Congressional leaders fight against posting bills online

As Congress lurches closer to a decision on an enormous overhaul of the American health care system, pressure is mounting on legislative leaders to make the final bill available online for citizens to read before a vote.

Lawmakers were given just hours to examine the $789 billion stimulus plan, sweeping climate-change legislation and a $700 billion bailout package before final votes.

While most Americans normally ignore parliamentary detail, with health care looming, voters are suddenly paying attention. The Senate is expected to vote on a health bill in the weeks to come, representing months of work and stretching to hundreds of pages. And as of now, there is no assurance that members of the public, or even the senators themselves, will be given the chance to read the legislation before a vote.

"The American people are now suspicious of not only the lawmakers, but the process they hide behind to do their work," said Michael Franc, president of government relations for the Heritage Foundation, a conservative think tank.

At town hall meetings across the country this past summer, the main topic was health care, but there was a strong undercurrent of anger over the way Congress rushed through passage of the stimulus, global warming and bank bailout bills without seeming to understand the consequences. The stimulus bill, for example, was 1,100 pages long and made available to Congress and the public just 13 hours before lawmakers voted on it. The bill has failed to provide the promised help to the job market, and there was outrage when it was discovered that the legislation included an amendment allowing American International Group, a bailout recipient, to give out millions in employee bonuses.

"If someone had a chance to look at the bill, they would have found that out," said Lisa Rosenberg, who lobbies Congress on behalf of the Sunlight Foundation to bring more transparency to government.

The foundation has begun an effort to get Congress to post bills online, for all to see, 72 hours before lawmakers vote on them.

"It would give the public a chance to really digest and understand what is in the bill," Rosenberg said, "and communicate whether that is a good or a bad thing while there is still time to fix it."

»  USA Patriot domestic surveillance bill, passed Oct. 23, 2001. Unavailable to the public before debate.

 

A similar effort is under way in Congress. Reps. Brian Baird, D-Wash., and Greg Walden, R-Ore., are circulating a petition among House lawmakers that would force a vote on the 72-hour rule.

Nearly every Republican has signed on, but the Democratic leadership is unwilling to cede control over when bills are brought to the floor for votes and are discouraging their rank and file from signing the petition. Senate Democrats voted down a similar measure last week for the health care bill.

The reluctance to implement a three-day rule is not unique to the Democrats.

The Republican majority rushed through the controversial Patriot Act in the wake of the Sept. 11, 2001, terrorist attacks as well as a massive Medicare prescription drug bill in 2003 that added hundreds of billions of dollars to the deficit.

For the majority party, legislative timing plays a big role in whether a bill will pass because support can be fleeting.

"The leaders use it as a tool to get votes or to keep amendments off a bill," said one top Senate Democratic aide.

But Baird warned of public backlash.

"Democrats know politically it's difficult to defend not doing this," he said. "The public gets this. They say we entrust you with the profound responsibility of making decisions that affect our lives, and we expect you to exercise due diligence in carrying out that responsibility."

Post any bill - particularly this one? 1st, they would have to be familiar with it to answer searing complaints about it. Unposted, they can make it up as they go along.
2nd, they would have to put concrete language in it. None of the B* that allows for them to "interpret" and act in a completely different manner than they have explained or claimed earlier. Some of what is in these bills are "concepts" = allowing regulators to develop parts of the plans later. Sounds dangerous...
But before we get to any vote - why are we even discussing a national health bill? Who the hel* gave Congress and liberal democrats the right and authority to legislate our health and insurance options??????

When government can act as responsible as doctors do, it will still be too soon for them to decide the quality and type of care I should receive. Congress your yes vote for the Question or the bill or any other sneaky parliamentary method of hiding the true intent of your vote will allow you to start drawing unemployment pay in 2011. Sooner, in states with recall privileges. That is the next bill I want to see pass, and it has to pass in the various legislatures, and then by ratified in the U.S> Congress. VOte against the wishes of your constituents and lose your job.

If our so-called Representatives and Senators do not have the time to read a bill prior to voting on it, they should ALL vote against it and not pass it. If they do post it for review by the public, then they should hold town hall meetings to discuss this.

However, the Government bureaucracy should keep its hands off of health care and discontinue its present involvement. The reason that their is a "health care crisis" in the USA is due to what the government has implemented in the pass with the insurance companies, hospitals, doctors, lawyers, the patients, etc to comply.

To quote Ronald Reagan, "The most frightening words one can hear are, 'Hi, I'm from the government and I am here to help you.'"

It stands to reason that those who want the healthscare bill passed will oppose the 72 hour rule, but just WAIT until there's something they want to suppress. They'll resurrect the 72 hour rule in a heartbeat.

Just a 72-hour rule isn't enough. What we should have is an online version control system that shows bills from the time they originate and lets one track the changes, who made changes, and easily compare versions, so it's harder to sneak modifications through.

There is a MAJOR ERROR with this story..

The House energy and global warming bill, passed June 26, 2009 was NOT available online 15 hours before vote. It was 900 pages and then 300 pages were added at 3am in the morning.. The extra 300 pages was not online... The bill was not even printed for the representatives to read... It was passed with NO reading.

This is reprehensible. AS a teacher I taught that our republic had taxation by representation. This has gone by the wayside. Now our esteemed representatives are only doing what will
further their purposes. To hell with the people. I guess we're here just to pay their salaries. I couldn't believe that they allowed their raises to stay as usual but cut out social security cost-of-living for at least next year.
I am 80 years old and happy with my Medicare Advantage. It cost me $4000 a year on Medicare and AARP, Now with much better care I've paid $200 so far this year.
I think if they do not post the bill we should vote everyone who voted for the bill.

They work for us, and I think it is time to get tough with some out of control and disrespectful employees. The town hall meetings were they events where we tried to "sit them down" and explain where they were going wrong. It didn't work, and soon senior citizen lost their cool and were screaming at them. The polls show that a large majority of Americans oppose their "health care reform," but they keep going anyway. Americans don't like having things rammed down their throats. What is it going to take to get their attention? They are putting a peace-loving people in a very bad position. Wake up, and smell the anger before it is too late!

I have to admit I really did think there would be a new era of transparency with this administration. In contrast, it may be the least transparent yet most intrusive government we have ever witnissed in this country. I also agree with uncledan, where is the outrage from the left? This is merely additional proof that our so-called elected representatives are only in it for themselves.

Any rep that votes to NOT post the bills in final form prior to the floor vote needs to be impeached, recalled, or whatever the state allows. This should be immediately followed by a criminal trial for fraud, followed by a lengthy jail term.

I am also tired of unknowledgeable voters in general. Voters should pass a test before voting. They can even take a cheat sheet in with them. I just want to see that they have read over the facts at least once.

If Health Care Reform is so URGENT, then why, if the bill is passed, does it not go into effect until 2013, AFTER the next presidential election.

If the Bill is so good for the economy and will create so many jobs, then why does it not go into effect until 2013?

If the Health Care Reform bill does not go into effect until 2013, then why the rush to pass it now?

And, if the Health Care Reform bill does not go into effect until 2013, then what is the problem with allowing an extra 7 days for each proposed bill from both House and Senate to be posted online so everyone can read it... BEFORE it is voted on?

What do they want to hide that they do not want people to see it before it is passed?

What effects of the plan do they not want us to see until after the next presidential election?

Let's us Medi-cal as an example. Do you know if you qualify for Medi-Cal, it takes approx 1 to 1 and 1/2 years before you can use it? That is only if you have an immediate health care issue. Another words, you will DIE before you can use it.
Will someone please tell me of a government run program that actually works? And I mean for the people intended not for the government. And, of course, without graft, cheating and illegals qualifing when Americans can't.

If there really IS a bill, it should be posted and read before voting. I get the feeling there there really ISN'T a bill; just a blank check for the government to have its way with healthcare.

Yeah, there's tons of paper floating around laden with legal boilerplate; but what is there once that's been dispensed with? Are they simply going to make up the healthcare rules as they go? Does the bill actually commit to a concrete approach to healthcare? Will it tomorrow? Will it when it's voted into law?

This country can't afford any more trillion dollar fiascos. Time to bring the Congressional shell game to an end.

Because the working American citizen can read 1100 pages of law (in lawyer gibberish) and give appropriate feedback to their respective legislatures. I think that the folks in Washington forget that they represent the people and should give people the opportunity for feedback.

That would give the public a chance to really read it, comment on it, and communicate with their legislators. Perhaps a coalition that falls apart during that time should never have existed in the first instance. Now, I know you're going to say it's impossible, but it isn't. I'm running against a 6 term incumbent in my county legislature. I'm mounting an effective campaign because I bought a book. Right, a book called, "RUNNING, How To Design And Execute A Winning Political Campaign." It's amazing. So, I'll start with the county, then the state Assembly, and finally Congress. You can too. Apparently, not only does Pelosi not want anyone to read the bill, but she is also not too eager to comment on it herself, I called her office several times and each time, as soon as I mentioned the bill I was switched by her staffer, to the automated recorded comment line. I am pretty sure that the line is not recorded, as I have commented there many times in the past and so far I have recieved 0% reponse from her office on anything. So much for a Representative that actually represents the people. As another commenter once said about his rep, "they represent DC to me, but they do not represent me to DC. Pelosi seems to be the epitome of that statement.

The contemplated rule requires a MINIMUM of 72 hours. The leadership can set the vote or the debate whenever they like, following the expiration of the embargo period. To say they're against posting the bill because they need to control the timing of consideration is a red herring. They can pull all the shenanigans they want; they just have to wait 72 hours to do it.

A simple common sense approach to the matter of proposed bills and the posting period for public disclosure should be:
>>Require bill writers to write bills that can be understood vs. the complex and confusing language most bills contain and certainly one as complex and far reaching as the Health Care bill;
>>A true minimum for public disclosure and posting should be one full week - 7 days. This should be the standard rule for all proposed legislation/bills.
>>> 72 hours is woefully inadequate but I guess it is better than what the Democratic leadership wants which is no time for adequate public disclosure because they do not want the hidden details to be disclosed. If they are allowed to get away with this, they should be voted out of office at the least. Let your congressional representatives know how you feel about this issue - do not be silent on this issue. Let them hear from you!

I'm not saying I am against this, however, these officials are elected because the voters believe they will be making decisions that they are in favor of. So by posting bills online, you are creating a difficult environment for things to get done. A bombardment of emails for and against a bill will pile high, but thats only the people who read it, not necessarily everyone who voted for that official.

If you want you're voice to count vote for someone you think will make the decisions you agree with. Or I guess we can throw our political system out and just have every individual vote for a individual bill....

The biggest problem with showing their hand is that there may be some bogus cards in there! Stuff crammed into this bill that they don't want us to see. I understand why they wouldn't want us to view this bill or any other. Think of how much they will have to make sure that there isn't something in there that would make them lose the confidence of the voters, and thus lose in the next election. More than that, I think most of these guys we the people have elected don't represent us at all anymore, and they don't want that exposed as well. Maybe you should consider presenting your arguments from a more neutral political stance. When you call your democratic congressman, and Demand "vote for Transparency, or I will vote you and your Liberal faschist democrats out of office", it's easy for him/her to ignore you, because no matter how much he/she votes with your side, you're still going to do your best to vote him/her out of office when the next election comes around.
If you present an arguement like "I really think you're doing a pretty good job, but the issue of Transparency in Government really concerns me as an active, politically intelligent independent voter. If you were to support transparency in government, it would go a long way toward winning my vote in 2012"
Now the representative really needs to consider your position, because you are a vote that he can win/lose, based on this decision.
Plus, it hides some of your Hatred, which is good for everyone...

The American voters can see to it that the proposal to post bills on the internet before a vote happens. We can hound every elected official every time they appear in public until this is done.

72 hours is not enough time though. I think the amount of time should be in relation to the length of the bill. No one can read and understand an 1100 page bill in 3 days.

Maybe it should be 1 day per page?

In what alternative universe is the Democratic leadership residing? Every step they take is in direct defiance of the minimum standards of proper conduct for public servants.

I am utterly aghast at the malignancy of the current administration in the US of A. I shudder to think of the damage they can do between now and January 2011. The November 2010 elections are too far out - the current malignancy needs to be excised much earlier than that. Rangel, Waters, Murtha, Frank - all need to be in jail - drag Kennedy's corpse into jail for good measure. Reid and Pelosi need to be ridden out on a rail. Obama needs to be awarded the Montezuma prize for bringing about collapse of an entire nation.

Hey it is very simple, none of them have read these bills so why should the American people get the chance to read them ?? This is the TRANSPARENCY that Obama promised and it is yet anothe rbroken promise with many more in store. Even if we are allowed to read these bills they are filled with references to a whole library of other legislation that would become an endless search for the information and this proves to me anyway that these politicos have ZERO idea what they are voting on in the end.

Post your bills online *before* you sign them into law, you'll have every fact checker on the net making sure you're doing things right ... good for the public at large, but its gonna be one hell of a worthwhile hassle for the Congressmen ... more importantly, will help your bills from being deemed unconstitutional later on -- might be worth the hassle ...

Two main issues here:

1)The public disclosure of potential bills before they are voted on: - Why shouldn't bills be posted for the public to read and react to before they are voted on? Many people forget that the gov't is supposed to work for the people, NOT the people working for the gov't. Making bills available to the public seems like common sense and anyone against it is trying to conceal something.

2)A public option to health insurance: No one is trying to "legislate your colon, kidney" etc. It is very clear that the current state of healthcare will lead to even higher costs and less coverage. A public option provides an alternative to private options. PERIOD. You like your current coverage? Fine, keep it. But why would you want to block public options for people that are unable to afford private options?

Of course they want everything they do hidden. And regarding healthcare: I've lived in six countries and nowhere is it as difficult and exasperating to deal with as here - and I have health insurance. The rest of the world looks at the opposition to reform and think Americans have gone crazy. Open your eyes. The insurance companies are feeding you lies. I'd take any European healthcare system over Blue Cross Blue Shield, Aetna, etc. I spent hours today on the phone because I got charged six co-pays for two doctor visits, and everyone is still blaming everyone else - insurance company, doctor's office, the physician's biller, etc. It's not insurance, it's robbery. Government-sanctioned robbery, well-regulated robbery. Not fit for a civilized nation.

Letters, E-mails. picketing of congressional offices, town hall meetings and peaceful TEA Parties around the country with a massive one on 9/12 in DC apparently did not influence congress. But you remember the 1999 Tennessee Tax Revolt when the Republican governor called a special session of the legislature to enact an income tax; No, well when the citizens found out through talk radio and E-mails they descended on the Capitol in a mass display of indignation. In some cases citizens utilized MLK's tactics by staging sit-ins in legislative offices. The legislature backed down and to this day Tennessee does not have a state income tax.

So what should we, the people, do now? Remember they work for us but are not listening. We cannot fire them under the law, but we can certainly send a message more powerful than we have to date.

I see no reason for congress not to publish the bills at least 72 hrs prior to passing them. Unless we are attacked, there is no urgency that ever warrants passing a bill without a "fresh air" review.

There is also NO reason to pass a bill that [unconstitutionally] forces folks to buy something (i.e., health care insurance) & then add taxes/fees that the insurance & health care companies will pass on to us.

Folks: if we don't like our elected officials' behavior, get in contact with them PDQ before the vote on Tuesday & let them know they're not meeting the expectations of their employer.

I looked at the HR 554 discharge petition and it needs 36 more signatures to force a vote on the resolution. All 33 co-sponsors of HR 554, the 72 hour Internet viewing of all bills, were Democrats and not one has signed the petition to force it out of the rules committee for a floor vote. One is my Rep and he has a statement on his web site proclaiming his support of congress (not citizens?) having HR 554 so they have time to read bills. He has heard from me! Now why are they now not supporting HR 554?

I have compiled a list of the "co-sponsors" of HR 554 who, as of today, 10/17/09, have NOT signed the Discharge Petition to force the Pelosi-Nazis to release it from committee for a floor vote. These are the sneaky House members who obviously wanted their constituents to see their names in support of the bill, but don't have the will or gumption to openly oppose Nancy. I intend to write to each of them, regardless which state they represent, and tell them what happens to COWARDS in the mid-terms! (1) This issue TOTALLY goes across party lines. Thus far the Democrat 111th Congress has employed the "steamroller" tactic with several bills, but in 2001 the Republican-controlled congress did the same thing with, among others, the Patriot Act.
(2) You probably should start by congratulating your own Representative and/or Senator(s) who HAVE signed the House petition, or ARE working toward producing a similar bill in the Senate.
(3) If your representative is NOT on the list, they are not a "co-sponser", or they HAVE already signed. Regardless, check the website to see whether they have signed or not, and if not, SEND THEM THE MESSAGE THAT WE WANT THIS LAW ENACTED!! Another source says we are part of an 83%(!!) majority of the American public.
