A former commander in the U.S. Navy Reserve pleaded guilty for continuing to accept active duty pay more than a year after his tour ended.

Prosecutors in Maryland said Carl W. Marquis, 48, of Burke, received overpayments of more than $159,000 after he finished a three-month active duty assignment at the Naval Air Station Patuxent River in 2009.

Marquis failed to notify anyone with the Defense Department to correct the overpayment. In August 2010, his unit administrator uncovered the fact that Marquis had never processed out from his active duty tour .

Marquis said he would correct the problem but didn’t comply for nearly four months. Prosecutors said he had spent all but $25,000 of the overpayment.

He faces up to five years in prison.
