Democrats are very afraid of the yet-to-be-made mistaken-identity defense

Democratic Sens. Dianne Feinstein, Dick Durbin, and Pat Leahy all asked Christine Blasey Ford about something that Republicans haven’t brought up this hearing yet: that perhaps Ford is mistaken about who attacked her.

That suggests that they think this is the biggest threat to Ford’s charges. We can presume Senate Democrats know something that we the public do not know about what evidence Republicans have on hand. Given the reports that the Committee has testimony about other men saying they were the perpetrator.

While the GOP hasn’t provided any evidence to that effect yet (as of noon), it’s not insane that she may have the wrong person in mind. Mistaken identity in the case of rape is not unheard of.

Terry McAuliffe pardoned a man who was convicted of rape. The Washington Post reported, “Final proof that Michael Kenneth McAlister, 58, was wrongly convicted came when another man — a serial rapist who bore an uncanny resemblance to McAlister — recently confessed to the 1986 attempted rape and kidnapping in Richmond, the governor said.”

James Curtis Giles spent 10 years in prison before being cleared on the grounds of mistaken identity.

This defense would make it possible that neither Ford nor Kavanaugh are lying.
