The RAT hiding deep inside the stimulus bill

The far-reaching — and potentially dangerous — provision that no one knows about.

You’ve heard a lot about the astonishing spending in the $787 billion economic stimulus bill, signed into law this week by President Barack Obama. But you probably haven’t heard about a provision in the bill that threatens to politicize the way allegations of fraud and corruption are investigated — or not investigated — throughout the federal government.

The provision, which attracted virtually no attention in the debate over the 1,073-page stimulus bill, creates something called the Recovery Accountability and Transparency Board — the RAT Board, as it’s known by the few insiders who are aware of it. The board would oversee the in-house watchdogs, known as inspectors general, whose job is to independently investigate allegations of wrongdoing at various federal agencies, without fear of interference by political appointees or the White House.

In the name of accountability and transparency, Congress has given the RAT Board the authority to ask “that an inspector general conduct or refrain from conducting an audit or investigation.” If the inspector general doesn’t want to follow the wishes of the RAT Board, he’ll have to write a report explaining his decision to the board, as well as to the head of his agency (from whom he is supposedly independent) and to Congress. In the end, a determined inspector general can probably get his way, but only after jumping through bureaucratic hoops that will inevitably make him hesitate to go forward.

When Iowa Republican Sen. Charles Grassley, a longtime champion of inspectors general, read the words “conduct or refrain from conducting,” alarm bells went off. The language means that the board — whose chairman will be appointed by the president — can reach deep inside a federal agency and tell an inspector general to lay off some particularly sensitive subject. Or, conversely, it can tell the inspector general to go after a tempting political target.

“This strikes at the heart of the independence of inspectors general,” Grassley told me this week, in a phone conversation between visits to town meetings in rural Iowa. “Anytime an inspector general has somebody questioning his authority, it tends to dampen the aggressiveness with which they pursue something, particularly if it’s going to make the incumbent administration look bad.”

I asked Grassley how he learned that the RAT Board was part of the stimulus bill. You’d think that as a member of the House-Senate conference committee, he would have known all about it. But it turns out Grassley’s office first heard about the provision creating the RAT Board last Wednesday, in a tip from a worried inspector general. It wasn’t until Friday morning — after the bill was finished and just hours before the Senate was to begin voting — that Grassley discovered the board was in the final text. “This was snuck in,” Grassley told me. “It wasn’t something that was debated.”

Snuck in by whom? It’s not entirely clear. “I intend to get down to the bottom of where this comes from,” Grassley vowed. “And quite frankly, it better not come from this administration, because this administration has reminded us that it is not about business as usual, that it is for total transparency.”

Maybe not this time. When I inquired with the office of a Democratic senator, one who is a big fan of inspectors general, I was told the RAT Board was “something the Obama administration wanted included in this bill.” When I asked the White House, staffers told me they’d look into it. So for now, at least, there’s been no claim of paternity.

The RAT Board has all sorts of other things wrong with it. For one thing, it’s redundant; there is already a board through which inspectors general police themselves, created last year in the Inspectors General Reform Act. For another thing, it could complicate criminal investigations stemming from inspector general probes. And then there’s the question of what it has to do with stimulating the economy.

But none of that matters now. It’s the law.

Last Friday, when he learned the RAT Board was in the final bill, Grassley wanted to voice his objections on the Senate floor. But there was no time in the rush to a vote, so Grassley’s statement went unread. “It’s fitting that the acronym for this board is RAT,” he was prepared to tell the Senate, “because that’s what I smell here.”

The Pelosi/Reid so-called stimulus bill is a "Rat" from the first page to the last. And its all in the name of 'transparency' which is a sad joke. I guess the so-called MSM is too busy singing Obama's praises to actually investigate what's in the bill. I hope the GOP Governors turn down the money in the bill.

And if the Governers do turn down the money, all in the name of pride, and watch their state plummet with layoffs and foreclosures what do they accomplish? I think it is sad that they are putting their personal opinions before their due obligation to "Serve the People". Some states are cutting jobs in their government office, freezing pay, and not hiring in vacant positions but removing them from their rosters. Those are positions that people could fill and do something positive. All I hear is the GOP saying "NO" to everything offered and tax cuts, but who will benefit if the companies are gone? I may not agree with RAT but the GOP Governers should be ashame of themselves if they sacrifice their state for their pride and personal agenda.

Rest assured, this provision designed to have a chilling effect on Inspectors General has no bearing on the operation of state law enforcement officials, like the A'sG, whom we should be bombarding with allegations that the D Party, through Nancy Pelosi, qua (in her role as) Chair of the 2008 DNC Convention, perpetrated fraud on voters in the state by Certifying BO is a NBC, when overwhelming circumstantial evidence indicates, he is not. York conveniently left out some following text from this passage about RAT First, BEFORE the text he quoted is this - '(a) Independent Authority- Nothing in this subtitle shall affect the independent authority of an inspector general to determine whether to conduct an audit or investigation of covered funds.' Second is this - 'The inspector general’s decision shall be final.' False controversy. Considering how much money is being pumped into these agencies there should be another oversight board that should help monitor this.

Hey, like the demoncrats keep reminding us, the American people put them in power so they are free to do as they wish without being accountable for their actions. They talked of transparency and no one in the liberal media complains when they take to the opposite direction. Code Pink protested the wars before Obama, but are silent when 17,000 more troops are assigned to Afghanistan. Newsweek tells us that Obama and the demoncrats aren't socialists and then try to tell us that we are all socialists. The demoncrats won the elections and now we will see what they truely stand for.

I agree with Logan; the liberal media touted the dems and Obama as the solution to all the problems that Bush caused and never told the whole story especially about the financial history and the demise caused by the majority of the dems; the media constantly bombarded the news with negative statements and the poor american fools soaked it right up; I listened to all the news stations and Fox Cable News was the only station that warned us of the socialist attitudes and the wrong doing of Barney Frank, Dodd and others, and they were totally ignored. Fifty-two percent of the people said they wanted change and we are certainly getting what the 52% requested and we are all suffering. If many are outraged then show your outrage the next time the state and house elections come up. Vote out the incompetents once and for all! Until then, suck it up!!!

The present economic crisis was a group effort. Politicians from both parties caused parts of our complex economic system to go unmonitored and unregulated. The unfortunate thing about unregulated free market capitalism is that it sometimes tries to commit suicide. This forces some form of massive government intervention which inevitably leads to a chorus of "It's socialism! It's communism!" Without some kind of intervention, our economic system has a chance of collapsing completely and not recovering for a very long time. Then we'd really get socialism up the wazoo.

Why are people so up in arms over this but not the TARP money which has apparently no accountability whatsoever? And what about Susan Collins' removal of whistle-blower protections? Seems having that protection would help to ensure that this money IS being spent the way it was intended. Remember, there are small businesses out there that are depending on the influx of this stimulus money to survive. It isn't just for individuals.

Decent bill if you believe spending our way out of this recession is the only way out, and most economists believe exactly that. Probably too small in general and as far as infra-structure rebuilding goes. Why worry about debt now???? If RAT is your biggest complaint, it's a great bill. If you think it's waste, don't take any jobs created by the bill or any extended unemployment benefits. I'll bet all you stimulus haters cashed your stimulus checks of 2008! Come on, raise your hands. Yeah, I thought so. You'll whine about the stimulus bill, but do every thing you can to benefit from it. I'm hoping GOP governors _do_ refuse any money (they won't)...it will leave more money for the other more sensible states.

Seem to be having posting issues- if you pull up the text of the final bill it shows that the IG that is solicited by the board can reject in whole, or in part the request of the board, but has to submit a written report. The IG in question has final authority, so this is only a problem is you have a roll-over IG, which is pretty unlikely given the job description. Cheers.

um...hate to say it...but i read this...went to govtrack... did a search for Recovery Accountability and Transparency Board. Several bills came up, including the original Obey legislation HR 679... introduced on 01/26... then did a whole google search on same... came up with the pdf from the appropriations committee by obey...http://appropriations.house.gov/pdf/RecoveryBill01-15-09.pdf ... i guess obama is responsible for calling them up and reminding them to do their homework as well... hard hitting investigatin' there. It was deeply hidden on page 16... in part 2 of the first title.

So far as I can see it makes no difference as to what the new president has said about any of the issues, to include transparancy in government, it is now back to business as usual. A smooth transition from one unconstitutional administration to another that will take unto itself the continued growing of government to the point of destroying this Republic. There is nothing "liberal"or "conservative" about the make up of this congress or presidency. Radical is the terminology that describes all that I witnessed since the Nov. election. The D.C. crowd needs to be "rotated as out of date stock", a
