Health care reform means more power for the IRS

There's been a lot of discussion about the new and powerful federal agencies that would be created by the passage of a national health care bill. The Health Choices Administration, the Health Benefits Advisory Committee, the Health Insurance Exchange — there are dozens in all.

But if the plan envisioned by President Barack Obama and Congressional Democrats is enacted, the primary federal bureaucracy responsible for implementing and enforcing national health care will be an old and familiar one: the Internal Revenue Service. Under the Democrats' health care proposals, the already powerful — and already feared — IRS would wield even more power and extend its reach even farther into the lives of ordinary Americans, and the presidentially-appointed head of the new health care bureaucracy would have access to confidential IRS information about millions of individual taxpayers.

In short, health care reform, as currently envisioned by Democratic leaders, would be built on the foundation of an expanded and more intrusive IRS.

Under the various proposals now on the table, the IRS would become the main agency for determining who has an "acceptable" health insurance plan; for finding and punishing those who don't have such a plan; for subsidizing individual health insurance costs through the issuance of a tax credits; and for enforcing the rules on those who attempt to opt out, abuse, or game the system. A substantial portion of H.R. 3200, the House health care bill, is devoted to amending the Internal Revenue Code of 1986 in order to give the IRS the authority to perform these new duties.

The Democrats' plan would require all Americans to have "acceptable" insurance coverage (the legislation includes long and complex definitions of "acceptable") and would designate the IRS as the agency charged with enforcing that requirement. On your yearly 1040 tax return, you would be required to attest that you have "acceptable" coverage. Of course, you might be lying, or simply confused about whether or not you are covered, so the IRS would need a way to check your claim for accuracy. Under current plans, insurers would be required to submit to the IRS something like the 1099 form in which taxpayers report outside income. The IRS would then check the information it receives from the insurers against what you have submitted on your tax form.

If it all matches up, you're fine. If it doesn't, you will hear from the IRS. And if you don't have "acceptable" coverage, you will be subject to substantial fines — fines that will be administered by the IRS.

Under some versions of health reform now circulating on Capitol Hill, the IRS would also be intimately involved in how you pay for insurance. Everyone would be required to buy coverage. The millions of Americans who can't afford it would receive a subsidy to pay for it. Under the version of the plan currently under negotiation in the Senate Finance Committee, that subsidy would come through the IRS in the form of a refundable tax credit. Under the House plan, the subsidy would come directly from the Health Choices Administration.

In either scenario, the IRS would be the key to making the system work. Before you could receive any subsidy, whether through the IRS or not, the Health Choices Administration would have to determine whether you are eligible for it. To do so, the bills under consideration would give the Health Choices Commissioner the authority to demand sensitive, confidential information from the IRS about individual taxpayers. The IRS would have to provide it.

Under current law, it is a felony for a government official to release taxpayer information in all but the most limited of circumstances. One such exception is for law enforcement; the IRS is allowed to give taxpayer information to prosecutors in criminal cases. The information can also, in some instances, be released to the Social Security Administration and the Veterans' Administration for the determination of benefits. The health care bills would change the Internal Revenue Code to permit the IRS to give similar information to the vast, new health care bureaucracy.

That means the personal tax information of millions of Americans would enter the system whether they want it to or not. "There's a mandate to buy insurance," says one Republican House aide. "You have to buy it. You have millions of people who can't buy it without a subsidy, so they will have no choice but to accept the subsidy in order to buy insurance, and then the Health Choices Commissioner will have access to their tax records."

"How many hands would this information go through?" asks a GOP source in the Senate. "What are the quality controls? This increases the risk of misusing this information."

Some versions of the bill even permit the release of confidential taxpayer information for decidedly less pressing reasons. In H.R. 3200, the IRS would be required to provide taxpayer information to the Social Security Administration for the purpose of helping Social Security officials find qualifying seniors who can then be encouraged to enroll in the prescription drug program. "There is no precedent for using taxpayer information for the purpose of identifying people to go out and advertise to them," says the House expert.

So far, there has been little substantive public debate about the integral role of the IRS in nearly every aspect of the various national health care proposals. But people who are closely involved with the process are deeply concerned about what they view as a massive, and in some senses unprecedented, expansion of the Internal Revenue Service.

First, they wonder whether the IRS can handle the new demands. "There is a sense at the IRS that their purpose is to collect revenue and not to implement all sorts of other programs," says a second Senate GOP aide. "Also, the IRS isn't necessarily great at doing what it does already. How is it going to determine whether 300 million people have health insurance?"

Second, they are concerned about anticipated abuse of the system. "You're going to have lots of fraud," says the House source. "People claiming lots of affordability credits or refundable tax credits. The IRS is not going to have the resources and expertise to police this stuff."

Finally, there is a third concern, more fundamental than questions of whether the IRS can handle the job: Should the IRS be involved in health care enforcement in the first place? As seen in the town halls across the country in August, many Americans are concerned about the coercive nature of the proposed national health care system. Handing the IRS the power to monitor every American's place in the system worries them even more.

Backers of the Democratic bills are betting that the handouts involved — giving people money to buy health insurance — will outweigh concerns about privacy and coercive government. Perhaps. But before Congress makes any decision on national health care, voters should know just what it will involve.

No on cares about health care! It's a scare tactic of the lib dems to distract from the fact the Barrack Hussein Obama has never shown a birth certificate! Everyone talking about healthcare is a threat to America because they won't talk about this basic CONSTITUTIONAL issue! In times of crisis like these, at least Republicans know the facts, which are that illegal governments must be set aside in favor of carrying on the REPUBLIC!

I have said elsewhere, and I reiterate, I will not cooperate with a mandate. I will intentionally drop myself from my insurance policy and I will not pay the tax. I would rather go to jail than pay that.

They HAVE to do it through the IRS or it will be outright unconstitutional. If they weave it through the IRS and attempt to show it as somehow related to a "tax", then they feel it might pass through the judiciary intact.

This is unconstitutional! It is a way to grab more power from the people. Mandating health care is not American, it is not wise and will only break our economic system further. "Cash for clunkers" didn't work either. That was a redistribution of assets. It failed, so will this. Stay out of our lives government!

Wow, there's a lot of ignorance in the comments above. Just how did you think the federal government could enforce mandated insurance? The tax code is the only constitutional way to do it, so it should have been obvious to anyone that knows the constitution that the IRS would be involved.

Without a public option in the bill, this is going to be an outrage. Forcing me to buy insurance from a private company, legitimizing their product with the force of the government and the law? Crazy!

We need the public option. The public option is actually the more conservative path than requiring people to buy private insurance. I don't like the government in my affairs, but I'd rather have them provide a service to me than require me to support the power-hungry greedy insurance companies.

This is scary stuff. Especially when Rahm Emanual's brother who is advising Obama on the health care bill recommends that the Federal Government implement a program where they judge a person's value to society when dolling out health care to control costs. This also means that under any government plan, Senators and Congressmen will _still_ have preferential treatment. With the addition of the IRS to the mix and helping to make these decisions ....

My one silver lining hope is that this administration causes such a backlash that the liberals/socialists are relegated to San Fransisco and Harlem. That would be something; 433 conservatives in the House and 2 Democrats --- Pelosi and Rangel!!

They'll probably do this like they do car insurance in Ky. Don't have mandatory insurance you get a 500 dollar fine and better show up with a policy. Don't pay the fine, go to jail with those who are behind their child support payments. Take your kid to the emergency room without insurance, pay a fine or go to jail, unless your an illegal alein. This is kind of good, no new agency will be created to collect on the premiums if they use the IRS; HOWEVER, IT IS SCARY, improved efficiency in the white house...must mean something is really up. Vote against any part of the Health care bill, all components will speed us into socialism before the year is over.

This is the central objective of this health care debacle. By tying health care to the IRS through the eleigibilty requirements the government can engage in almost any activity without a constitutional implication. The constitution gives the power of congress to collect taxes and thus preempting any constitutional questions on the methods. In doing so the Obama adminstration will, with one vehicle, destroy the structure of the United States by creating a direct leverage over all of the citizens of the US with contitutional immunity.

This bill (1000 pages) must have been written along the way for years, just like the stimulus plan (800 pages). This means it is more than the democrat congress and the president put together, no way could they have written it in the short time they all have been in office. The stimulus plan and this health care bill were created by a legalistic entity determined to turn America into a socialist nation, with every i dotted and every t crossed.

Is it wrong for a business to take advantage of the loopholes created by government mandates? If they did not, then their stockholders would fire the board and the CEO. That is the way it works.

This is NOTHING like auto insurance. You have a choice about auto insurance. Don't drive. Driving and owning a vehicle is not a "right". It's a privilege. If you choose to drive, then yes, you need to play by their rules.
But there is no opt out to be alive. Well, there is, but your argument is moot if you're dead. Being alive is a right, not a privilege.
So, comparing health insurance mandates to auto insurance mandates is like comparing apples to elephants.

Obama must be stopped! Read what is "acceptable" health insurance in the bill and you will know within 2 years even us who have employer/group insurance will be forced into the National plan b/c of penalties to employers for not converting to it!! Also, then the government will have access to your bank account for claims reimbursements. John - I agree with the birth certificate - let's add to that - just impeach Obama based on the fact that he's not upholding the Constitution as he swore to do on Inauguration Day! He works for us, and he needs to be reminded of that!!

Congress must be taught that every dollar they spend is a many thousands of dollars per each of us ,man woman and child. wealth re-distribution, by force. the 16th amendment has gone far beyond it's original intent (just like the 14th and illegal aliens "rights"), just as the federal government has done. whatever grants more power to the gov and makes states and American citizens even more dependent is the ultimate goal of these wastes occupying gov seats.

impose term limits for all government positions! stop gravy train and stop socialism. every single American needs to read the Constitution and think for themselves, exercise some individual responsibility. if you want health insurance, buy it. to what end do liberals see the gov intruding into our lives?!

certainly there are steps that could be taken to upgrade health care insurance in this country. Certainly those steps were not included in the current massive bills being floated. The Dems took the issue by the horns and screwed it up - the arrogance with which this administration and the Dem controlled Congress operates - left no room for common sense. Therefore, nothing of any substance will get done - the over 1000 pages of massive, arrogant, government control over "we the people" will be flushed down the toilet as it should be. Next flush - the Dems in Congress. Get ready.

This information has been out before but there is now a growing credence to what is being said even though the left will deny any and all proof.

The IRS is far to powerful and it is a force that disrupts America because of the need to feed this large governments ever growing, hungry coffers. I do not believe this is what the founding fathers had in mind for this Republic, in fact we all know that lower taxation will increase the coffers of government by sheer willingness to do less restrained business but as a police force and all your money they can use this agency is being misused and in a tyranical way. It is way past time to reform all this misuse and put it in order to take away the abuse of power being execised by our elected representatives.

I an thinking that using this bill and the IRS is a first step in locating all possible sources for "help" and "income". Right now the only way to do it is to use our SSNs. Considering how far technology has come, the next logical step would be to "chip" all citizens so that the privacy concerns will have been taken care of.

The IRS already has far too much power and far too little oversight. They have a history of "auditing" people who try to work against them - and with a tax code as complex as ours, it's next to impossible to protect against them. Can you imagine what would happen if they had control of your health care as well, and could cut you off at any time based on some technicality?

Add this to Obama's constant acquisition of prime-time TV slots, his upcoming attempt to propagandize every child in America, his contributions to the housing collapse (guess who was one of the primary recipients of compaign donations), his control of the banks and assorted other major industries, etc. and it's fairly obvious we're on the road to socialism / fascism.

The only thing missing so far is having our guns taken away.

I think the IRS proposal first arose in the bipartisan Wyden-Bennett Healthy Americans Act. You can go to either Senator's website to see their specific proposals. I'd say that Bennett is as about conservative as they come and Wyden is a policy wonk not an ideologue.

It more than likely outsourced just like the Stimulus, Reinvestment, or whatever they packaged it as by The Apollo Alliance which is funded in large part by the Tides Foundation, which in turn is largely funded by George Soros. Catching the chain of command yet? This congress can't put two words together let alone 1000 pages of coherent thought. Social justice, environmental justice, the tools of wealth redistribution. I work representing clients with IRS problems and examinations. Almost on a daily basis.
The examiners are not well trained in the Internal Revenue Code. Nor any other aspect of the organization. The Service cannot even take care of the issues with which they are charged now.
Assignment to impose penalties if you do not have enough health insurance is a joke. The IRS employees are like the members of Congress, they live in a world removed from reality in the real world.I worked for the agency for 10 yrs. The agents I am working with right now would have been asked to resign or be fired after the first phase of basic school.

These kids choose not to have health care because they cannot afford it after paying for tuition loans, rents and Starbucks. Why are insurance companies so "Evil". We aren't forced to accept it. They simply provide a chosen elective of coverage. This is based on proven "risk" and losses. They weren't so evil when they paid to repair your damaged car or burned down house or cracked tooth. If you dodn't have it you're on your own. It's a choice and affordability. Type of coverage is a choice. Think about this - 9 out of 10 people on this earth don't even know what insurance is. I couldn't afford it several times and it worked out. Let's focus on fixing social security so that they can't continue to squander those funds - and medi-care and the VA. Just imagine what they'll do with the trillions from Health care. He went to an emergency room complaining of a horrible pain in his lower abdomen the doc said it sounds like kidney stones, he was given pain pills and was sent home. This is irrelevant because an individual mandate will be struck down by the Supreme Court, unraveling the entire reform effort. A federal mandate on an individual to buy insurance clearly violates the 10th amendment. It is not an extension of the interstate commerce clause. It doesn't matter whether the IRS or another agency enforces it. The only way it would pass muster is by making it voluntary, in which case an incentive would need to be created, such as removing federal benefits for non-compliance as is done with Selective Service registration.

The stock market will love Cap and Trade.
Here's how it works...
Co A makes too much pollution.
Co B doesn't make hardly any.

Co A can then buy "credits" from Co B. Credits being some ficticious number that the gov credits it with for not polluting too much.

Then the stock market can make a market for these credits in drrivetives. You know the same way they did in houses.

Are you now getting the picture. Duh!

I am so sick and tired of this government, anyone who does not want to leave this country out of fear alone is completely out of touch with the rest of the world.

This bill will make America the first country in the history of the world to criminalize health related behavior. Anyone who cannot see how horribly scary a concept this is needs to get an education, and if not too embarrassed six or eight years from now, re-discuss this subject.

Isn't it the democrats who always say the republicans are trying to take away social security and medicare? Now the demos are saying if we are against obamacare, why do we take that dole from the govt. Well, for one thing I and most others who have held jobs were forced to pay ss with the promise we woud be able to supplement our retirement with it. Of course the gov. couldn't stand to see all that money sitting there , so they put it in the general fund and spent it. People could have made much more by investing it themselves. Also we who have medicare pay for it, and it costs more each year for less. It you don't have a supplement you end up owing a lot. I'm 70 years old and don't want the gov. to tell me what kind of treatment I can have for what ails me. They have already said that old people will just have to get used to whatever they have, because they won't be treated. Obama and his tsars and administration are all crooks.

Mandatory health insurance is a scam similar to Social Security. Social Security was based on the idea that most people who paid into it would not live long enough to collect it. The proposed health insurance will be paid for mostly by the young and healthy who will seldom need to use it, but who will have to pay a large deductible they can ill afford when they do. Yes, they will eventually grow older and need more health care, but where will the government then get the money? It can't even pay for the Baby Boomers' coming Medicare and Social Security.

This is all about creating more cushy government jobs for the Dems and their friends, relatives and supporters.

Mandatory health insurance is also about revenue enhancement - it is a new tax that EVERYONE will pay, regardless of Obama's campaign promises not to raise taxes on the middle class. Did we not hear him on nation-wide television tell us that this health care bill was necessary for economic recovery, because the Government is about to go broke from all the entitlements it is obligated to provide? Whether you pay money to the government for health insurance or to a private company, it all goes to meeting those obligations.

The private insurance companies will be forced to cover pre-existing illnesses. The only way they will go along with that is if the government guarrantees them a profit by forcing everyone to buy a policy. The insurance industry has already made its backroom deals with Obama and the Dems - in secret, closed-door meetings.

So the IRS will be the enforcers or the punishers. Since a tax return will be their primary source of information, where will they get the info on all those folks who do not file a return? The homeless, the illegals, those below the cap of having to file, and simply those that ignore filing altogether. I can see the next mandate box to be checked right after the "do you have approved health insurance?", will be "Did you eat all your vegetables?" There are companies that opt to be self-insured. Will that be an approved option?

This idea when applied to the health care DRAMA reads like this… Those choices have been condoned by the health care system through a profit motivated codependence. Barack is basically staging an intervention. The American people are not only being forced to face their behaviors as a choice but they are being forced to “quit.” On top of this Americans’ are afraid they will be left high and dry when it comes to the ramifications of those choices 10 years from now. When the income tax was created it was voluntary. Then it became law thru Gov.Then the IRS was created and all hell broke loose. Since then it made it mandatory to come out of your pay check. Then some liberals decided that wasn't enough so they attacked social security program. Now S.S. is broke. In the new gun bill that is being proposed they want you (as a gun owner) to list all your guns on the IRS tax forms and pay a tax of $50.00 per gun and
$25.00 for any change of ownership. Just another way to control and charge a TAX. People if this is the change you voted for then live with the outcome. Along with millions of other TRUE AMERICANS I don't like it.

They said it was written in about a week after 911. There is no way they could write that act in that short of time and get evertone to sign off on it. The patriot act was written well before 911 but had to wait for an event like 911 to happen before they could implement it. I work representing clients with IRS problems and examinations. Almost on a daily basis.
The examiners are not well trained in the Internal Revenue Code. Nor any other aspect of the organization. The Service cannot even take care of the issues with which they are charged now.
Assignment to impose penalties if you do not have enough health insurance is a joke. The IRS employees are like the members of Congress, they live in a world removed from reality in the real world.I worked for the agency for 10 yrs. The agents I am working with right now would have been asked to resign or be fired after the first phase of basic school.

Another thing to be aware of is the 'piggy back' bill. This fight isn't over. The gov is going to try new tactics. One is to introduce a good bill people will be benefit from. The health care bill won't receive news media attention like the 'good bill' will. Then when we urge our reps to vote yes on the bill, in our uninformed ignorance we will have asked for the health care bill too. GOvernment will wait and then bring it up again. Has there been any serious CUTTING on the federal government.. ever?

Its time to ask one thing of our federal level politicians.

To Cut. Its time for the biggest trimming ever.

Time for liberals to join hands with conservatives to end big government. Liberals, if they are rational, should understand they do not want more power in the hands of politicians they hate half the time.

Obama gets power that one day falls into the hands of GWB and his ilk.

Did anyone read 1984? What is the point of liberals loving books if they don't learn anything FROM THEM!!!!!!
