Former Baltimore Mayor Martin O’Malley illegally fired former Baltimore Police Commissioner Kevin Clark in 2004, Maryland’s highest court ruled today.
The Court of Appeals ruling sends Clark’s $120 million lawsuit seeking reinstatement of his job back to Baltimore Circuit Court for trial.
O’Malley fired Clark after a domestic dispute with Clark’s girlfriend made headlines in 2004, but Clark eventually was cleared by the Howard County police and never charged.
Clark argues his firing violated state law and that using a SWAT team to force him from office amounted to a violation of his rights.
