Hochul proposes banning ‘deceptive’ AI used in misleading advertisements

Gov. Kathy Hochul (D-NY) proposed banning the “deceptive” use of artificial intelligence, including its misleading use in advertisements.

Hochul’s office told Axios that the new proposed legislation would ban the “deceptive” use of AI in various manners and require the disclosure of AI usage in campaign ads. One of the laws would establish the crime of “unlawful dissemination or publication of a fabricated photographic, videographic, or audio record.”

Another provision would expand punishment for the use of AI in coercion, criminal impersonation, and identity theft. Existing revenge porn laws would be expanded to include AI-generated nude or sexual images of someone. The right to sue over AI-manipulated images would be codified.

The use of AI in political campaigns was included in some of the measures as well. Political campaigns would be required to disclose the use of AI in any form of political communications, “including video recording, motion picture, film, audio recording, electronic image, photograph, text, or any technological representation of speech or conduct,” within 60 days of an election, Hochul’s office told the outlet.

The proposals are part of Hochul’s executive budget proposal, which will be unveiled in full at the end of March.

AI and its abuses have become a hot-button topic in recent years, with fears accelerating amid rapid developments in the technology over the past year.
