Why tax problems have plagued Team Obama

It’s been a recurring question about the young Obama administration: Why have so many of its nominees come down with tax problems?

Timothy Geithner, Tom Daschle, Ron Kirk, Nancy Killefer, and a number of others who didn’t make it to the nomination stage — all have been felled, or tainted, by unpaid tax bills ranging from a few hundred dollars to more than $140,000. After the first few cases, Republican Rep. Eric Cantor quipped that “it’s easy for [Democrats] to sit here and advocate higher taxes because — you know what? — they don’t pay them.”

For their part, some Democrats have suggested that the Senate Finance Committee, which investigates nominees before confirmation, has gotten so nit-picky in examining tax returns that good candidates have gone down in flames. “The Finance Committee has gone a bit overboard, and I find it a little striking that a Democratic committee is doing this to a Democratic administration,” one anonymous insider told the Politico recently. “This has been a lot more in-depth and detailed, to the point of being silly.”

Now, we find out that neither Cantor nor the unnamed Democrat was correct. The problem is not with Democrats in general, nor with the Finance Committee in particular. The problem is the Obama White House, which, fully aware of its nominees’ tax issues, decided that those problems were trivial, or that the public wouldn’t care about them, and pushed forward with nominations that in the past would have been quietly shelved.

In little-noticed remarks last week, Sen. Charles Grassley of Iowa, the ranking Republican on the Senate Finance Committee, gave us a look inside the confirmation process. Irritated by news reports suggesting the committee had been too hard on Obama’s nominees, Grassley pointed the finger back at the White House.

“I want to stress that the Finance Committee is not doing anything different now from what it has always done under the leadership of either Senator Baucus or me,” Grassley said, referring to Democratic chairman Max Baucus of Montana. “We are vetting nominees for the current administration the same way we vetted nominees for the previous administration.”

“The tax issues of the nominees considered by the committee this year came to be public only because the nominees chose to proceed.”

Grassley said the committee has always requested three years of tax returns from nominees, and always employed experts to review them. And in the past, he added, “many nominees” faced questions based on their tax returns. The reason tax problems seem more prevalent now, Grassley explained, is that in previous administrations those nominees chose to quietly withdraw. Now, they try to stick it out, leading to sometimes embarrassing controversy. “Chairman Baucus and I agree that if a nominee chooses to proceed after tax issues are identified, then the public should be informed of those issues,” Grassley said.

I asked a Senate source close to the nominating process why the troubled nominations kept coming, in spite of the tax problems. “I think it was the administration underestimating what the grassroots folks who elected President Obama were going to object to,” the source told me. With the out-of-touch White House firmly behind the nominees, Senate Democrats got the message that they, too, needed to line up in support. So they did — until they started hearing from outside the Washington bubble. “If you look at Daschle’s experience, he came out of a meeting with members of the committee, and the Democratic members said they supported him,” the insider pointed out. “But on the next day he withdrew.”

So when it comes to tax woes, the White House has no one to blame but itself. Looking at the reports the Finance Committee staff produced on Geithner, Daschle and others, it’s impressive how bipartisan the work has been. Baucus and Grassley appear to be working together quite closely on nominations, and their assessments of nominees’ tax problems have been dry, matter-of-fact, and fair. Some members of Team Obama may believe the senators have gone too far, but it’s a very hard case to make.

So why the complaints? “I think it’s just someone in the administration being completely frustrated by what’s going on with their nominees and then attempting to discredit the process or discourage Baucus and Grassley from doing what they’ve always done before,” my Senate insider told me. “It hasn’t worked.”

A number of readers have suggested that the tax problems of Obama nominees point to, among other things, the need for a simpler, more rational tax system.  There's a difference of opinion on that, but there's no doubt that the nominees who ran afoul of the IRS should have been doing the things that all other Americans are required to do.  Sen. Grassley addressed this issue when he brought up the statement of a fellow senator (Grassley didn't name names, but it was Republican Lamar Alexander) who complained about "the maze of forms and onerous reviews for nominees."  Here's what Grassley said to that:

"If by “maze of forms” this individual is referring to the IRS Form 1040, then I agree that it is maze-like. But we shouldn’t hold the people who are literally running this country to a lower standard than the more than 130 million individuals and families that file a tax return every year."

At another place in his statement, Grassley also addressed the issue of the basic responsibilities of citizenship that nominees for high office, perhaps more than the average citizen, should observe:

"The Finance Committee has an obligation to thoroughly vet every nominee that comes before it.  Many, if not all, of these individuals will make decisions that will impact the lives of many people.  The purpose of the vetting process is neither to embarrass anyone, nor to further inject politics into the process.  Rather, the purpose of the vetting process is to ensure that nominees may be trusted with the responsibilities that come with serving in a Senate-confirmed position.

By ensuring that these individuals are paying their taxes, something which they should be doing anyway, we are ensuring they are, at a minimum, complying with the rules that in many cases they will help create and administer."

It's natural for Obama to think that since the voters gave him a pass on his monumental cheating in terms of facilitating illegal campaign contributions from foreigners and non-existent people, his nominees would get a pass too.

Most Americans in the middle have no clue who they elected or how corrupt the Democrats really are. With the help of the MSM a single corrupt GOP will get a year of negative press and be used to remind the masses of how corrupt the GOP is, but that same MSM will defend and ignore the run interference for the many many corrupt Democrats. What is is now...more corrupt Democrats have been outed in the Obama administration than all the GOP administrations since Nixon added together and the MSM ignores it.

The hypocrisy is overwhelming. Dodd: sweetheart deals w/countrywide. Frank: policy maker for Fannie/Freddie while his signif other was exec at Freddie; bailing out disastrous bank in Boston whose company car is a Porsche; Rangel: tax cheat in NYC; Pelosi: demanding G50 planes for trips that include family memebers, etc..... This administration is a fraud and sadly that under 30 crowd has no idea what will HIT them with this diaster they eleccted.

Ortenzio; GOP leader of Manhattan; admitted tax cheating (media called it "evasion") 11/15/2007 . Robert Beale; founder of Minnesota Christian Coalition, delegate to national Republican convention (did not file federal or state tax returns for four years, even though he received at least $5,696,574 in income between Jan. 1, 2000, and about September 2004.) Samuel J. Wurzelbacher owes the state of Ohio $ 1,200.00 in back taxes for his income.

Sen Obama opposed Fannie/Freddie reforms, and took lots of their cash for his campaign while they collapsed, with no consequences for him during the election. Barney Frank and Chris Dodd presided over the collapse, and still have their chairmanships. Charley Rangel is still around. With the media to cover for him all this time, he probably is surprised to find out how many of us are paying attention. He still doesn't know how betrayed many of us feel. For all of these men, it may yet worry them politically that they have betrayed us, but it doesn't seem to bother them personally.

We need a SIMPLER tax system. Think about the many man-hours spent in this country preparing and reviewing tax returns. Compare it to sales tax, which is collected more efficiently. Our system is so complex that a person can spend many hours learning about the tax rules and preparing his return, and even then he cannot be sure he did it all correctly. (I will add that from my experiences with people at the IRS call center, they know less than I do!)

There is a more fundamental aspect also. The tax code is so complex and convoluted that even the kinds of people selected for high administration positions, with all of their wealth, experience and/or connections, cannot reliably navigate through it without going astray. Yet the solution is to make it even more complex and convoluted and apply it rigidly and unerringly --- to the ordinary folks, while the wealth and/or connections of the "upper crust" gets them a pass.

Since when is owing back taxes the same thing as being a tax cheat? You can fill out a perfectly honest return, have no intention of evading taxes, but not be able to pay the whole thing when it's due, which is why the IRS will work out payment plans, or put liens on property. That's very different from what, say, Tim Geithner did, which was to be specifically informed about certain rules, and decide to ignore them anyway.

I am becoming increasingly disappointed at Team Obama. The tax cheat issue is one thing, and at least the Senate is doing some yeoman work -- that should have been down by Obama's people. But in my own mind, March 16 was the crowning BLOW! The president had a number of veterans organizations in town for a big photo op where the president touted what he was going to do for the brain injured troops through the Veterans Administration. What he failed to tell the press was that he also wanted them -- in his plans -- to buy their own health insurance to cover the costs!! See below for the blow by blow. No longer trust the man!!

If 3-5 million regular guy/gal taxpayers got out their tents, Coleman stoves, and coolers, we could shut down Washington, the Sunday Washington talk shows, the Congress, the streets, and DC services to protest the New State of Obama-Pelosi-Reid-Frank-Dodd-Geitner. This should require coordination of The Tea Party People, conservative talk show hosts, the Repulicians in Congress, Fox, WSJ, and others. Two things going on here. The first one is that Obama is very likely pathologically narcissistic. He can pick tax cheats because he wants who and what he wants, and everyone else needs to fall in line. Today in the news is Obama's wish to have those who have suffered war injuries to have to pay for their own medical care and rehabilitation. That is completely over the top, but it does not bother him one bit and he moving forward with this. The second issue is his involvement in Chicago politics. If you know the right people and know how to play dirty you (mostly) get your way. So, there you go. I know of no other plausible explanations as to why Obama is doing what he is doing to take this country down the pathway of ruin. He is not the brightest guy around, but it is hard to imagine that he is this stupid, either. Maybe it is stupid is as stupid does, with an asterisk.

I'ts easy for me to pay taxes b/c they come right out of my check before I even see the check. However if the fair tax is enacted I don't want to pay a 20% sales tax on EVERYTHING I buy and on top of that with no w-2, or 10-99's It will be increasingly difficult to pin down the taxes on everyone who is responsible for paying their own taxes Investors, excecs, anyone who does not draw a salary or paycheck. This also means no more tax rebate check every Jan.

Gee Byron, you make it sound like ther is a long conga line of Obama appointee tax cheats all summoned from parts unknown. Geithener was already part of the government when nominated, most of his former senate colleagues were winking at Daschle that he'd be confirmed any way when he started in the hearings process, Solis' husband had the minor issues any small business owner had and the nominee for the Performance Oversight post with drew even though she had long since settled a minoe tax bill. Not enough felons to fill a VFW hall I think.

I love visiting the Conservative websites from time to time just to see what's going on. Its much nicer on the winning liberal websites. All you do on the losing side is whine and complain about how bad Obama is and hoping he fails. That's what the losing party does of course. It does get tiring after a while reading this paper. If you wanted to, you could find that every single person in this country has a tax problem in some form or another. The reason Bush's nominess didn't get caught is because Karl Rove and his minions doctored the IRS records to hide the truth from the public. As such, Bush's nominees sailed though because everyone was under a cloud of fear that you would be called unpatriotic for refusing to kowtow to the Bush/Cheney/Rove/Ashcrift/Limbaugh radical religious right wing agenda. Now, all of a sudden the Republicans are making trouble because it is killing them that they have to answer to a black man and just can't accept his obviously highly-qualified nominees. Bush's tax cuts for the rich killed our economy, and the Republicans don't want it fixed because Big Oil and Haliburton are getting rich off the backs of the everyday man.

Here's the deal, folks. Correctly or not, Obama really thought these people were the best ones for the job. Whether that should have overridden the tax problems is debatable. But if they turn out to do a good job, people are likely to forget the tax problems. If they do a poor job, the tax problems will loom even larger in an assessment of the Obama administration.

Byron, I think you buried the lede. The fact that otherr nominees decide to quietly withdraw from the vetting process rather than let their tax problems come to light makes me wonder just how many people on both sides of the aisle are not paying their taxes! Your article makes it clear that this is a bipartisan problem. How the hell do all these people get away with not paying their taxes? What the hell is the IRS doing? A kinder, gentler IRS is one thing, but that doesn't mean they shouldn't be auditing - just do it with a smile.

No one should be walking around thinking that in Geithner's case anyhow, this is even plausibly an honest oversight. Geithner was paid a bonus explicitly for the payment of his self employment taxes and he had to sign a statement that he understood that and would do so. He did this several years in a row. So not only was this illegal supplemental payment tax free itself, that was not enough. He could not even pay the tax the way any other contractor does. He is a liar, a criminal and a cheat. As such he is the perfect figurehead for the putrid fraud that is the racist, socialist and anti-American Barack Obama Administration and traitorous Democratic party. These are pirates, pure and simple.

Well done, Byron. Miss you over at NRO, but you seem to be doing fine here. As for these hapless nominees, if my husband and I have to hire an accountant to do our taxes (including paying taxes on childcare providers) in order to get it right, then anyone who wants to work in government should be held to the same standard. What this does is show the system for the insanely convoluted mess that it is--and it highlights the fact that rational people do not want to slave for the government.

There is no excuse for these people not paying their taxes! I have been a peaceful American who has never been an activist in politics but this has provoked and outraged me. I shall be a part of THE TEA PARTY coming my way in April. All of the Congressmen and women and the Executive office is doing is interesting... bringing those of us couch potatoes out in the USA a reason to bring about a REVOLUTION! Now we find that the administration is considering what we will and won't care about, and making decisions based on those assumptions. Unfortunately, since Grassley's name comes up so much here, I have to agree with the administration on this one, and I'm no Obama supporter. Grassley has been nuts for the past two years nearly on every nitpicky tac issue he can find, and frankly, I'd like to hear more about this man's background because I never heard of him before all this grandstanding and outrageous behavior.
