Attorney General Merrick Garland notified Congress that special counsel Robert Hur completed his report on the investigation into President Joe Biden’s handling of classified documents, but witnesses who contributed have not been able to view it.
Classified documents were recovered from the Penn Biden Center in Washington and the president’s home in Delaware. Last year, Garland appointed Hur, a Republican, to investigate Biden keeping documents after being vice president. A law governing presidential records states presidents and vice presidents must return government records to the National Archives and Records Administration upon leaving office.
Hur’s report is under legal review, and ABC News reported that he declined to let witnesses who cooperated review the documents before the public does, according to an attorney representing 20 witnesses. Attorney Michael Bromwich reportedly urged Hur to let the witnesses look over sections of the draft, telling his team that without such a review, “proper factual context” about the information from the witnesses could be overlooked.
“It’s a huge process foul and not in the public interest,” Bromwich said.
Garland said Hur filed the report on Monday, and he expects to make the documents available to the public soon.

“I am committed to making as much of the Special Counsel’s report public as possible, consistent with legal requirements and Department policy,” Garland wrote in a one-page letter. “I will produce to Congress the report, its appendices, and the letter from counsel following completion of the White House’s privilege review.”
The letter did not mention any charges and provided little detail about the investigation. Multiple reports suggest no criminal charges are expected to be filed in the investigation. The public release of the report is pending based on Biden’s White House Counsel’s Office legal privilege review, which is expected to be completed later this week, White House spokesman Ian Sams said, per Politico.
