Byung J. “BJay” Pak, a former Atlanta-based U.S. attorney who resigned after President Donald Trump pressured Georgia election officials to pursue false allegations of election fraud, testified Monday that a purported suitcase of ballots in heavily Democratic Fulton County was false.

In the weeks after Election Day, when Trump lost to then-candidate Joe Biden, Rudy Giuliani falsely claimed that Georgia election workers engaged in ballot fraud.
Pak said Attorney General Bill Barr asked him to investigate the claims to prepare him for a meeting at the White House. Pak said Barr had already said he did not believe there was evidence of systemic election fraud. But Pak said he wanted to have the details about the allegations made by Giuliani, a onetime Trump lawyer and former New York City mayor. So, Pak said his office conducted an investigation of the video.
Pak said the so-called suitcase was actually “an official lockbox where ballots were kept safe.”
The clip circulated by Giuliani, who characterized it as a smoking gun of fraud, was incomplete and out of context, Pak said.
“We interviewed, the FBI interviewed, the individuals depicted in the video,” Pak said, determining that nothing irregular occurred.
In written testimony, Pak added that Giuliani’s claims “were simply untrue and making such a claim was reckless,” adding that the election workers were doxxed and threatened and required protection from state law enforcement.

“The allegations made by Mr. Guiliani were false,” Pak said.
