Holder's CIA move could imperil Obama agenda

Attorney General Eric Holder's decision to put a federal prosecutor on the CIA interrogation case is a game-changing move that could upend President Barack Obama's broader agenda.

Holder on Monday asked Assistant U.S. Attorney John Durham, who has been investigating the destruction of CIA interrogation tapes, to look into whether the agency's methods for questioning detainees were illegal.

Approved by Obama, the new scope of the investigation threatens to enflame still-raw tensions on both sides of a long-unresolved national security debate.

"This could create a political problem for the president, who rightly understands that looking back will be politically explosive and has the potential to undermine progress on his top priorities," said Clark Ervin, a national security expert at the Aspen Institute and a former Bush administration official.

Holder's expanded probe appears destined to reawaken deep partisan divisions over the conduct of the war, and could alienate conservatives strenuously opposed to criminalizing interrogation methods.

The investigation could play havoc with Obama's efforts on health care reform by creating a political maelstrom in Congress. It also creates a tricky calculus for the president's war strategies -- some of which, such as rendition, are continuations of former President George W. Bush's policies.

"It has the potential to make it tougher to get funding for the war," Ervin said. "There is evidence of cold feet on that already."

White House press secretary Robert Gibbs said Obama still believes CIA inquisitors who acted "in good faith and within the scope of legal guidance" should not be prosecuted.

"Ultimately, determinations about whether someone broke the law are made independently by the attorney general," Gibbs said.

Obama several times has held firm against calls from within the Democratic Party to investigate harsh interrogation methods, saying it's best to look forward, and not back.

Holder's move signals his determination to operate independently from the White House. Although a staunch ally of Obama, Holder is not a member of the president's trusted inner circle.

During the Bush administration, then-Attorney General Alberto Gonzales' role as loyal adviser is often cited by critics as a contributing factor to the lack of independent oversight that allowed alleged detainee abuse and other problems to occur.

Holder called Durham's probe "preliminary," aimed at determining whether an independent investigation, for example by a special prosecutor, is warranted.

Even with a full investigation, Holder said, it is not certain that criminal charges would result.

Even so, "special prosecutors are dangerous animals," said Stephen Hess, a presidential scholar at the Brookings Institution. "Once you set them in motion, you never really know where they are going or how to stop them."

David Dow, a constitutional law expert, said convictions from a special prosecutor's probe would be highly unlikely.

"I think there will be pretty daunting legal defenses, unless there were people doing things they were explicitly told not to do by superiors that also violated criminal law," Dow said.

If Obama didn't want Eric Holder to persecute the heroes who kept us safe afte 9/11 Eric Holder wouldn't be doing it. This is being done now to throw a piece of raw meat to the left wing crazies, and deflect attention away from the disaster of Obamacare! One has to wonder how many terrorist plots to murder thousands in the U.S. will continue to be foiled as CIA agents run to their attorney's office as Obama conducts his war against the CIA?

I do not believe for a second that Holder made this decision without first getting the OK from Obama.

Our President is, I am sorry to say, a liar. He has stood in front of us and told us endless lies about a heathcare bill that he has apparently not read. He promised to end the unconstitutional "signing statements" that Bush used. Before he took over the car companies he prtended he didn't want to do that..and he pretended he wanted to "look forward, not backward" in regard to investigating torture. The idiots in the media are now suggesting Holder is acting on his own-- that is laughable.

The message is "Either fire Holder or accept my resignation."

Wonder how long Holder will keep his job when Pres. Obama needs to hire 20,000 new employees or just close down the CIA.
And no, he can't keep the CIA in their jobs. They can't strike, but they can all quit.

Iraq War, including incalculable costs plus lives lost and destroyed, was one big vendetta of 43 against Saddam for his attempt on 41 in Kuwait. "Hey, we're talking about a guy who tried to kill my dad!"

AQ never existed in Iraq before US invaded, despite 41's "mushroom cloud" type fabrications and scare-mongering.

Don't get me wrong, Saddam was one evil character, and needed taking out. But stop and think where Iraq got the chemical weapons he used on the Kurds.

My point is, what goes around, comes around. And nearly every international problem faced today can be attributed to past "foreign policy pigeons coming home to roost."

Pigeons like decades-long Cold War proxy battles fought throughout the world, right-wing dictatorships supported (including nasties like Saddam), and of course, Palestine.

Given Holder's history of politically-driven decisions, it's inconceivable that he's doing this without coordinating with the WH. The question is why Obama is determined to manufacture division and crisis.

His base has been defecting and maybe he is desperate enough to keep them that he'd try this-- the timing does coincide with a rising leftwing chorus of discontent. On the other hand, maybe he and Emmanuel just enjoy the opportunities they see associated with "a good crisis."

If George (41) hadn't gone wobbly in the first Gulf War, he had Saddam's army on the run (road to Baghdad), and could have taken SH out then, rather than letting him wreak another 15 years of terror on Kurds, Shiites, and anyone else who ran afoul.

The "Hey," comment was a direct quote to one of 43's few press conferences.

The remainder of your insults don't merit a response, and don't reflect informed thinking.

So, how exactly, do you arrive at your conclusion? I am not a libertarian because I think government should not be able to indefinitely hold you without a trial? Or because I believe that the government should be held accountable by the people they represent?
Exactly which of my positions disqualifies me from being a Libertarian?
Republicans used to believe in limiting government power over individuals, you know, little things like: you can't lock me up for life unless you at least give me a trial, you must have some sort of evidence, you know, little things like that.

If the CIA Interrogators committed a crime, they should be brought to Justice like any other criminal. This is suppose to be a country of LAWS. That is unless you are a REPUBLICAN perhaps. The President did not commit the ABUSE that was perpertrated, he tryed to look the other way. But even the President can not circumvent the Law, thank God for that. The CIA did some things that are against the LAW, so let JUSTICE prevail.
