BRIDGEVIEW, Ill. (AP) — A Cook County judge is expected to schedule a hearing on whether a suburban Chicago businessman convicted of killing his wife should get a new trial.
The Southtown Star reports (http://bit.ly/1laOBG1 ) Allan Kustok is set to appear in court Friday.
In March, a jury found the 63-year-old guilty of first-degree murder for the 2010 death of his wife, Anita “Jeanie” Kustok.
Prosecutors accused Allan Kustok of shooting his wife in the head while she slept. Defense attorneys said she committed suicide.
Laura Morask is an attorney for Kustok. She says the defense wants to have more testing done on the gun that killed Anita Kustok. She says it could show the gun was fired by accident.
Kustok is in custody awaiting sentencing. He faces at least 45 years in prison.
