Judge: Cops must warn Occupiers before evicting them

A federal judge on Tuesday said he will issue an order requiring the National Park Service to notify the court and Occupy DC’s lawyer before removing the protesters’ tents from McPherson Square.

The order would not apply to tents that are violating the camping ban. The Park Service has already given notice that it would seize those tents as evidence if they catch protesters sleeping in the park. Notice would have to be given before police can remove tents that are in compliance with the camping ban – those from which bedding has been removed.

District Judge James Boasberg didn’t specify how far ahead of time the government must warn Occupy DC before initiating evictions, but he did say they must give the group enough time to respond in court. 

Another injunction filed Monday also came before the court Tuesday morning. That motion, filed by Georgia resident Dane Charles Primerano, requested a temporary restraining order that would stop the Park Service from enforcing a camping ban in the park. The government hadn’t completed a response to that requested injunction, so Boasberg put off a decision.
