A federal appeals court on Tuesday rejected Exxon Mobil’s attempts to sue the attorneys general of New York and Massachusetts, delivering a blow to Exxon in its effort to halt the inquiries over whether it lied to its investors and the public over its knowledge of climate change.
New York Attorney General Letitia James issued a statement praising the decision, which was handed down by the 2nd U.S. Circuit Court of Appeals in Manhattan.

“We are pleased with the Second Circuit’s decision today, which rejected Exxon Mobil’s baseless attempts to challenge state law enforcement efforts,” James said. “We will continue our efforts to protect New York consumers and investors from any harm or deceit.”
The decision comes after the U.S. District Court for the Southern District of New York rejected the original lawsuit Exxon Mobil had filed against New York in 2018, claiming that the state discriminated against Exxon and violated the company’s constitutional rights with its investigation.
Exxon had appealed that decision to the U.S. Court of Appeals for the 2nd Circuit, which rejected that appeal and again dismissed Exxon’s attempts to sue the state.

In its decision, the appeals court also ruled that Exxon could not sue Massachusetts Attorney General Maura Healey in federal court because it was pursuing the same case in state courts.
