When Democrats derailed a GOP Latino nominee

Unless something entirely unforeseen happens, confirmation hearings for Supreme Court nominee Sonia Sotomayor will be a lovefest for the Democrats who run the Senate Judiciary Committee.  There will be much talk about Sotomayor's historic opportunity to become the first Hispanic on the Court, about her inspiring background, and about the sterling qualifications she would bring to the job.  Sotomayor will have the majority party strongly on her side, and odds are things will end happily for her.

For some Republicans, however, it will be hard to avoid thinking back a few years, to a confirmation hearing that didn't end happily at all.  In 2001, President George W. Bush nominated former Justice Department lawyer Miguel Estrada to a seat on the federal courts of appeals.  In that instance, as today, the nominee was was a Hispanic with a compelling story and impressive qualifications.  And some of the very people who are today praising Sotomayor spent their time devising extraordinary measures to kill Estrada's chances.

Born in Honduras, Estrada came to the United States at 17, not knowing a word of English.  He learned the language almost instantly, and within a few years was graduating with honors from Columbia University and heading off to Harvard Law School.  He clerked for Supreme Court Justice Anthony Kennedy, was a prosecutor in New York, and worked at the Justice Department in Washington before entering private practice. 

Estrada's nomination for a federal judgeship set off alarm bells among Democrats.  There is a group of left-leaning organizations -- People for the American Way, NARAL, the Alliance for Justice, the Leadership Conference on Civil Rights, the NAACP, and others -- that work closely with Senate Democrats to promote Democratic judicial nominations and kill Republican ones.  They were particularly concerned about Estrada.

In November, 2001, representatives of those groups met with Democratic Senate staff.  One of those staffers then wrote a memo to Democratic Sen. Richard Durbin, informing Durbin that the groups wanted to stall Bush nominees, particularly three they had identified as good targets.  "They also identified Miguel Estrada as especially dangerous," the staffer added, "because he has a minimal paper trail, he is Latino, and the White House seems to be grooming him for a Supreme Court appointment.  They want to hold Estrada off as long as possible."

It was precisely the fact that Estrada was Hispanic that made Democrats and their activist allies want to kill his nomination.  They were determined to deny a Republican White House credit, political and otherwise, for putting a first-rate Hispanic nominee on the bench.

Durbin and his colleagues did as they were instructed.  But they had nothing with which to kill the nomination -- no outrageous statement by Estrada, no ethical lapse, no nothing.  What to do?

They brainstormed. Estrada had once worked in the Justice Department's Office of Solicitor General, right? (Appointed under the first President Bush, Estrada stayed to serve several years under Clinton.)  That office decides which cases the government will pursue in the Supreme Court, right? And that process involves confidential legal memoranda, right?  Well, why don't we suggest that there might be something damaging in those memos -- we have no idea whether there is or not -- and demand that they be made public?

Durbin and his colleagues knew the Bush Justice Department would insist the internal legal memos remain confidential, as they always had been.  It wasn’t just the Bush Administration that thought releasing the documents was a terrible idea; all seven living former Solicitors General, Republican and Democrat, wrote a letter to Judiciary Committee chairman Patrick Leahy begging him to back off.

But the Democrats didn't back off.  They had a new, very serious question to ask: What is Miguel Estrada hiding? 

The answer was nothing, of course.  But the strategy worked.  Democrats stonewalled Estrada's nomination, and, after losing control of the Senate in 2002, they began an unprecedented round of filibusters to block an entire slate of Bush appeals-courts nominees, Estrada among them.  The confirmation process ground to a halt.  More than two years after his nomination was announced, Estrada, tired of what appeared to be an endless runaround, withdrew his name from consideration. Instead of being on the federal bench, he is now in private practice in Washington.

And that was how Democrats treated the last high-level Hispanic court nominee.  Think about that when you watch their lovefest with Sonia Sotomayor.

Democrats will say that we are trying to block Sotomayor because she is Hispanic and tar us a racist. But we will be against her not because of her race, but because of her racists remarks and judicial philosophy and real issues, none of which were there for Estrada. And it was the Democrats who actually DID block a nominee because he was Hispanic. Ironic and hypocritical, but this is always what the lying Democrats do. and they always get away with it because they always have the media to cover for them and carry their water. I am so sick of it and see no way to get around it ever. I have never been so discouraged because this happens just time after time. The Democrats actually are everything they try to say the Republican are -- racists, corrupt, liars, idealogue, etc. And the Republicans actually are NOT any of those things.

Most Americans, like my wife, are much more concerned with and obsessed with "Celebrities" and pop culture rather than the future direction of the country. Case in point -- On our kitchen counter is my wife's In Touch magazine which has an article titled "Which star has a lumpy butt." She probably doesn't even know who Sotomayor is or what a danger Sotomayor presents to traditional American values and thought.

Greg: Reading comprehension not your thing? The facts brought forth in the article are that Estrada is a hispanic with an impeccable record that was dashed by the Dems for political purposes. Since you can't point to anything wrong with the article you revert to a "...well, you guys are hypocrites" defense and don't back it up with any claims. There is more than enough evidence to question Sotomayor's nomination based on her statements and rulings. It would nice if you would look into it instead of spouting off an ill-informed partisan rant devoid of rational thinking.

Rush Limbaugh is so far the only sane voice out there, perfectly enunciating the ton of baggage that Sotomayor brings to this appointment. Her own words, not the words of Rush or any other Conservative, brand her a racist. Does she ever use any other word besides "Latina" to describe herself? How many people do you know who preface every description of themselves with an adjective proclaiming their racial heritage or sex? I am a white woman of German-Irish descent who also studied law, and my own life story is pretty darn "compelling." We don't have any white Christian German-Irish women on the court, do we? Well, why not? Guess I'm not ethnic enough,huh? Give me a break! Sotomayor is a racist, obama is also a racist, and that's why he likes her so much.

I would recommend that the GOP Senators use the "same" words the Dem's used during their hearings. See how the MSM plays it and the reaction from Pat and Dick. I would recommend that Jeff Session pull the entire line of questioning from Estrada's hearing and play it back to the Dem's when they question Sotomayor.

I agree with Loadmaster. I think Durbin, Reid and Kennedy reread their Estrada transcripts as they prepare their questioning of Sotomayor. Just as LBJ got the Civil Rights act passed in 1964 it was on the backs or Republicans, not Democrats. The southern Dems totally blocked it. It's to bad such history is forgotten.

Thank god for that, because I do not want anyone on the supreme court with any hint of a tie to the nonsense regarding Bush's trumped up war and policy initiatives. In such matters, we should all agree that Republicans should not behave like Democrats. Republicans should climb up out of the gutter, leaving it to the Democrats and the rest on the Left. Sure, this is unilateral disarmament, since Dem-lefties have demonstrated time and again - Bork, Estrada, Gonzales - that gutter politics works. But, at least Republicans will be abandoning the gutter with honor, leaving the Democrats standing happily dishonored but in charge. As Charles put it,"someone has to step up and be the bigger person and end this quid pro quo nonsense." Since we know that the Democrat Party has subsisted on racial and ethnic political strife for about 150 years, we cannot expect them to be this "bigger person," thus giving up one of their most successful tactics, which means the role can only fall to Republicans.

irish dem, you make me embarrassed to have common ancestry. It was OK for Dems to attack Estrada, or Janice Rogers Brown, but any crticism of Sotomayor is dismissed as recist? Estrada had an impressive background and a sound resume. By contrast, even judges agreeing with Sotomayor find her to have a questionable temperament and lacking in judicial intellectual heft. try reasoning through this without the talking points next time.

My comment to my husband is always, "They think we are stupid!" Growing up in the South during integration I speak from experience. There are a few racist left but most of us have learned to accept people for who they are. I don't like "white trash", illegal immigrants, unwed mothers having babies just to get more welfare, black panthers bullying voters, I could go on but I do accept those who are responsible human beings working hard to do what is right and not continuing to be on the dole. This administration, Congress as well, is creating an even greater welfare state. Someday all those who are working to make a living will realize it is all for naught...then who will be taxed to death. The Supreme Court is an unelected, lifetime group who have extreme power. It should be made up of moderates who know the law and rule as the Constitution allows not a political appointment which will garner votes for one party or the other.

Dave, you seriously need to read a history book. It was the Democrats, specifically Southern Democrats, in Congress who tried their hardest to block the Civil Rights Act. Most Republicans voted for it. The South shifted Republican because they blamed it on JFK and LBJ, who was mostly pushing it forward on behalf of his predecessor. When that paragon of Hispanic jurisprudence Miguel Estrada was assessed by the Congressional Hispanic Caucus, he was roundly condemned as a millionaire's son, raised in privilege in Old Westbury, a millionaires' row community on Long Island.

He had no judicial experience, had never been anywhere a judge's gavel or held a seat as a Justice.

In addition, there was nothing "Hispanic" about him, execept for his surname. He had no record in the Hispanic community, no record of mentoring, assisting, or any special concern for Hispanics.

There WERE no Hispanic credentials, and no judicial ones either.

This article is yet another load of manure from York, a writer who specializes in shoveling what he is told to shovel.

The wingnuts on this site should take a step back and get some perspective. Sonia Sotomayor is a centrist judge, who has supported limitations on abortion; she is hardly a wingnut lefty. Further, she is a diabetic woman, and not likely to serve as long as someone without this affliction. Even if Republicans were successful in derailing her confirmation, the alternative would likely be less palatable for the posters on this site. Think about it.

First of all, Cardozo was considered Portugese not hispanic (pretty remarkable event though for the 1930's).

Both Dems and GOP block some judges for higher office for political reasons. That is not news (though its not right). Agree with York that Dems did that to Estrada, though the facts are that W put up 2 white men for Supreme Court and did not choose a Hispanic .. or woman .. or Asian American. Couldn't W have picked Estrada for Supreme Court? So GOP is in a pickle mostly of its own making.

GOP (most of them) are not racist, but they are racially insensitive.

Repubs should ask Sot.. her reaction to the words of Dems at past nomination hearings. They should show vids of the treatment they lovingly gave to Thomas, Rodgers,Estrada, Alito etc and remind America who they are.
They should not sink to the abyss in which Dems dwell ( "The war is lost!" Harry Reid etc)
They should carefully review her record.

This is typical liberal racism. To start with, they separate minorities from whites and practice identity politics. Than they demonize all minorities who don't follow the doctrine of "you are low and need help lifting yourself to the status of whites". It's sickening really. Even Obama, totted as the black man who made it, had to be qualified as part white before he could be accepted as something other than just another black man.

America will never be over racism as long as politicians and assemblies continue to differentiate minorities as the other Americans.

They don't deserve a chance, they deserve to be equal.

Why are we still on the subject of Estrada? Why are we still fighting over race? The main question is who is more qualified to take this job? Im totally against Sotomayor but not because of the color of her skin or because of where she came from, but because of the things she believes in and the ideas she has.
