Prosecutors say Three Percenter’s children will testify against him in Capitol riot trial

Two children of a Texas member of the Three Percenter militia group are expected to testify against their father this month in a Capitol riot trial, according to a witness list from the Justice Department.

Jackson, 19, and Peyton Reffitt, 17, are expected to testify that Guy Wesley Reffitt, who is facing charges related to his actions on Jan. 6, threatened them not to cooperate with the FBI’s investigation, insisting that “they would be traitors, and that traitors get shot,” according to federal prosecutors in a Monday court filing reported by Politico.

Jackson will also testify about a threat his father made to him after returning from Washington, D.C., “about cooperating with the FBI’s investigation,” prosecutors said.

Several pieces of evidence admitted include group texts his father sent while he was away with a link to a Fox News segment circling himself in videos and an audio recording of his father in their home around Jan. 9-10.

“He will testify to the words the defendant used, why he perceived them to be a threat and took them seriously, and the steps he took to secure his own safety after that incident,” the court filing described.

Peyton Reffitt is expected to corroborate her brother’s story that her father’s intention was “to intimidate her,” prosecutors added.

Guy Reffitt, who was arrested Jan. 19, 2021, is scheduled to begin trial Feb. 28. He is facing several charges, including obstruction of justice, illegally entering the Capitol complex, and obstructing Congress’s counting of the 2020 Electoral College votes. Guy Reffitt has pleaded not guilty to all counts.

Reffit is one of more than 670 people who have been charged, many with misdemeanors, as part of the Justice Department’s Jan. 6 investigation.

Several other witnesses are expected to testify in the trial, including another alleged Three Percenter member under immunity, a Secret Service member, Senate staff, and FBI agents.
