A government transparency group is suing to obtain documents in an investigation of Carlos A. Martinelly-Montano, an illegal immigrant accused of killing a nun in August while driving drunk. The conservative nonprofit Judicial Watch said it filed the Freedom of Information Act lawsuit to get access to an internal Department of Homeland Security investigation about Martinelly-Montano’s deportation process.
At the time of the crash that killed Benedictine nun Denise Mosier, Martinelly-Montano had been released from federal authorities while awaiting a deportation hearing for two years. He had two previous drunken-driving convictions.
DHS Secretary Janet Napolitano ordered an investigation after the crash into why the deportation process took so long. Officials said last month that inquiry was complete but would not be released.
