The federal government is citing a recent opinion from Judge Norman K. Moon that upheld the constitutionality of the new health care law to bolster its argument in a separate health-care lawsuit brought by Virginia.
In a Friday filing in the U.S. District Court for the Eastern District of Virginia, lawyers for the Justice Department highlighted Moon’s Nov. 30 decision to dismiss a separate lawsuit from Liberty University, filed in the U.S. District Court for the Western District of Virginia, and declare the health care law constitutional as further evidence in its case.
U.S. District Judge Henry E. Hudson has said he’ll likely rule on the constitutionality issue in the lawsuit filed by Virginia Attorney General Ken Cuccinelli by the end of the year. Cuccinelli recently said he’s weighing a move to expedite a ruling that would bypass the appeals court process and go straight to the Supreme Court.
