A judge granted New England Patriots owner Robert Kraft’s motion on Monday to suppress video evidence in a prostitution case centered around a Florida spa.
Video obtained by police allegedly showed the 77-year-old engaging in massage parlor sex at Orchids of Asia in January.
“The fact that some totally innocent women and men had their entire lawful time spent in a massage room fully recorded and viewed intermittently by a detective-monitor is unacceptable,” Palm Beach County Judge Leonard Hanser said in his ruling, blocking video evidence taken by police in a sting on the Florida spa from being used in court.
It wasn’t immediately clear if prosecutors would appeal the decision. A source told USA Today that Kraft’s attorneys are ready to file a dismissal of the case in the coming days.

In February, Kraft was charged with two misdemeanor counts of soliciting sex at the Florida massage parlor as the result of a monthslong investigation that incriminated more than 100 people. Kraft pleaded not guilty but offered an apology in March.
“I know I have hurt and disappointed my family, my close friends, my co-workers, our fans and many others who rightfully hold me to a higher standard,” Kraft said in a statement.
Prosecutors offered Kraft a deal he declined in March that would have dropped charges if he admitted his guilt in the case. Kraft has owned the Patriots since 1994.
