HHS would become federal giant under Senate plan

A quick search of the Senate health bill will bring up "secretary" 2,500 times.

That's because Health and Human Services Secretary Kathleen Sebelius would be awarded unprecedented new powers under the proposal, including the authority to decide what medical care should be covered by insurers as well as the terms and conditions of coverage and who should receive it.

"The legislation lists 1,697 times where the secretary of health and humans services is given the authority to create, determine or define things in the bill," said Devon Herrick, a health care expert at the National Center for Policy Analysis.

For instance, on Page 122 of the 2,079-page bill, the secretary is given the power to establish "the basic per enrollee, per month cost, determined on average actuarial basis, for including coverage under a qualified health care plan."

The HHS secretary would also have the power to decide where abortion is allowed under a government-run plan, which has drawn opposition from Republicans and some moderate Democrats.

And the bill even empowers the department to establish a Center for Medicare and Medicaid Innovation that would have the authority to make cost-saving cuts without having to get the approval of Congress first.

"It's a huge amount of power being shifted to HHS, and much of it is highly discretionary," said Edmund Haislmaier, an expert in health care policy and insurance markets at the Heritage Foundation, a conservative think tank.

Haislmaier said one the greatest powers HHS would gain from the bill is the authority to regulate insurance. States currently hold this power, and under the Senate bill, the federal government would usurp it from them. This could lead to the federal government putting restrictions and changes in place that destabilize the private insurance market by forcing companies to lower premiums and other charges, he said.

"Health and Human Services ... doesn't have any experience with this," Haislmaier said. "I'm looking at the potential for this whole thing to just blow up on people because they have no idea what they are doing. Who in the federal government regulates insurance today? Nobody."

The health care reform legislation would rely on the U.S. Preventive Services Task Force for recommendations as to what kind of screening and preventive care should be covered. Last week, the group, which operates under HHS, drew sharp criticism for advising that mammograms should begin at age 50, a decade later than the current standard.

Critics of the bill said this was an example of how the new bill could empower HHS to alter health care delivery, but Democrats argue they would rather have the government making these decisions.

Right now, the best way to fight back, outside of simply writing letters by the hundreds, is to STOP SPENDING MONEY! Save everything, recycle your own cans (don't let the state get the money you paid for deposit! every city has a recycling center), bake your own bread, make your own clothes...don't know how? LEARN! Avoid sin taxed products (booze, cigs, luxury items - the taxes are HUGE on these). Keep your money in your pocket and stop filling the coffers these villains are using to strip you of choice and freedom. If we all did this, their money - their power - would dry up considerably.

This bill is good and bad. You need to read between the lines. Here is just one example. GOOD: Everyone will pay the same for healthcare. With the single government plan, obammamao bureaucrats will take the cost of healthcare, divide by the population of the US and send out a TAX BILL for your "care". Since I'm old and my current insurance says my health care costs more than $12K a year, I will pay less than some young punk just starting out in life. BAD: If I'm a young punk just starting out in life, I will pay for old codgers health care. And by the time I"m old, health care will be so expensive that there won't be any "health care". Government bureaucrats will decide how long you can live and then kill you.

This is accurate; in fact, when I first got a copy of the bill to read, I was stunned by how often changes were made to "Internal Revenue Code" to the extent that I uploaded it to Microsoft Word so I could search the document. I didn't count, but it seemed like every other page. In fact, the Washington Examiner did a story on it:

The reason the federal government has no experience in regulating insurance is because they do not have the Constitutional authority to do so. It is a states issues, which is why most states have an insurance commissioner, because they do have the authority to regulate the insurance industry.

Many thought "change" by Obama and the democrats was to fix some problems with Capitalism, instead of imposing Socialism.

The difference between Capitalism which allows people to choose between insurance companies and Socialism where the government forces one size to fit all is now obvious.

No health care/welfare/insurance/etc system will work unless everyone using the system is doing everything possible to prevent the use of the system. The abusers always destroy the systems that were intended to do good. Democrats are very righteous when they rebuke the rich when the rich abuse the system, but democrats would be more righteous if they would also rebuke the poor when the poor abuse the system.

Some say poverty is because of the abuse of the poor by the rich, but I say most poverty is because of too much wine, women and song by the poor. Even the rich become poor when they indulge in too much wine, women and song.

This is no suprize, Kathleen has already implemented this strategy in KANSAS with FEDERAL dollars in the STATE colfer by refraining from distributing payments to health organizations for SERVICES PROVIED for months and even dozens of months are the PAYMENTS WERE DUE. Of course in KANSAS defence, the state was broke and didnt have any money so it didnt want to turn loose of any money to entitys who provided services in the case that KANSAS might need to tap into those funds. ALL THE WHILE....... MEDICAL entitys with 10's, and 100's of thousands of dollars in services proved awaited payment while they swayed on the verge of bankrupcy. Some even had to borrow money to make payroll, all the while Kathleen partied on thier past due earned bankaccount paid to the state of KANSAS by the US GOVERNMENT>.....

We forced ourself to beleive in the Blacks and not call them the "N" word. This seems ok, but now one is president of the USA. If you have a problem with your insurance company you can change it, you can sue or you can pay for the care yourself. An insurance company refusing to pay does NOT mean you can't get the treatment. In my family we have had to pay for scans the insurance declined, pay for 2 extra hospital days when the insurance said my dad should go to a "rehabilitaion" center instead. When the screen showed an extremly massive and malignant cancer and when my dad went home after the two days and died 36 hours later --- they paid for both. When the government says you can't get something they mean YOU CANNOT GET IT. PERIOD. Try it and you will be imprisoned. Of course the ultra rich simple fly to Geneva or Paris or Cozumel -- where I predict a fantastic new hospital will be appearing shortly.

Think congress believes they could actually control their creation? Congresscritters should take stock of how cheaply their own members can be bought and sold, or coerced, before voting for this Frankenstein of a bill, because Sebelius sure has. And she knows exactly how much their votes cost. HHS would wind up crafting whatever legislation would be necessary to consolidate and expand their power. It would create a monster that congress could never control, with HHS eventually coming to rival or exceed both congress and the President in its power...a de facto and unelected fourth branch.

No, there is NOT. A patient has absolute right to buy whatever care he or she wants and the doctoer has the right to sell whatever service the patient will buy. The insurance bureaucrat only has power to argue about whether the insurance will pay.
Government as payer is fundamentally different, with the power to determine whether the patient has the right to purchase the service, whether the doctor has the right to provide the service, how much the doctor can charge for the service, how much the ptient can pay to obtain the service, how often the service can be purchased, etc.
No insurance representative can deny me treatment, they can only dispute whether my contract with the insurer obligates the insurer to pay.

Not to mention, if the right actually thought any of their supposed, empty solutions would actually happen, they would quickly stop offering them. So spending billion of dollars in 10 aircraft carriers, 100 military bases worldwide, afghanistan and irak invasion is all OK and make sense to everyone here while taking care of the health and feeding our own people is not...no reform is perfect but lowering military spendings and increasing education and health investemnt would not hurt this country, far from it...what we need is good brains and good health prevention policies...or shall we build another aircraft carrier?

Fellow American citizens, I am very concerned about the direction of our country. We have both Climate-gate and government insurance coming and both possibly in the month of December.

If Obama goes to Copenhagen and signs us up for the Climate Treaty, we have to take action. As a Texan, I am ready for succession but would rather a revolution to take our country back.

I am serious about the Climate Treaty. If we sing up for that, we will be essentially ruled by a world government. The repercussions of that treaty will cripple us financially.

I think we are needing to get past complaining about what is happening and begin taking action to remove our elected officials and put responsible citizens in office. Our system of government has become corrupt and we need to fix it ASAP.

On the opening day of deer hunting in Wisconsin 600,000 men(and women)went into the woods all armed with at least a .243 caliber high powered rifle or a shotgun. In Minnesota it was approx. 525,000 hunters equipped the same way. In Michigan, who knows?? We haven't even talked about the South or Southwest or Western states yet!

Only this week, I read of the UK's National Health Service as a 'government unto itself' unassailable by democratically elected government and unanswerable to anyone.

From a patient's pov, that's exactly what it is. Nothing but a dictatorial fiefdom run by stasi penpushers who actually do decide on matters of life and death.

The NHS is disastrously run, it's a real shambles 'managed' by people who'd be given very short shrift by proper businesses.

Checks and balances anyone??? The Stimulus Bill, Cap and Trade, Healthare, Cyber Security Act all transfer enormous powers to the Executive Branch; throw in the Czars and Executive Orders and you will see the huge expansion of power to the President. State rights, anybody. The only oversight from the federal government would be how the tax monies (equitably) are to be funneled to each state. The state would, along with cooperation from the medical health, and insurance industries set the standard for health care. These are state matters, not federal entrusion, and especially not in the hands of a czar/czarina. Smells of socialism/communism perfumed with pleasant odor and dress.

The plan also allows her to decide who gets free rides to medical school. So, it will be more payback to the Acorn folks, instead of to those most qualified. Your next surgery could be by someone highly skilled at voter fraud. And, of course taxes will have to go up even more, because they will have to provide tutors for these medical students. And, standards will have to be lowered. So, I guess we will be getting the same kind of care as the rest of the world.
