a nation of laws. Equal protection under the law means what it says. The only reason any office-holder can justify amnesty for illegal aliens is that they will stack the deck in future elections by buying a whole lot of votes with this issue. It is vote-buying in the worst possible sense. Nothing more. Nd this, at the expense of taxpayers who are out of work and needing employment.

I agree with James, immigration should be done legally - that's what we made the laws for. It is not just the hispanic that are involved here, what about the arabs, etc. This is to help keep our country safe. Besides, why do these things have to be done behind closed doors. Congress should know what they are voting on. Give them time to read the legislation - keep things out in the open. That's what Obama promised. He knows what the majority of the people want, but it's not the same as his, so he keeps it secret and tries pushing legislation through without anyone knowing what's going on.

We live with the crime, overcrowded school, emergency rooms full, litter dropped everywhere, criminals arriving daily and their refusal to speak English, as well as their refusal to assimilate as legal immegrants do. Round up ALL the illigal invadors and their BRATS, whether or not they were born here, and return them to thier country of origin. An argument for amnesty is that we need workers for agricultural jobs and other jobs that "Americans won't do". There are from 12-20 million illegals in the country and we still don't have workers for agricultural jobs. Why? Because they have taken jobs in construction and other trades that pay better and can be paid under the table, putting American citizens that want to do those jobs out of work and on unemployment or welfare, and increasing the tax burden for our taxpayers. Amnesty is simply a reward for damaging our economy and the livelihood of our citizens. Employers of these people should be jailed and the workers deported. If they want to be here, they should work for the right legally.

The left states that illegals pay taxes into SS etc..How does one get a SSN, and if it is bogus, who actually gets the "benefits"? If illegal retires and draws SS, what happens to the true owner of the SSN? When amnesty is raised, Latinos are the first thought in many citizens minds, however, as an Operating Room RN, undocumented "health care patients" are not all from south of the border. Amnesty would cover all "feet dry" people looking to enjoy USA benefits without pledging loyalty to our flag and core beliefs.

Amnesty would only encourage more illegals to come and would only make the problem worse. Ergo, no amnesty. For the health of the U.S. all illegals must in an orderly way be sent back to their own country. Then revise the immigration laws to only allow immigrants whose qualifications will help the U.S. and who swear to learn English and assimulate into citizenship. Then enforce the new laws. Yes, it will cost money, but not as much as it is already costing and we'll have good Americans instead of _______-Americans. A well administered immigrant work program could be used to get work done which Americans choose not to do.

Of the President's many pre-election promises he's failed to uphold, few rise to the level of disappointment as his promise of transparency. Everything seems to be an "emergency" that requires the Congress to vote on bills THEY have not had an opportunity to read, much less the public! This Administration's blatant arrogance has no precedent in recorded history - unless you consider dictatorships. I was taught to respect the office of the President of the United States - but the man currently occupying that office seems hell bent on destroying our country. The Constitution seems to bear no relevance to this administration. While the office deserves our respect, the current occupant does not. I am dismayed that so many of my fellow countrymen, most of whom are sincerely well meaning, fail to see this man for who he really is and what his agenda is. I'm afraid the lunatics are in charge of the asylum. God help us!
