Biden: I wouldn’t stop Trump prosecution if DOJ pursued it

Joe Biden said he would not stand in the way of the Department of Justice if it decided to pursue charges against Donald Trump if he were to win November’s election.

The former vice president noted that it would be “very, very unusual” and “not very … good for democracy” for a former president to be indicted, but noted that he wouldn’t stop it from happening during a virtual interview with the National Association of Black Journalists and National Association of Hispanic Journalists on Thursday, according to Fox News.

“Look, the Justice Department is not the president’s private law firm,” Biden told NPR reporter Lulu Garcia-Navarro. “The attorney general is not the president’s private lawyer. I will not interfere with the Justice Department’s judgment of whether or not they think they should pursue the prosecution of anyone that they think has violated the law.”

He then said that he’d leave it up to the attorney general to decide whether to pursue charges against Trump.

“If [a case] prove[s] to be a criminal offense, then, in fact, that would be up to the attorney general to decide whether he or she wanted to proceed with it. I am not going to make that individual judgment,” Biden said.

Before Biden answered the question, Garcia-Navarro noted that Sen. Kamala Harris, one of the most popular names among Biden’s potential vice presidential candidates, said that the Department of Justice “would have no choice” but to prosecute Trump based on the findings of the Mueller report.
