Former House Oversight Committee Chairman Jason Chaffetz posted a photograph on Instagram Wednesday showing what appeared to be a homeless man in New York City's Times Square using a smartphone.

Chaffetz, a Republican representing Utah until he retired last month, previously drew criticism earlier this year when he suggested low-income Americans should invest their money in healthcare rather than "getting that new iPhone that they just love."

The comment came as House Republicans were discussing their Obamacare replacement plan.

Before he retired, Chaffetz also proposed that members of the House and Senate should receive a $2,500 monthly housing allowance.

Chaffetz is now a political analyst with Fox News.
