Lawyer for 75-year-old Buffalo man shoved by police says his ‘brain is injured’

The attorney for Martin Gugino, the 75-year-old Buffalo protester who was hospitalized after being shoved to the ground by police, says his client’s “brain is injured.”

A widely circulated video showed two officers pushing Gugino, causing him to hit his head and crack his skull. Gugino’s lawyer said he was starting physical therapy this week.

“As heartbreaking as it is, his brain is injured and he is well aware of that now,” the attorney said in a statement. “Because of this, he told me that he is not interested in media interviews right now. He feels encouraged and uplifted by the outpouring of support which he has received from so many people all over the globe. It helps. He is looking forward to healing and determining what his ‘new normal’ might look like.”

Fifty-seven members of the Buffalo Police Department resigned from a special squad last week after the two officers, identified as Aaron Torglaski and Robert McCabe, were suspended after shoving Gugino.

Torglaski and McCabe were charged with second-degree assault on Saturday and released without bail after pleading not guilty.
