Hunter Biden investigation: Prosecutors are at ‘impasse’ on plea and expect a trial

Prosecutors say plea negotiations in the Hunter Biden case are “at an impasse” and President Joe Biden‘s son is likely heading toward a criminal trial — but not in Delaware.

Last month during the younger Biden’s arraignment, the judge presiding over the hearing was hesitant to move forward with the plea agreement established between his attorneys and U.S. Attorney David Weiss‘s office.

The Friday filing from prosecutors came just a moment after Attorney General Merrick Garland gave Weiss special counsel status in the investigation over the first son.

As part of the plea deal that is now off, prosecutors initially agreed to file their charges against the younger Biden in Delaware.

However, the new motion from prosecutors says that since Hunter Biden did not plead guilty, a trial must take place in the venue where the alleged crimes took place, which would be the central district of California or Washington, D.C.

Hunter Biden’s attorney Chris Clark release a statement in response to Weiss’s appointment as special counsel, arguing Garland “made clear what was always the case in terms of the authority of the U.S. Attorney’s Office in Delaware in this matter.

“Whether in Delaware, Washington, D.C. or anywhere else, we expect a fair resolution on behalf of our client — this U.S. Attorney has diligently been investigating my client for five years and he had proposed a resolution which we fully intend to pursue in court.”

Clark said he is “confident” that once all the legal maneuverings have ended, his client will have “resolution and will be moving in with his life successfully.”

The now-defunct plea agreement included the younger Biden pleading guilty to two misdemeanor tax charges and entering a diversion agreement for a felony gun charge, though the younger Biden wound up pleading not guilty to the tax charges in a surprise turn of events on July 26.
