Supreme Court Justice Ruth Bader Ginsburg on Tuesday missed a second day of oral arguments as she continues to recover from cancer surgery, Chief Justice John Roberts said Tuesday.
Roberts marked Ginsburg’s absence — for the second day in a row — before the court heard arguments in two cases Tuesday. Roberts noted she will participate in the consideration of the cases based on the briefs filed and argument transcripts.
The eight other justices convened to announce opinions in two cases and hear arguments in two more cases.
Ginsburg, 85, was also absent from the bench Monday, which marked the first time she missed an oral argument in her 25-year tenure on the Supreme Court.
The justice underwent surgery Dec. 21 to remove two malignant nodules from her left lung and was discharged from Memorial Sloan Kettering Cancer Center on Christmas Day.
She has since been recuperating from home.
The cancerous growths on Ginsburg’s left lung were discovered when she underwent testing after fracturing three ribs in a fall Nov. 7.
Ginsburg is the oldest member of the court and the leader of its liberal bloc.
