Massachusetts prosecutors announced they are dropping sex assault charges against actor Kevin Spacey, according to a document filed with the court.
The document filed by Cape and Islands District Attorney Michael O’Keefe said prosecutors would be dropping the case “due to the unavailability of the complaining witness.”
Spacey, 59, was formally charged in January with indecent assault of a teenager a year after a news anchor accused him of sexually assaulting her son, William Little.
Little, now in his early 20s, alleged Spacey had sexually assaulted him after he was plied with alcohol.
During a pre-trial hearing earlier this month, Little invoked his right to remain silent on the witness stand. Little’s case hit a snag after it came out that Little’s mother had deleted data from her son’s phone, which could have been useful to Spacey’s defense.
Defense attorneys determined that key messages from Little’s phone had been deleted before being handed over to investigators.
The House of Cards actor would have faced up to five years in prison if convicted.
