A new report that federal investigators have unearthed sufficient evidence to levy charges against Hunter Biden isn’t adding up, according to former U.S. Attorney for the District of Utah Brett Tolman.
Describing the Washington Post story about growing evidence of chargeable offenses as a “very awkward, clumsy story,” Tolman sought to poke holes in its underlying logic and pondered if someone leaked the information to bury assertions made by whistleblowers claiming the FBI inquiry was riddled with political bias.

“So much of it doesn’t make sense, Martha,” Tolman told Fox News’s Martha MacCallum. “It is a very awkward, clumsy story that seems to be identifying what is happening. … Some of this doesn’t add up. It does add up if, in fact, the whistleblowers are correct and they are trying to bury the story.”
The Washington Post reported Thursday that federal investigators believe they have sufficient evidence to charge Biden with tax crimes and a false statement pertaining to a gun purchase and that the next step is for the U.S. attorney in Delaware to decide which charges to file.
It has long been known that federal prosecutors have been mulling charges against Biden, the adult son of President Joe Biden, on tax crimes and the purchase of a firearm at a time when he should have been restricted from making the purchase due to his drug addiction.
On the firearm issue specifically, the new report indicated the federal authorities now believe they could charge him for lying on a form, but Tolman, who is the executive director of Right on Crime, felt that was illogical.
“The charges themselves, they talk about the lying and buying. … Why would you bring that charge when you have him actually possessing the firearm? You would bring the possession of a firearm by a user of narcotics instead of lying and buying because it has a far greater punishment. Some of this doesn’t add up,” Tolman explained.

Tolman also noted that the grand jury overseeing the case has expired, which adds a roadblock to the prospects of levying charges against Hunter Biden.
“The other is in relation to the charges they make, and first of all, the grand jury has expired. So they have the charges already and kept them under seal, or they do not have an ability to present any of these charges unless they impanel a new grand jury,” he added.
So far, the Justice Department has declined to comment on the report. The younger Biden has denied wrongdoing.
