Tony Evers called for a special session of the state’s legislature toward the end of the month to consider repealing an 1849 abortion law.
Evers, a Democrat, called the law “criminal” and urged the Republican-controlled legislature to end the ban, which forbids women from getting an abortion at any time during pregnancy.

“This isn’t about politics — it’s about empathy, compassion, and doing the right thing,” Evers said in a statement. “It’s about making sure the people we care about get the healthcare they need when they need it.”

The law makes performing an abortion a felony unless two doctors determine the pregnancy poses too great a risk to the life of the mother.
The ban has been irrelevant for the last 50 years as Roe v. Wade, which guaranteed women would have access to abortion, overruled any restrictions states placed on the procedure. However, the leak of a first draft of a Supreme Court opinion on an abortion law in Mississippi appeared to show a majority of the court is ready to overturn Roe, handing authority to regulate abortions back to states.
Wisconsin Attorney General Josh Kaul said if the court did overturn Roe, he would not prosecute or investigate the doctors who performed the procedure, according to the Associated Press.

Evers has called multiple special sessions for the state’s lawmakers during his term, urging them to consider reform on other matters such as education funding, gun control, and how to spend the budget surplus. Those cases were dismissed by both state chambers.
