Last week I wrote about two members of the American Law Institute’s proposed draft of a model penal code that would vastly expand the definition of “sexual assault” so as to make nearly all sex illegal. While other members of the organization appeared to disapprove of that draft, another proposal has gained traction — one that could make any touch (even non-sexual touches) a civil liability if someone so chooses.
The proposal, a Restatement of Torts relating to assault and battery, was approved by the organization’s members last month.
