lawsuit
against six
Texas
medical schools
alleging they illegally discriminated against white, Asian, and male applicants in their admissions processes.
America First Legal filed a federal lawsuit alleging “illegal racial discrimination” Tuesday in the U.S. District Court for the Northern District of Texas against officials at Texas Tech University Health Sciences Center, the University of Texas at Austin’s Dell Medical School, the University of Texas at Houston’s McGovern Medical School, the University of Texas at Galveston’s John Sealy School of Medicine, the University of Texas San Antonio’s Long School of Medicine, and the University of Texas Southwestern Medical School.

The plaintiff of the lawsuit, George Stewart, claims that he applied for admission at all six medical schools for the 2021-2022 term but was denied admittance. A public records request revealed that the six schools had favored the admission of black, Hispanic, and female applicants over white, male, and Asian applicants who had higher grades and standardized test scores.
“Today, America First Legal makes history by striking at the heart of the equity industry that is overtaking the medical profession,” America First Legal President Stephen Miller said in a news release Tuesday. “We are suing six medical schools for illegal racial discrimination: denying entry to qualified applicants solely because they are the ’wrong’ race.”
Stewart, the lawsuit says, graduated from the University of Texas at Austin with a GPA of 3.96 and scored a 511 out of a possible 528 on the Medical College Admissions Test but was still rejected. Meanwhile, students from minority backgrounds were admitted with GPA scores as low as 2.82 and MCAT scores as low as 495, according to the public records obtained by Stewart.
“The data demonstrate that each of the defendant medical schools is providing admissions preferences to female, black, and Hispanic applicants while unlawfully discriminating against whites, Asians, and men in admissions decisions,” the lawsuit says.
In their press release announcing the lawsuit, America First Legal blasted the medical schools for pushing a “divisive ‘equity’ agenda.”
“When you or a loved one shows up in an emergency room, all you care about is getting the best treatment possible — not whether the Hospital’s VP of Equity has fulfilled a quota,” Miller said.

Affirmative action, which allows universities to consider race in admissions, is currently legal on a limited basis. Supreme Court cases in recent decades have said that schools may consider race in admissions, but not as a primary variable. In October, the court heard oral arguments in two cases that asked the court to declare all race-based admissions considerations illegal. A decision is expected in June.
