Gov. Ron DeSantis announced Thursday he and the state of Florida will be suing the Biden administration over another of its vaccine mandates.
The Republican said in a press conference his state is suing the federal government because the Occupational Safety and Health Administration’s rule, which targets employers with 100 employees or more, is “not consistent with the Constitution.”
DeSantis also said he found it “interesting” how the OSHA rule took two months for it to be issued despite being deemed an “emergency power.”
“And, of course, the rule doesn’t take effect until January, which is convenient because it’ll minimize workforce disruptions over the holiday season, which we know we’re likely to see anyways, and then, this would only exacerbate that,” DeSantis said. “So, this is not consistent with a government of limited and enumerated powers.”

Under OSHA’s rule, private companies with 100-plus employees are required to get their employees vaccinated against COVID-19 prior to Jan. 4, 2022. If employees fail to get vaccinated, they will have to test weekly for COVID-19. The rules say there is a $14,000 fine for each violation, according to ABC7.
DeSantis also pointed out the practical strains of implementing OSHA’s vaccine mandate, specifically the nation’s supply chain problem. He noted if even a few truckers lose their jobs for not getting vaccinated, it would be “catastrophic” and cause ripple effects throughout the entire economy.
Florida has joined Georgia, Texas, and other states in resisting COVID-19 vaccine mandates.
In another lawsuit against the Biden administration, which DeSantis announced in late October, he sued over its requirement that federal contractors get vaccinated.

DeSantis, who is widely seen as a 2024 presidential front-runner, is no stranger to speaking out against Biden.
He referred to the Biden administration on Wednesday as “the Brandon administration,” a play on the popular “Let’s go, Brandon” chant. The “Let’s go, Brandon” joke started after a reporter mistook chants about the president from a NASCAR crowd as cheers for racer Brandon Brown. The now-viral phrase is a euphemism for the actual chant: “F*** Joe Biden.”
